Indiana historical murals. Requires the governor to administer a program under which historical murals depicting milestones in Indiana's history as a territory and a state will be created and permanently displayed in prominent places around the state capitol campus in celebration of the 2026 semiquincentennial of the United States. Provides that the governor shall consult with specified individuals concerning the selection of historical murals for placement around the state capitol campus, at least one of whom must be an individual from a minority group. Empowers the governor, in collaboration with the department of administration, to decide the number and size of the historical murals, the locations where the historical murals will be displayed, the milestones of Indiana history to be depicted, and the design and terms of the competitive process through which artists will be chosen to create the historical murals. Specifies that the department of administration shall do the following: (1) Determine the manner by which a mural is displayed. (2) Provide for the mural's maintenance and upkeep. (3) Ensure that each label or plaque that will be fixed on or near each historical mural is accessible to an individual who has a vision impairment or a hearing impairment.

Educational costs exemption. Amends the eligibility requirements for educational costs exemptions for children and spouses of certain members of the 1977 police officers' and firefighters' pension and disability fund.

Regulation of combined sewer overflows. Provides that if an NPDES permit holder has submitted an approved long term control plan for its combined sewers, water samples used to assess the permit holder's compliance with water quality standards and water quality based effluent limitations for discharges from combined sewer overflows must not be collected: (1) within 96 hours after a combined sewer overflow discharge that is consistent with the approved long term control plan; or (2) during or following excessive precipitation conditions. Requires the environmental rules board to adopt rules, including emergency rules, to implement the limitation on water samples used to assess a permit holder's compliance.

Prescription for hormonal contraceptives. Allows pharmacists who meet certain requirements to prescribe and dispense hormonal contraceptive patches and self-administered hormonal contraceptives (contraceptives). Establishes requirements for pharmacists who elect to prescribe and dispense contraceptives. Provides that a pharmacist is not required to prescribe a contraceptive to a woman if the pharmacist believes the contraceptive is contraindicated or objects on ethical, moral, or religious grounds. Provides that an individual who is a pharmacy technician, pharmacy technician in training, pharmacist student, or pharmacist intern is not required to dispense a contraceptive to a woman if the individual objects on ethical, moral, or religious grounds. Requires the Indiana board of pharmacy (board) to revoke the license of a pharmacist who knowingly or intentionally prescribes a drug that is intended to cause an abortion. Establishes penalties for a pharmacist who prescribes a drug that is intended to cause an abortion. Requires the state health commissioner or the commissioner's designated public health authority to issue a standing order that allows a pharmacist to prescribe and dispense contraceptives until the board adopts rules that adopt the standing order. Establishes requirements for the standing order. Requires the office of the secretary of family and social services to reimburse a pharmacist for services and prescriptions for contraceptives provided to an eligible Medicaid recipient.

Floodplain disclosures. Requires an owner of residential real estate to disclose on the sales disclosure form if any portion of the real estate is located in a floodplain. Repeals a statute concerning floodplain mapping.

Gary Community School Corporation. Terminates the Gary Community School Corporation's (school corporation) status as a distressed political subdivision on June 30, 2024. Provides that the members of the governing body of the school corporation shall be elected at the municipal general election held on November 7, 2023, and take office upon taking the oath required by the Constitution of the State of Indiana not later than November 14, 2023. Requires the governing body to select a superintendent not later than February 1, 2024. Requires the emergency manager and chief financial officer to consistently inform the superintendent of the school corporation regarding the day to day operations of the school corporation. Requires the emergency manager to provide monthly financial and academic reports to the governing body. Provides that the current emergency manager's appointment terminates on June 30, 2024. Provides that the elected governing body assumes all powers, rights, duties, and obligations of the school corporation on July 1, 2024. Provides that, before the governing body sells real property, a building, or another structure owned by the school corporation, the governing body shall: (1) provide written notice to the mayor of the city of Gary at least 30 days before selling the real property, building, or other structure; and (2) provide public notice and hold at least one public hearing within the geographic boundaries of the school corporation to hear public testimony on the proposed sale. Transfers, not later than July 1, 2023, to the common school fund from the state general fund an amount sufficient to pay off all debts from advances and loans that were made to the school corporation from the common school fund. Removes or repeals provisions regarding the establishment and use of a school improvement fund.

Additional prosecuting attorneys. Allows the appointment of additional prosecuting attorneys in certain counties.

Historic rehabilitation tax credit. Beginning in taxable year 2024, allows a qualified taxpayer to claim a historic rehabilitation tax credit equal to 25% or 30% of the qualified expenditures incurred in the restoration and preservation of a qualified historic structure, depending on the type of historic structure.

Student disciplinary proceedings. Requires a state educational institution to: (1) maintain administrative files on disciplinary proceedings that include certain information; (2) record a disciplinary hearing by video recording, audio recording, or written transcript; (3) include certain disciplinary rights and procedures in the state educational institution's code of conduct; and (4) make a good faith effort in disciplinary proceedings to include relevant evidence and exclude evidence that is not relevant or probative. Provides that a student or student organization injured by a violation of these provisions may bring a civil action against the state educational institution.

Domestic violence reports. Removes language concerning an affidavit from provisions concerning probable cause for battery and domestic battery. Requires a law enforcement officer to provide a victim who requests a protection order with the required forms and appropriate assistance in completing and filing the forms.

Discipline rules regarding bullying. Provides that discipline rules adopted by the governing body of a school corporation must include timetables for reporting bullying incidents to parents of both the targeted student and the alleged perpetrator in an expedited manner that is not later than five business days after the incident is reported. (Current law provides that discipline rules adopted by the governing body of a school corporation must include timetables for reporting bullying incidents to parents of both the targeted student and the bully in an expedited manner.) Provides that discipline rules adopted by the governing body of a school corporation: (1) must include provisions that require a school to prioritize the safety of the victim; (2) may include provisions to determine: (A) the severity of an incident of bullying; and (B) whether an incident of bullying may warrant the transfer of the victim or the alleged perpetrator to another school in the school corporation; and (3) must include policies to allow a parent of a child in the school corporation to review any materials used in any bullying prevention or suicide prevention program. Requires public schools to document acts of bullying and abusive behaviors against a victim and committed by a verified perpetrator.

Regulation of sexually oriented businesses. Provides that a sexually oriented business may not operate within 1,000 feet of specified facilities that cater to minors. Exempts pre-existing businesses that have been in continuous operation. Establishes a civil enforcement mechanism. Repeals the existing law concerning sexually explicit materials. Makes conforming amendments.

Recreational vehicle and truck camper excise tax. Provides that, if the owner of a recreational vehicle or truck camper is at least 65 years of age, the annual excise tax for the recreational vehicle or truck camper is 50% of the annual excise tax amount otherwise imposed for a recreational vehicle or truck camper of the same classification and age.

Hospital and health care cost and quality controls. Provides for implementation of a health care improvement and cost control strategy in Indiana that requires equalization of hospital reimbursement rates for all payers by July 1, 2025, and a total cost of care model of health care improvement and cost control for all heath care providers by July 1, 2030. Conditions implementation of the strategy upon approval of the strategy by federal Medicare and Medicaid agencies.

Lake Michigan seawalls. Provides that if an application for a permit or license to construct or repair a seawall or revetment on or near the shore of Lake Michigan is submitted to a local authority and the site or proposed site of the seawall or revetment is on the side of the ordinary high water mark opposite Lake Michigan when the application is submitted but is at other times on the Lake Michigan side of the ordinary high water mark: (1) the applicant shall prepare plans for the construction or repair of the seawall or revetment; (2) the local authority shall refer the application and the applicant's plans to the department of natural resources (department); (3) the department shall study the application and plans and may advise the applicant and the local authority that changes must be made in the plans before the plans may be approved; (4) the department shall approve or disapprove the plans; and (5) if the department approves the plans, the local authority shall grant the application for a permit or license for the construction or repair of the seawall or revetment.
