The committee then heard HB 338, which would clarify that premium interest-rate adjustments for non-fossil fuel generation are just and reasonable and allow the PUC to include them in rates. DCCA and the State Energy Office supported the bill, and the PUC also supported it. Hawaiian Electric opposed unless amended, arguing the PUC already has discretion and warning the bill could weaken competitive procurement by encouraging higher bids tied to the utility’s credit rating. DCCA said the concern was that developers might not seek the best financing if premium rates are recoverable, but said Hawaiian Electric’s suggested amendment requiring clear and convincing evidence of unavoidable financing-cost increases would help. Members also asked about refinancing and whether developers could later lower debt costs after locking in a premium rate; DCCA said that ability exists and suggested a time limit or review mechanism.
For HB 337, which would direct the PUC to establish standards requiring utilities to remove certain fossil-fuel costs from the rate base when adding renewable resources, the Department of Hawaiian Home Lands, Hawaii Clean Power Alliance, and the State Energy Office supported the measure. Hawaiian Electric opposed it, saying it misunderstood utility cost recovery and could threaten grid reliability because fossil plants provide ancillary services such as voltage regulation and balancing, not just energy. Hawaiian Electric pointed to its integrated grid plan and recent fossil-unit retirements as evidence of ongoing transition, and asked the committee to defer the bill and leave oversight to the PUC. The committee also heard HB 879 on cesspool conversions, which would raise the maximum grant from $20,000 to $30,000 and add DOH positions; DHHL, DOH, environmental groups, Hawaii Realtors, and others supported it, while DOH discussed staffing needs and the practical effect of the higher grant cap. The committee also began HB 379 on requiring denitrification capacity for certain wastewater systems near shorelines or groundwater, with DLNR testifying in support.

Support came from labor organizations, contractors, and other regional stakeholders; no opposition testified. Members emphasized the region’s high unemployment and the importance of workforce development. The bill passed on a do-pass motion to Labor and Employment.
SB 697, by Senator Laird, would update the stream system adjudication process by allowing the State Water Board to use modern technology, such as stream gauges and digitized records, when investigating water rights claims, while still allowing field investigations when needed. The author said the process has not been updated since 1976 and should be streamlined. After amendments addressed stakeholder concerns, there was no opposition testimony. The committee asked whether the bill would affect pre-1914 water rights, and the author said it would not. SB 697 passed as amended to Judiciary. The committee also approved consent calendar items SB 599, SB 609, and SB 765 earlier in the hearing.

The Solid Waste Subcommittee met to discuss proposed amendments to HB 171 and HB 215. The committee then turned to HB 215, which would create a two-stage landfill siting review centered on a “net public benefit” determination before full technical review. Representative Gerna explained that the amendment would define net public benefit, require an independent third-party assessment paid for by the applicant, and set up a process for selecting the contractor from a list submitted by the applicant, with DES and the host community involved and the commissioner choosing if no agreement is reached within 60 days. Members asked how “host community” would be defined; DES said it would generally mean the municipal governing body, though that body could appoint others. The amendment also broadened the factors considered in both harms and benefits, including human health, property values, tourism, recreation, wildlife, local economic benefits, and infrastructure improvements.
The discussion also added a provision directing DES to consult with the Department of Transportation, the Department of Business and Economic Affairs, and the Department of Natural and Cultural Resources as needed when reviewing the third-party assessment. Director Whap said interdepartmental consultation is normal and that DES would likely adopt rules to guide the process. Members questioned whether the new framework would be too vague or burdensome for applicants, but Whap said it would not be designed to stack the deck against applicants and that the process should provide clearer, more balanced criteria. No votes were taken during the meeting, and the subcommittee appeared to continue refining the amendment language before further action.

The Transportation Committee heard and acted on a series of transportation, licensing, and memorial bills. The committee then approved several specialty license plate and memorial measures. CS/SB 1024 added a United States Military Academy plate alongside the Naval Academy plate. CS/SB 824 created a Florida Highway Patrol specialty plate. CS/SB 666 created a Miami Northwestern Senior High School alumni plate, with supporters emphasizing the school’s history and scholarship uses for the revenue. CS/SB 916 authorized indemnification and insurance arrangements for commuter rail operations on the Brightline corridor, modeled on SunRail law, and was reported favorably after technical amendments. CS/SB 1290 updated DHSMV rules to conform to IFTA and federal motor carrier standards, raised the crash-damage reporting threshold, and made other registration and email-notification changes; CS/SB 1292 created a public-records exemption for certain email addresses used in motor vehicle and vessel notifications. CS/SB 1408 designated memorial highways for fallen officers Jesse Madsen and Elio Diaz, and CS/SB 1502 authorized FDOT blanket permits for mobile cranes to travel at night under specified conditions. All of these bills were reported favorably.
The committee also received a lengthy informational presentation from FDOT on aggregates and the state’s construction-material supply chain. The witness described aggregate sources, transportation methods, recycling efforts, the importance of the Lake Belt and out-of-state imports, and the department’s supply-chain grant program. Senators asked about long-term reserves, stranded reserves, pricing, and the impact of regulation on future supply, and requested the study and a summary of regulatory impacts for members. The meeting concluded with no further business and adjournment.
