Summary: The Committee on Legislative Review met with five members present and took up two public hearings: House Bill 369 and House Bill 3465. On HB 369, Representative Simmons said the bill would let school employees join or leave teachers’ unions at any time and would prohibit school districts from automatically deducting union dues from paychecks, citing the Janus decision and arguing members should pay directly rather than through payroll deduction. Committee members questioned why the bill was needed, whether unions and school districts had been consulted, whether current law already allows opt-in/opt-out at any time, and whether the bill would affect other payroll deductions. Opposition testimony from Missouri NEA, Missouri State Teachers Association, and the Missouri AFL-CIO said the bill was unnecessary, targeted unions, could create administrative burdens, and might raise constitutional concerns; they emphasized that payroll deduction is already voluntary and that members can cancel membership at any time. No vote was taken on HB 369 during the hearing. The committee then heard HB 3465, a severability bill sponsored by Representative Keithley. He explained that it would create a broader severability standard so that if part of a legislative act is found unconstitutional, the rest could remain in effect unless there is clear and convincing evidence the legislature would not have passed the act without the invalid provision. He said the bill is intended to give courts clearer guidance and preserve the remainder of legislation when possible. Questions from members focused on how this differs from existing severability law and whether it would improperly direct the courts; Keithley responded that it clarifies legislative intent and applies to procedural as well as substantive constitutional issues. Supporters, including Campaign Life Missouri, said the bill would apply to bills, joint resolutions, and concurrent resolutions and would give courts a clearer standard. There was no opposition testimony on HB 3465, and the hearing concluded with no further business and adjournment.

Summary: The House convened with a quorum, opened in prayer, and received official notice from the Secretary of State certifying Dana Henry and Paul Sawyer to fill vacancies in the chamber. Both members were sworn in. The House also received Senate messages on several concurrent resolutions and a large slate of Senate bills, and it adopted a number of House resolutions recognizing groups and individuals, including agriculture, athletic trainers, GoFar Louisiana, homeschooling families, veterans, and several community honorees. Committee reports and bill referrals were also announced throughout the morning hour. A substantial portion of the meeting was devoted to floor action on House bills, many of them memorial highway designations and policy measures. The House gave final passage to bills naming roadways and bridges for Officer Trevor Abney, Dr. Harry Blake Sr., Virginia Green Evans, and American Legion Post No. 14, and it also passed bills extending Tax Commission assessment fees, creating a transfer-on-death securities registration act, increasing lender origination fees, expanding assessor certification committee membership, and strengthening protections for eligible adults against financial exploitation. Other bills passed included measures on teacher certification appeals, removing Evangeline Parish from a juvenile justice district, re-creating the Department of Education, and repealing a $25 impaired-driving fine. Most of these bills passed overwhelmingly or unanimously. The most extensive debate centered on House Bill 68, which would create a new offense for disturbing worship services and impose a mandatory 30-day jail term for certain misdemeanor conduct, with higher penalties for related offenses. Supporters argued the bill was intended to deter disruptions and reduce the risk of escalation in houses of worship, citing heightened security concerns and incidents in churches nationwide. Opponents questioned the bill’s vagueness, the mandatory minimum sentence, the distinction between misdemeanor and felony treatment, and whether existing law already covered the conduct. The bill remained under discussion as members continued to raise constitutional, enforcement, and policy concerns.

It also approved a Parks and Recreation supplemental to allow fund transfers after program restructuring, and then approved the department’s FY 2027 enhancements for staffing, trail work, equipment, grant pass-throughs, staff housing, park construction, RV campsite development, and replacement items, with members discussing the use of federal funds and the department’s management of prior appropriations. The committee then considered the Department of Health and Welfare’s Division of Public Health Services. After debate over the Idaho Home Visiting Program, immunization assessment funding, disaster planning, lab testing, ARPA grants, HIV prevention, and hepatitis prevention, the committee rejected a substitute motion that would have restored more funding for home visiting and instead approved the original motion, which included funding for home visiting, immunization assessment restoration, lab testing, ARPA grants, HIV and hepatitis prevention, and a small general fund restoration for suicide prevention, while reducing three FTP. The committee also adopted reporting language for suicide prevention, HIV prevention, hepatitis prevention, and immunization assessment funds. It then moved to the Division of Early Learning and Development, approving a budget that included Idaho Child Care Program capacity funding, replacement items, population forecast adjustments, and the transfer of the Home Visiting Program from Public Health. The committee also approved language requiring an open competitive acquisition process for Idaho STARS after extensive discussion, then adopted language for Home Visiting reporting, Idaho Child Care Program reappropriation, and restrictions on Idaho Child Care Capacity Grant spending after debate over definitions and provider eligibility. Finally, it approved language exempting the division from certain transfer restrictions, and began the next budget for Family and Community Partnerships, which included a kinship navigation grant enhancement.
