Summary: The subcommittee first took up House Bill 702, which would change how extra or special duty pay for retired police officers is treated for retirement and work-limit purposes. Supporters argued the bill would let retirees work more special-duty hours, helping municipalities fill traffic-detail and similar assignments without added state cost, and said it would not prohibit retirees from working but would simply stop those hours from counting toward the return-to-work threshold. Opponents argued the change would be inconsistent with the retirement system’s 2011 reforms, could increase pension liabilities, and would treat the same compensation differently for active employees and retirees. Members also discussed whether the bill would affect current and future retirees, the role of municipalities, and whether the policy amounted to “policing for profit.” The subcommittee ultimately voted 3-2 to recommend inexpedient to legislate (ITL) on HB 702, sending it to the full committee with that recommendation. The committee then discussed House Bill 581, which would create a Group Three retirement plan for new state employees hired after the bill’s effective date. The chair outlined a housekeeping amendment to delay implementation, moving the effective date to January 1, 2026, and noted a sponsor amendment addressing health insurance group inclusion and medical and surgical benefits so those benefits would not be put at risk for the new group. Testimony and discussion focused on the shift from defined benefit to defined contribution, with supporters citing Michigan examples and arguing the bill would help recruit and retain employees while giving them more flexibility. Opponents said the change could weaken retirement security and increase unfunded liability, though supporters responded that the bill still requires employer contributions toward accrued liability and is intended to keep the state on track to pay off its unfunded liability by 2039. The transcript ends with continued discussion of the bill and no final vote shown on HB 581.

Summary: The committee first took up House Bill 622, but after the sponsor said further research raised concerns, he asked that the bill be tabled. The committee then moved in executive session and voted unanimously to find the bill inexpedient to legislate, sending it to consent. The committee also retained House Bill 349, the ophthalmologic laser bill, after members said more time was needed for the professions involved to work out training standards and provide additional information; that motion also passed unanimously. The committee then discussed House Bill 244, a municipal building/fire code recodification measure. Members said the bill needed more review and careful scrutiny because of its length and possible unintended effects, and they voted unanimously to retain it as well. House Bill 534 was then heard; the sponsor said the bill did not do what was intended because of a misunderstanding about current processing, and the committee voted inexpedient to legislate and placed it on consent. The committee next considered House Bill 233, with an amendment to remove a requirement affecting the New Hampshire Vaccine Association. Supporters argued the bill would reduce an unnecessary burden and improve transparency, while opponents said the committee should not single out one private 501(c)(3) organization. The amendment was adopted 8-5, and the bill as amended then passed 7-6; a minority report was requested. Finally, the committee opened House Bill 536, a proposed 1.5% cost-of-living adjustment for certain state retirees. The sponsor and supporters argued retirees had not received adequate COLAs and that the bill would help offset inflation, while the retirement system testified that the proposal would add significant costs, including an estimated $1.5 million for the state, $6.6 million for political subdivisions, and about $100.7 million in present-value unfunded liability, with the impact reflected in future employer contribution rates.

Summary: The committee heard testimony from Insurance Commissioner DJ Bettencourt on the New Hampshire Insurance Department budget. He said the department is self-funded through assessments on insurers based on New Hampshire premium volume, with about $8 billion in premiums written in the state and a department budget of roughly $15.5 million. He explained that the department has 88 authorized positions, eight vacancies, and that three full-time positions were unfunded after the governor’s requested 4% reduction exercise. He also said the department is trying to balance staffing needs with not overburdening carriers during a hard insurance market. A major topic was the department’s $2.6 million rebate to industry from the prior fiscal year, which Bettencourt described as a credit against the next assessment rather than a direct cash payment. Members questioned why that credit was not reflected as a reduction in the upcoming budget, and Bettencourt and staff explained that the budget assumes full staffing and full spending, with any year-end surplus returned to insurers. The commissioner said the department had added staff in recent years for succession planning and to preserve institutional expertise, and that the rebate reflects careful budgeting rather than excess spending. Members also asked about staffing changes by division, including positions unfunded in fraud, property and casualty examinations, life and health examinations, and tax. Bettencourt said fraud investigations remain strong and that the department can use outside contractors for examinations, with those costs billed to the company being examined. He also described the department’s examination process, including periodic financial exams and targeted market conduct reviews triggered by consumer complaints or trends. Additional questions covered OIT transfers, the department’s oversight of fully insured health coverage, the insurance premium tax and fines going to the general fund, and the department’s limited role in auto repair reimbursement disputes, where he said complaints have recently declined.
