Summary:
The House Judiciary Committee met and heard three bills. HB 372 would reorganize Justice of the Peace Court resources by shifting the number of judges and court locations among counties, consolidating overnight operations into a single 24-hour court in Kent County, and adjusting staffing to address workload and efficiency concerns. Chief Judge Alan Davis said the change responds to increased civil filings, automated enforcement, and staffing shortages, and that a Sussex County pilot closing a 24-hour facility had worked without major issues. Some members raised concerns about impacts on Sussex and Kent County, bail processing, and local response times, while public comment included one supporter. The committee voted to release HB 372.
The committee then considered SB 324, which amends Delaware’s permit-to-purchase law to allow constable agencies, including those serving institutions like Delaware Tech, to purchase handguns for newly hired constables without duplicative background checks. Sponsor Representative Cook said the bill aligns constable procurement with existing law-enforcement exemptions while preserving gun-safety requirements. Public testimony included support from Delaware Tech and comments urging broader fixes to the permit-to-purchase law, including exemptions for retired officers with federal 218 credentials and clarification on firearms returned from manufacturers, gunsmiths, or police departments. The committee voted to release SB 324.
Finally, the committee heard HB 414, which clarifies that the Superior Court’s exclusive jurisdiction over certain destructive-weapon offenses applies only to adults, while juvenile cases would still begin in Family Court. Sponsor Representative Romer said the bill preserves the Family Court’s role in handling youth cases and allows referral to Superior Court when appropriate. The Department of Justice said it still believes Superior Court is the proper venue for these serious charges, while the Office of Defense Services supported keeping youth cases in Family Court first, arguing that rehabilitation and juvenile-specific dispositions are more appropriate. After public comment, the committee voted to release HB 414, and the meeting adjourned.

Summary:
The Senate Committee on Agriculture received a presentation from Florida Forest Service Director Rick Dolan on the agency’s wildfire response, forest management, and emergency support roles. He described the service’s four regions and 14 districts, its year-round wildfire response, use of bulldozers, helicopters, and drones, and the current high fire danger due to drought conditions. Dolan also highlighted prescribed burning, fuels mitigation, state forest management, the pine seedling nursery, and the agency’s role in hurricane response and incident management. Members asked about equipment loans and whether more prescribed burning could reduce wildfire impacts; Dolan said Florida already leads the nation in prescribed fire and emphasized public education and fuels reduction.
The committee then considered and unanimously reported favorably Senate Bill 386, which creates a farm-equipment consumer protection process similar to a lemon law, allowing purchasers to seek repair or replacement of defective major farm equipment at no cost. The committee also took up Senate Bill 290, the Agriculture and Consumer Services omnibus bill. The bill would modernize fair association rules, preempt local bans on gas- and diesel-powered farm and landscape equipment, allow surplus of certain state-owned lands for bona fide agricultural use while excluding parks, forests, and wildlife lands, create a veterinary loan repayment program, make Farmers Feeding Florida permanent, expand Forest Service training opportunities, criminalize signal-jamming devices, increase penalties for CDL and English-proficiency exam cheating, restrict certain door-to-door solicitation, protect food safety inspectors, clarify biosolids rules, and add criminal and vendor-list penalties for contractors who fail to pay subcontractors. The committee adopted three amendments to align dates and technical language and to authorize native seed research and marketing through the Florida Wildlife Foundation. Testimony on SB 290 included support from several industry groups, concerns from the Home Builders Association about the new contractor-payment criminal penalties, and opposition from a citizen worried about the new surplus-land process for conservation lands. Despite concerns, CS/SB 290 was reported favorably.
Finally, the committee unanimously recommended confirmation of the appointees listed on tabs 4 and 5, and then adjourned.

Summary:
The committee first adopted amendment 2026-2021S to correct a drafting issue in the budget language so that the $2.5 million appropriation for Medicaid per diem rate stabilization at county nursing homes can be spent during the biennium rather than lapsing at the end of the fiscal year. Senator Lang explained that the funds are matched with federal dollars for a total of $5 million and are intended to prevent rate reductions that could shift costs to county property taxpayers. The amendment was adopted unanimously by both chambers, and the committee proceeded on the bill as amended by the Senate.
The main discussion then focused on HB 155 and a proposed amendment to the business enterprise tax. The House proposal would lower the BET rate in stages when combined business tax revenues exceed certain thresholds, while the Senate opposed an immediate rate reduction and argued that tax changes should be handled in a budget year. Senators emphasized that raising the filing threshold to $375,000 had already removed about 3,500 small businesses from filing requirements, and they preferred further relief through threshold changes rather than rate cuts. House members argued that the trigger-based reduction was a reasonable, tested mechanism and would provide future tax relief without taking effect unless revenues rose enough.
Members debated whether the trigger could be distorted by one-time revenue spikes, such as the recent tax amnesty receipts and prior federal repatriation-related revenue, and Representative Sweeney said he was willing to adjust the effective date or carve out amnesty revenue. The committee did not reach agreement on the BET reduction, and the chair called a break and then continued the meeting later with a new proposal to delay the trigger’s effective date to January 1, 2028. Senator Lang rejected that version but offered a counterproposal to raise the filing threshold to $400,000, and the parties ultimately agreed to continue discussions and reconvene later.
The meeting also took up HB 1102, concerning the research and development tax credit and state park fees. The House position was to support the R&D tax credit but remove the park-fee provisions, citing testimony from the Department of Natural and Cultural Resources that it did not need the increase and concerns about discouraging tourism, especially at border parks. Supporters of the park-fee language argued that the department had not raised rates in years, could set its own rates, and should be able to charge nonresidents more while keeping New Hampshire residents’ fees lower. The discussion remained unresolved, with members debating the likely effect on tourism and fairness to residents versus the need for additional revenue.
