The Department of Corrections then received approval for a smaller shortfall transfer and a larger overtime-related transfer, with officials citing a 52% corrections officer vacancy rate, ongoing recruitment, academy classes, and efforts to use civilian staff in some non-security roles. A late item from the Veterans Home was also approved to cover overtime, holiday pay, and indirect cost shortfalls within its existing budget.
The committee then heard an informational presentation on implementation of Senate Bill 134 and the new federal Medicaid work-requirement rule. DHHS said it plans to submit a state plan amendment, seek approval for hardship exceptions, start with one eligibility check cycle, and use existing federal grant funding to make system changes. Finally, the committee received a performance audit of the Doorway opioid treatment program, which found weak written procedures, incomplete data use, reimbursement delays, and problems with the Governor’s Commission on Addiction Treatment and Prevention. Members discussed follow-up reporting, and the next Fiscal Committee meeting was scheduled for August 21 at 11:00 a.m.

The committee began with a presentation on the 520 Native American Language and Culture certificate, created to let proficient tribal language and culture speakers teach in K-12 schools without a bachelor’s degree. LESC staff, PED, and HED described the certificate’s statutory basis, the role of tribes and pueblos in setting proficiency standards, and ongoing challenges such as uneven MOAs, limited professional development, rural access barriers, data gaps, and retention concerns. A student, Alonzo Hughes, testified about how learning Tewa from 520-certified teachers helped him understand his culture and speak with elders, and members praised the program’s role in language revitalization and asked about funding, teacher pathways, and whether similar models exist in other states.
Committee members then discussed several PED rule updates. Staff reviewed an adopted rule implementing HB 54 on AEDs and cardiac emergency response plans, including staff training requirements and staggered compliance dates, and a proposed rule for school nurse licensure under HB 195 that would create a three-tier system and align nurse pay with teacher pay. They also reviewed proposed changes to the Community Schools Act rule, including a full-time community school coordinator requirement, updated grant language, and broader coalition membership criteria; PED said the broader language would not conflict with the Martinez-Yazzie work. A proposed bilingual teacher rule would standardize coursework requirements, add trans-languaging and culturally relevant curriculum competencies, and allow Native American language certification applicants to demonstrate proficiency using tribal standards.
In questions, members raised concerns about AEDs being present at athletic events, the need for the amended school nurse bill to move experienced nurses directly into higher levels, and whether the community schools rule’s broader coalition language could affect current education litigation. Members also asked about funding for 520 programs, teacher residency or cohort models, and how to support advanced language instruction and sustainability. PED said the Indian Education Fund and school budgets can support some of the work, but additional strategic funding and cross-training are needed. The committee also heard that New Mexico’s 520 system is unusually robust compared with other states, and members encouraged staff to present the model at national conferences. The meeting ended with the director’s report, which noted a flat budget request of $2,024,300, staff turnover including Natasha Davalos’s departure, and appreciation for the committee’s work before adjournment for the holidays.

The State Auditor recommended the legislature establish oversight authority and require a lead organization to coordinate and evaluate statewide digital equity efforts and develop a unified plan. The Department of Commerce and Office of Equity agreed with the need for clearer leadership and coordination, and a public witness described ongoing coalition and local planning work. Committee members asked about best practices from other states and whether the auditor could provide additional research on coordination models.
In the Digital Navigator Program audit, the State Auditor concluded Commerce did not consistently follow core grant-management practices, including competitive award processes, vetting of grantees, clear contracts, performance monitoring, and reimbursement controls. Auditors said Commerce expanded grants without a new competition, lacked adequate documentation and reporting, and paid out millions without sufficient support; they also cited management decisions that overrode staff concerns. Commerce said it had already begun major contract-management reforms, created a new contracts and compliance structure, and was working on risk assessments, documentation standards, and staff training. Members pressed Commerce on accountability, possible recoupment of improper payments, ethics issues, and whether the agency had clear performance metrics for the program. No votes were taken, and the hearing ended after public testimony and committee discussion.

JLARC members asked about the scope of the district testing, whether smaller districts face greater risk, the meaning of the funding discrepancies, and whether the system could support a future change to a simpler per-student funding formula. Auditors said the discrepancies were small but could compound into millions statewide, and that the audit did not evaluate broader policy questions or alternative system owners. They recommended OSPI modernize or replace the system and address current control weaknesses while the new platform is developed.
OSPI officials largely agreed that the current platform needs replacement and said a feasibility study completed in 2024 found the system at catastrophic risk of failure. They clarified that the Legislature had approved up to $16 million in the state IT pool for the project, but that funding is released through gated oversight and not all of it had yet been appropriated for the current biennium. OSPI disputed the auditor’s characterization of some rounding and budget-law issues, saying the calculations were consistent with agency rules and legislative inputs, and explained that some manual workarounds are used to handle newer statutory requirements. One member of the public testified in support of modernizing the system and strengthening controls. The committee then adjourned.

Deputy Auditor General Matthew Tracy explained how to read operational audit reports, including findings, criteria, condition, cause, effect, recommendations, and management responses. Deputy Auditor General Greg Senators explained financial audit reports, including audit opinions, required supplementary information, internal control and compliance findings, federal program compliance, and management letters.
