Cole described a recent transaction in which a title defect caused a buyer to walk away and later restart the financing process, creating costs for both buyer and seller. A committee member asked about notice to mortgage holders; the response was that the lender bears responsibility for recording and extending the mortgage, and that due process rights would remain if a lender later contested the discharge.
Ryan Hill of the New Hampshire Bankers Association said the banking industry had reviewed the bill and was generally comfortable with it, while requesting a delayed effective date so members would have time to adjust their recording practices.
