Abortion inducing drugs. Provides that a person who knowingly or intentionally engages in the use of an abortion inducing drug, including Mifepristone or Misoprostol, on a pregnant woman without the knowledge or consent of the pregnant woman, commits a Level 5 felony. Prohibits a person from knowingly or intentionally sending Mifepristone or Misoprostol to another person located in Indiana, if the other person located in Indiana possesses the Mifepristone or Misoprostol. Provides that each offense is a Class A misdemeanor with a Level 6 felony for subsequent offenses. Adds Mifepristone and Misoprostol to the list of Schedule IV drugs.

Adoption for abandoned infants. Provides that when the department of child services (department) or a licensed child placing agency takes custody of a child who is voluntarily left with an emergency services provider or in a newborn safety device, the department or licensed child placing agency shall: (1) not later than 72 hours after taking custody of the child, contact each licensed child placing agency in Indiana and request that the licensed child placing agency inform the department of any suitable prospective adoptive parent for the child known to the licensed child placing agency; and (2) collaborate with licensed child placing agencies to identify a prospective adoptive parent for the child. Requires the department to: (1) request that the Indiana department of health conduct one or more searches of the putative child registry on behalf of the child before a petition is filed to terminate parental rights with regard to the child, with at least one request being made not earlier than 30 days after the estimated date of birth of the child; and (2) notify an individual identified as a potential father by the registry search that the individual's consent to termination of the parent-child relationship will be irrevocably implied if the individual does not file a paternity action with regard to the child. Provides that when considering an out-of-home placement for the child during child in need of services proceedings, if a court, the department, or the licensed child placing agency is unable to locate a suitable and willing relative (or de facto custodian, if applicable) with whom to place the child, the court or the department shall consider placing the child with a prospective adoptive parent before considering any other placement for the child. Requires that a child's case plan include certain information.

Taxation of military income. Exempts military pay for members of the United States Space Force, the United States Public Health Service Commissioned Corps, and the National Oceanic and Atmospheric Administration Commissioned Officer Corps from the individual income tax. Exempts military pay earned by members of an active component of the United States Space Force, the United States Public Health Service Commissioned Corps, and the National Oceanic and Atmospheric Administration Commissioned Officer Corps from the individual income tax. Adds members of the United States Space Force, the United States Public Health Service Commissioned Corps, and the National Oceanic and Atmospheric Administration Commissioned Officer Corps for purposes of eligibility for the income tax deduction for income from military retirement or survivor's benefits.

Child operated refreshment stands. Provides that a local health department, the health and hospital corporation of Marion County, a county, a municipality, or a township may not adopt or enforce a law, rule, ordinance, or resolution that prohibits or regulates, including by requiring a license, permit, or fee, the sale of lemonade or other nonalcoholic beverages from a stand on private property by an individual who is less than 18 years of age. Provides that the individual who operates the stand must comply with certain requirements. Provides that a stand is not considered a food establishment and does not require a certified food protection manager. Provides that the governing documents of a homeowners association may not prohibit or regulate, including by requiring a permit or fee, the sale of lemonade or other nonalcoholic beverages from a stand on property located in the subdivision by an individual who is less than 18 years of age. Provides that a homeowners association: (1) does not owe a duty of care to persons participating in a beverage sale; and (2) is not liable for any injury to persons participating in a beverage sale; except for willful or wanton acts or gross negligence of the homeowners association.

Absentee ballots. Provides that absentee ballots may be processed, counted, and tabulated before 6 p.m. on election day, but vote totals for a precinct, a county, or an election district may not be released before 6 p.m. on election day. Describes the process of processing, counting, and tabulating early voting absentee ballots. Requires a county election board to use the procedures relating to voting and processing of ballots by voters who vote in person at a precinct or vote center on election day, to the extent that such procedures are applicable in the context of early voting. Provides that an absentee ballot card voted during early voting may be scanned using an optical scan ballot scanner beginning 28 calendar days before election day. (Under current law, scanning may begin not earlier than seven days before election day.) Requires that a feature of a voting system that enables the retraction of a ballot must be approved before being used in an election. Provides that a voting system retraction process must be designed to minimize the possibility that the retracted votes on a voter's ballot can be linked to the identity of the voter. Relocates statutes applicable to early voting absentee ballots and mail absentee ballots. Repeals superseded statutes.

Teacher retention grant program. Creates the teacher retention grant (grant). Provides that certain schools qualify for a grant if one or more licensed teachers employed by the school or directly providing virtual education were rated as effective or highly effective. Requires certain schools to create and submit policies to the department of education (department) in order to receive a grant. Provides that the amount of a grant is equal to $37.50 multiplied by a school's current ADM. Provides that the department shall distribute the grant in accordance with the following priorities: (1) to the extent possible, to achieve geographic balance throughout Indiana and to include urban, suburban, and rural schools; and (2) to address a documented need for teacher retention grants based on a low teacher retention rate as determined by the department. Makes conforming changes treating teacher retention grants in the same manner as teacher appreciation grants.

Various education matters. Provides that the department of education (department) is the proper authority to accept federal funds appropriated to aid in the education of children with disabilities (current law provides that the state board of education is the proper authority). Removes the member of the Indiana Transportation Association from the list of nonvoting members on the state school bus committee. Provides that an individual seeking an initial practitioners license through an alternative certification path must successfully complete an applicable teacher licensing exam as approved by the state board of education (board) (current law requires the successful completion of a Praxis Subject Assessment). Provides that summer school funding may be differentiated based on the course or length of time of the program. Moves the establishment of the division of special education from the board to the department. Changes certain duties for the secretary of education and the director of special education. Provides that the department may suspend or terminate the certification of a scholarship granting organization if the department establishes that the organization has not granted a scholarship within certain time frames.

Condemnation of Hoosier homestead property. Establishes the Hoosier homestead program administered by the Indiana state department of agriculture to commemorate and maintain a registry of farms owned by the same family for at least 100 years. Provides that if a condemnation action involves the taking of a fee simple interest in a Hoosier homestead: (1) the property owner is entitled to testify at a hearing conducted by the appropriate municipal or county legislative body; and (2) the legislative body must approve the condemnation for the condemnation to proceed. Provides that only the portion of a farm that satisfies the familial ownership and other requirements receives the Hoosier homestead designation and is subject to the provisions regarding eminent domain. Requires all property taxes to be paid up to date to be registered as a Hoosier homestead property or to renew registration as a Hoosier homestead property.
