Lake and St. Joseph County magistrates. Provides that in appointing magistrates, the judge of the St. Joseph County probate court and the judge of the juvenile division of the Lake County superior court shall strive to reflect the ethnic and racial demographics of their respective counties.

Material harmful to minors. Removes schools and certain public libraries from the list of entities eligible for a specified defense to criminal prosecutions alleging: (1) the dissemination of material harmful to minors; or (2) a performance harmful to minors. Adds colleges and universities to the list of entities eligible for a specified defense to criminal prosecutions alleging: (1) the dissemination of material harmful to minors; or (2) a performance harmful to minors.

Professional counselors licensure compact. Requires the behavioral health and human services licensing board to administer the professional counselors licensure compact (compact). Adopts the compact. Sets forth requirements of a member state. Sets forth the duties and authority of the counseling compact commission (commission). Allows a counselor in a home state to practice via telehealth in a member state. Allows each member state to have one delegate on the commission. Establishes the procedure to withdraw from the compact. Makes conforming changes.

Sex offender residency restrictions. Provides that an offender against children who knowingly or intentionally resides within 1,000 feet of certain areas owned, leased, operated, or maintained by a homeowners association or property owners association commits a sex offender residency offense, a Level 6 felony.

Evidence of lack of seat belt use. Provides that evidence concerning a failure to comply with safety belt requirements, including a child restraint system, may be admissible in a civil action. Repeals a provision that failure to comply with a child restraint system does not constitute contributory negligence.

Memorializing late Governor Kernan. A CONCURRENT RESOLUTION honoring the late Governor Joe Kernan and urging the Indiana Department of Administration to place a memorial bust of Governor Kernan within the State Capitol.

Consent for pelvic, prostate, and rectal exams. Prohibits health practitioners and other specified individuals from performing pelvic, prostate, or rectal examinations on an anesthetized or unconscious patient except in specified circumstances.

Civil service annuity income deduction. Increases the amount of federal civil service annuity benefits that an individual or the individual's surviving spouse may deduct from adjusted gross income tax.

Assessed value growth cap. Limits the annual increase in the gross assessed value of real property for property tax purposes to the lesser of 5% or the percentage change in the Consumer Price Index for all Urban Consumers. Provides that the limit does not apply if: (1) the ownership of the property changes; or (2) the increase is attributable to one or more physical changes to the property. Precludes agricultural land for the limit.

State spending report for taxpayers. Requires the department of state revenue (department) to annually provide each resident individual taxpayer who paid adjusted gross income taxes in the immediately previous taxable year a taxpayer receipt statement in an electronic format explaining how the individual taxpayer's taxes are being used. Requires the department, in consultation with the budget agency, to create and administer an Internet web page on which individual taxpayers may access an estimate of the allocation of their adjusted gross income taxes to various expenditure categories for the most recent state fiscal year based on the adjusted gross income taxes paid by the taxpayer. Specifies the information that the must be provided on the web page. Requires the department to include a link to the web page on the Indiana individual income tax return, Form IT-40.

Requirements for foster families. Prohibits a licensed child placing agency from: (1) requiring, as a condition for obtaining an adoption, that an individual or a member of the individual's household receive an immunization; or (2) discriminating against an individual with respect to the immunization status of or a refusal to receive an immunization by the individual or a member of the individual's household. Requires the department of child services to assess certain penalties in certain circumstances. Provides that immunization status or the refusal to receive an immunization do not constitute a sufficient basis to deny a foster home license application.

Compensation for the taking of a business. Provides that if a city or town (municipality) condemns property, a person operating a business on the property may be compensated for business losses resulting from the condemnation. Provides that a municipality may not acquire property using an alternative condemnation procedure conducted by the public works board if the municipality is notified of the person's intent to claim compensation for business losses.

Pharmacist contraceptive prescriptions. Allows pharmacists who meet certain requirements to prescribe self-administered hormonal contraceptives (contraceptives). Establishes requirements for pharmacists who prescribe and dispense contraceptives. Requires the Indiana board of pharmacy (board) to adopt rules. Allows the state health commissioner to issue a standing order that concerns standard procedures for the prescribing of contraceptives by pharmacists that is effective until the board adopts rules. Requires health plans to provide coverage for contraceptives and certain services. Establishes an exception for nonprofit religious employers.

Compliance with CHINS dispositional decrees. Provides that if the department of child services (department) takes a child into custody, the department may not release the child to the child's parent, guardian, or custodian if: (1) the parent, guardian, or custodian, or a household member of the parent, guardian, or custodian, is the subject of a substantiated allegation of abuse of a child; and (2) the child expresses a desire to not be released to the parent, guardian, or custodian; and may not allow the parent, guardian, or custodian to have contact with the child until: (A) the child consents to contact with the parent, guardian, or custodian; or (B) the child's child in need of services case is closed; whichever occurs first. Provides that if a dispositional decree requires a child's parent, guardian, or custodian to participate in a program of care, treatment, or rehabilitation and the court finds that the parent, guardian, or custodian has failed to make consistent and timely progress toward the goals set forth in the dispositional decree, the department: (1) may not return the child to the home of the parent, guardian, or custodian; and (2) may not allow the parent, guardian, or custodian in person contact with the child unless the contact is approved as being in the child's best interest by: (A) a court appointed special advocate or guardian ad litem; and (B) a licensed marriage and family therapist, if one has been appointed for the child; until the court finds that the parent, guardian, or custodian is making consistent and timely progress toward the goals set forth in the dispositional decree. Provides that if, in a 12 month periodic case review for a child in need of services, the court finds that the child's parent, guardian, or custodian has failed to make consistent and timely progress in any service that was ordered by the court and that was made available to the parent, guardian, or custodian by the department, the court shall order: (1) that the permanency plan for the child be changed to a concurrent plan in which at least one intended permanency arrangement is not reunification; or (2) that the intended permanency arrangement for the child be changed to placement of the child for adoption. Provides: (1) that in a 15 month periodic case review for a child in need of services, the court shall order: (A) that the permanency plan for the child be changed to a concurrent plan in which at least one intended permanency arrangement is not reunification; or (B) that the intended permanency arrangement for the child be changed to placement of the child for adoption; and (2) that thereafter, the intended permanency arrangement for the child may not be changed to solely reunification. Amends and adds to the conditions under which reasonable efforts to reunify a child with the child's parent, guardian, or custodian, or preserve a child's family, are not required. Provides that: (1) if a parent, guardian, or custodian of a child in need of services is involuntarily discharged three or more times from a program or service in which the parent, guardian, or custodian is required to participate under the child's dispositional decree, the court may order the parent, guardian, or custodian to pay the cost of subsequent participation in the program or service; and (2) if the dispositional decree requires the parent, guardian, or custodian to submit to drug testing and the parent, guardian, or custodian: (A) tests positive for a controlled substance; or (B) fails to submit to a required drug test; three or more times, the court may order the parent, guardian, or custodian to pay the cost of any subsequent drug testing required under the dispositional decree. Establishes conditions under which a parent's consent to termination of the parent's parent-child relationship with respect to a child is implied without further action of the court, and provides that the parent's implied consent is a factor weighing in favor of terminating the parent's relationship with the child. Provides that a court finding that a parent has failed to make consistent and timely progress in any service that was ordered by the court in a dispositional decree and that was made available to the parent by the department is a factor weighing in favor of terminating the parent's relationship with the child. Requires termination of the parent-child relationship with regard to a child who is: (1) taken into custody; and (2) adjudicated a child in need of services; on two separate occasions in a two year period. Provides, for purposes of a petition to terminate the parent-child relationship, that: (1) the court finding that there is a satisfactory plan for the care and treatment of the child, and that the plan is in the child's best interests, is a factor weighing in favor of terminating the parent-child relationship; and (2) if the intended permanency arrangement for the child is placement of the child for adoption, a specific adoptive home need not have been identified in order for the plan to be satisfactory or in the child's best interests.
