<p><strong>Separation of Powers Restoration Act</strong> <b>of 202</b><strong></strong><b>3</b></p> <p>This bill modifies the scope of judicial review of agency actions to authorize courts reviewing agency actions to decide de novo (i.e., without giving deference to the agency's interpretation) all relevant questions of law, including the interpretation of (1) constitutional and statutory provisions, and (2) rules made by agencies. </p> <p>No law may exempt a civil action from the standard of review required by this bill except by specific reference to such provision.</p>

<p><b>Commercial Cabins for Cabinet Members Act</b></p> <p>This bill prohibits the Department of Transportation from using charter air transportation until Congress enacts a law that authorizes appropriations to carry out activities of the Federal Aviation Administration for FY2024.</p>

<p><strong>Unmasking the Origins of COVID-19 Act</strong></p> <p>This bill authorizes the Department of State to pay a reward for information leading to the identification of the origins of COVID-19 or other related information, such as the identification of individuals or entities involved in a cover-up of the origins of COVID-19.</p>

<p><b>Cyber Vulnerability Disclosure Reporting Act</b></p> <p>This bill requires the Department of Homeland Security to submit a report describing the policies and procedures developed to coordinate the disclosure of cyber vulnerabilities. The report shall describe instances&nbsp;when these policies and procedures were used to disclose cyber vulnerabilities in the previous year. Further, the report shall&nbsp;mention the degree to which the disclosed information was acted upon by stakeholders. </p>

<p><b>Stopping Abusive Student Loan Collection Practices in Bankruptcy Act of 2023 </b></p> <p>This bill requires a bankruptcy court to grant a debtor attorney's fees and the costs of the proceeding if (1) the debtor's student loan debt is discharged on the basis of undue hardship, and (2) the court finds that the creditor's position was not substantially justified. </p>

<p><strong>Breath of Fresh Air Act</strong></p> <p>This bill establishes a grant program for local educational agencies to purchase, and train school personnel to use,&nbsp;nebulizers.</p>

<p><b>Chisholm National Historic Trail and Western National Historic Trail Designation Act</b></p> <p>This bill designates (1) the Chisholm National Historic Trail, and (2) the Western National Historic Trail.</p> <p>The Department of the Interior shall administer any portion of these trails that is located on nonfederal land only (1) with the voluntary consent of the owner of the nonfederal land, and (2) if the portion qualifies for certification as a component of the applicable trail. The approval by an owner of applicable nonfederal land of a certification agreement shall satisfy the voluntary consent requirement. A certification agreement may be terminated at any time.</p> <p>The establishment of these trails does not authorize any person to enter private property without the consent of the private property's owner. </p> <p> Interior may accept a donation of land or an interest in land for these trails, with specified exceptions.</p> <p>Land or an interest in land may not be acquired for these trails by eminent domain or condemnation.</p>

<p><b>National Jazz Preservation, Education, and Promulgation Act of 2023</b></p> This bill establishes a National Jazz Preservation Program and a National Jazz Appreciation Program, to be carried out by the Smithsonian Institution through the National Museum of American History, to (1) preserve knowledge and promote education about jazz, and (2) further the appreciation of jazz music throughout the nation. <p> The Smithsonian Institution shall (1) record interviews with leading jazz artists; (2) acquire, preserve, and interpret jazz artifacts; (3) continue to recognize Jazz Appreciation Month; (4) establish collaborative agreements for the sharing of such artifacts; and (5) encourage, consult with, and engage in capacity building with community-based and regional organizations with the potential to establish jazz archival collections. </p> <p>The bill amends the Elementary and Secondary Education Act of 1965 to allow the use of certain funds for programs to promote jazz education, which may include (1) a Jazz Artists in the Schools program, (2) a program for the development and distribution of educational materials about jazz and teacher training on jazz education, and (3) an Ambassadors of Jazz program. </p> <p> The Smithsonian Institution shall establish a series of jazz performances at Smithsonian affiliates that provides broad geographic access to jazz and supports public appreciation for the diversity of jazz music.</p>

<p><b>Bonuses for Cost-Cutters Act of </b><b>2023</b></p> <p>This bill expands the awards program for cost-saving identifications by federal employees of fraud, waste, or mismanagement to include identifications of certain operational expenses that are wasteful (i.e., that are identified as wasteful by an employee and that an agency determines are not required for the purposes for which the amounts were made available). An agency must propose any identified wasteful expenses for rescission.</p> <p> The bill also doubles the maximum cash award that may be made under the program.<br> <p class="MsoNormal" /> <p class="MsoNormal" />

<p><b>Fourth Amendment Restoration Act</b></p> <p>This bill limits surveillance conducted for foreign intelligence purposes.</p> <p>Specifically, the bill repeals provisions authorizing without a court order various types of searches and surveillance for foreign intelligence purposes, including electronic surveillance and access to business records.</p> <p>An officer of the U.S. government must obtain a warrant for certain search and surveillance activities against a U.S. citizen, including (1) conducting electronic surveillance, (2) conducting physical searches of property under a U.S. citizen's exclusive control, or (3) targeting a U.S. citizen to acquire foreign intelligence information. The bill provides for criminal penalties for a person who knowingly violates these requirements or otherwise obtains such information under color of law without statutory authorization. </p> <p>Information about a U.S. citizen acquired under Executive Order 12333 (relating to intelligence gathering) or during surveillance of a non-U.S. citizen shall not be used against the U.S. citizen in any civil, criminal, or administrative proceeding or investigation.</p>

<p><strong></strong><b>Real Justice for Our Veterans Act of 2023 </b></p> <p>This bill expands data collection on the effectiveness of veteran treatment court programs, incentivizes local governments to improve retention rates in veteran treatment court programs and drug court programs, and expands options for veterans to participate in drug court programs. </p> <p>First, the bill requires the Department of Justice (DOJ) to report on the effectiveness of veteran treatment court programs. The report must assess the population served by the programs, whether the programs use evidence-based treatments, the recidivism rates of participants, and program completion rates. The report must also assess whether women and racial and ethnic minorities have equal access to the programs and an equal opportunity to participate. </p> <p>Second, the bill requires DOJ's Bureau of Justice Assistance to implement a pilot program to make grants for local governments to improve retention in veteran treatment court programs and drug court programs.</p> <p>Finally, this bill allows a veteran (including a veteran who is a violent offender) to participate in a drug court program instead of a veteran treatment court program if a jurisdiction does not operate a veteran treatment court program.</p>

Electing Members to certain standing committees of the House of Representatives.

<p><strong>All Economic Regulations are Transparent Act of 2023 or the ALERT Act of 202</strong><b>3</b></p> <p>This bill establishes various reporting requirements with respect to federal agency rulemaking.<br> <br> Specifically, each agency must submit a monthly report to the Office of Information and Regulatory Affairs (OIRA) for each rule the agency expects to propose or finalize during the following year, including information about the objectives and legal basis for the rule as well as whether the rule is subject to periodic review based on its significant economic impact. Additionally, each agency must submit a monthly report for any rule expected to be finalized during the following year for which the agency has issued a general notice of proposed rulemaking, including an approximate schedule for completing action on the rule and an estimate of its cost and economic effects. OIRA must publish this information online and, subject to certain exceptions, a rule may not take effect until the information has been published for at least six months.<br> <br> The bill also requires OIRA to annually publish in the Federal Register specified information it receives from agencies under this bill, including a list of each rule an agency has proposed and the total cost of all rules proposed or finalized. OIRA must further publish online (1) any analysis of the costs or benefits of rules that were proposed or finalized during the previous year, and (2) a list of rules that were subjected to various forms of review during the previous year.</p>

<p><strong></strong><b>Residential Substance Use Disorder Treatment Act of 2023</b></p> <p>This bill revises and reauthorizes through FY2027 grants for residential substance use disorder treatment programs at state and local correctional and detention facilities.</p> <p>Among the revisions, the bill</p> <ul> <li>replaces statutory references to <em>substance abuse</em> with <em>substance use disorder</em>,</li> <li>specifies that the term <em>residential substance use disorder treatment program</em> includes a medication-assisted treatment program, </li> <li>requires the chief medical officer or other staff overseeing a program to complete training on the science of addiction and the latest research and clinical guidance on treating substance use disorders in criminal justice settings, and</li> <li>allows people who are awaiting trial or in pretrial detention to participate in the programs.<br> </li> </ul>

<p><b>Marginal Well Protection Act</b></p> <p>This bill amends the Clean Air Act to exclude certain facilities from reporting and payment requirements related to methane waste emissions. Under the bill, the requirements do not apply to facilities that produce less than 15 barrels of oil per day and less than 90 thousand cubic feet of natural gas per day.</p>
