He reported that court rules had been updated to clarify notice requirements for minor guardianship changes, and that the branch had received positive feedback on the family access motion, which provides a statutory timeline and listed remedies for parenting-time disputes.
Members also discussed prior committee work on rules of evidence and family court procedures. One member recalled recommending quiet review of any judges who appeared to apply evidence rules inconsistently, and Krian said the administrative judge can review complaints even if they come from a single person. The committee also received a status update on prior initiatives, including a federal grant for guardian ad litem services for indigent litigants in four locations, testing of redesigned court forms, and continued training improvements. The chair scheduled the next subcommittee meeting for April 1 and the full Children and Family Law Committee for April 8, with further documents from committee research and NCSL to be circulated.

A member also asked about the fee schedule, and the department said the fees are sufficient and supported in part by federal funds. The committee then approved Rule 25188 as amended, with oral edits, on a voice vote.
The committee next considered Department of Environmental Services Rule 25206, dealing with subsurface wastewater rules and an administrative fine schedule. Staff said most comments had been addressed, but one remaining issue concerned the fine schedule because the prior interim rule had expired years ago. Staff also noted public concerns about septic tank replacement sizes, but pointed to waiver provisions and replacement-in-kind language that would still allow smaller existing systems to be replaced under certain conditions. DES officials explained that the rule package adds the fine schedule into the program rules and that no fines have been brought under these expired provisions for many years. They also described the waiver and grandfathering provisions as intended to protect existing systems and seasonal campgrounds from unnecessary upgrades.
A public witness, Christopher Albert, testified that two sections of the rule would harm manufactured home parks and cooperatives. He argued that the new “two people per bedroom” assumption and the minimum bedroom threshold for using water-meter data would inflate design flows, make water-meter data unusable, and increase costs for low-income residents. Committee members questioned both the witness and the agency about the assumptions. DES staff responded that the two-person-per-bedroom standard is meant for individual on-site system design, not citywide planning, and that water-meter data is only useful in larger or unusual facilities. They said the rule still allows flexibility through waivers and grandfathering for existing uses, and that the drinking-water rule cited by the witness was not the correct comparison. No final vote on Rule 25206 was taken in the portion of the meeting provided.

The committee adopted the substitute, approved a title amendment, and passed the bill with favorable expression. House Bill 605, sponsored by Rep. Kim King, clarified which grants qualify for a grant program and allowed cities or counties to apply on behalf of water districts or other entities not directly affiliated with them; Rebecca Hearts of Grant Ready Kentucky said the program had matched $103 million of the $200 million allocation, generating about $469.98 million in total project value. The committee adopted the title amendment and passed the bill with favorable expression.
House Bill 606, by Rep. Wade Williams, added a capital-oversight reporting requirement for school district general obligation bonds that had been omitted from prior legislation. The committee substitute also made several budget and program adjustments, including moving Regional Training Center funds, accelerating funding for the Grand Lyric Theater, correcting water funding language, removing Odyssey Inc. language from a treatment-related item, fixing a double appropriation to LifeWorks Transition Academy, clarifying carry-forward language, allowing SRO reimbursements for public and non-public schools, and authorizing an additional $10 million in agency bonds for Western Kentucky University athletic facilities. The committee adopted the substitute, approved a title amendment, and passed the bill with favorable expression.
The committee then spent the most time on House Bill 695, a Medicaid-related bill. Rep. Adam Bowling said the bill was intended to stabilize Medicaid, create oversight and advisory mechanisms, and address growth in the program. Cabinet for Health and Family Services Secretary Eric Friedlander and Medicaid CFO Steve Beckle said they were generally supportive of the transparency and reporting changes but flagged risks, including federal compliance concerns, budget growth from changing the drug rebate treatment, administrative costs tied to MCO rebidding and a managed long-term services study, and some data-collection challenges. Representatives from the Kentucky Association of Healthcare Facilities opposed the section calling for a managed long-term care reimbursement study, arguing it would be costly, duplicative, and likely ineffective, and they warned against managed care models for long-term care. Despite the concerns, the committee adopted the committee substitute by voice vote and moved the bill forward with favorable expression.
