Requires the criminal justice institute (CJI) to provide grants to law enforcement agencies and testing labs to help eliminate the backlog of untested rape kits. Requires the CJI to make an annual report to the general assembly. Makes an appropriation.

Exemption from prior authorization requirements. Amends the law concerning the prior authorization of health care services by a health plan (which includes a policy of accident and sickness insurance, a health maintenance organization contract, and the Medicaid risk based managed care program). Provides that: (1) if a health plan, during a six month evaluation period, approves at least 90% of a health care provider's requests for prior authorization for a particular type of health care service, the health plan may not require the health care provider to obtain prior authorization for that type of health care service for the entire duration of an exemption period of six calendar months immediately following the evaluation period; and (2) at the conclusion of the initial exemption period, the health plan shall continue granting consecutive exemption periods of six months to the health care provider unless the health plan rescinds the exemption. Provides that a health plan may rescind a health care provider's exemption only on the basis of a determination by a physician that, in at least five and not more than 20 cases randomly selected for review, less than 90% of the health care services provided by the health care provider met the health plan's medical necessity criteria. Authorizes a health care provider that is notified of the rescission of its exemption to initiate a review of the rescission by an independent review panel. Requires the independent review panel to determine whether at least 90% of the health care services provided by the health care provider met the health plan's medical necessity criteria. Requires a health plan to restore the health care provider's exemption if the independent review panel's determination is in favor of the health care provider. Requires the insurance commissioner to adopt rules.

1977 pension and disability fund. Modifies the definition of "salary of a first class patrolman or first class firefighter" for the 1977 police officers' and firefighters' pension and disability fund (fund). Increases the fund's maximum annual cost of living adjustment from 3% to 5%.

Human trafficking. Provides that the human trafficking prevention and victim assistance fund may provide funds for victim transition services. Allows a community based organization to inspect sexually oriented businesses. Requires that all hospital staff likely to have direct, ongoing contact with patients are required to participate in training pertaining to the identification and reporting of human trafficking. Requires sexually oriented businesses and hotels to provide certain training pertaining to the identification and reporting of human trafficking. Provides that a sexually oriented business or hotel that fails to provide this training commits a Class A infraction. Establishes an annual $500 inspection fee to be paid by sexually oriented businesses to be deposited into the human trafficking prevention and victim assistance fund.

Economic development in Lake County. Establishes the blighted property demolition fund (demolition fund). Provides that money in the demolition fund is to be used for costs associated with demolishing a qualified property located in the territory of a current or future transit development district or in the area surrounding the Gary Metro Center. Allows the Lake County fiscal body to adopt an increase in the county innkeeper's tax. Establishes the Lake County economic development and convention fund (convention fund). Provides that money in the convention fund may be used for purposes related to a convention center in Lake County. Establishes a local county fund known as the Lake County convention and event center reserve fund (reserve fund). Provides that the revenue received from an increase in the innkeeper's tax is deposited in the reserve fund. Provides that, beginning July 1, 2023, proposals may be submitted for construction and operation of a Lake County convention and event center to the Lake County board of commissioners. Provides minimum requirements for a proposal. Provides that if a proposal is approved, the Lake County convention center authority is established to provide general oversight. Establishes the Gary Metro Center station revitalization fund (metro center station fund). Establishes the Gary Metro Center station revitalization project board to provide oversight of the ongoing maintenance and operation of the Gary Metro Center station. Beginning after June 30, 2025, requires the department of state revenue to deposit certain amounts in each state fiscal year of the riverboat wagering tax revenue collected from a riverboat operating within the city of Gary in the demolition fund, the convention fund, and the metro center station fund.

Consumer data protection. Establishes in the Indiana Code a new article concerning consumer data protection, to take effect January 1, 2024. Sets forth the following within the new article: (1) Definitions of terms that apply throughout the article. (2) Exemptions for certain: (A) persons; and (B) types of information and data; from the bill's requirements concerning the personal data of Indiana consumers (consumers). (3) The rights of a consumer with respect to personal data relating to the consumer. (4) The responsibilities of controllers of consumers' personal data (controllers). (5) The roles of: (A) controllers; and (B) processors of consumers' personal data (processors); with respect to a consumer's personal data. (6) Requirements for data protection assessments by controllers. (7) Requirements for processing de-identified data or pseudonymous data. (8) Limitations as to the scope of the new article. (9) The establishment, maintenance, and publication by the attorney general's consumer protection division of a quarterly listing of electronic mail addresses of consumers who request that their personal data not be sold. (10) Requirements for brokers of consumers' personal information (data brokers) to: (A) provide notification of security breaches; and (B) register annually with the attorney general. (11) The authority of the attorney general to investigate and enforce suspected or actual violations of the new article. (12) The establishment of the consumer privacy account within the state general fund to support the work of the attorney general in enforcing the new article. (13) The authority of the attorney general to: (A) to adopt rules to administer the new article; and (B) issue opinion letters and interpretive guidance to develop an operational framework for persons subject to the new article. (14) The preemption of local rules, regulation, and laws regarding the processing of personal data.

Charity gaming matters. Defines the term "professional sports team foundation" for purposes of the charity gaming law. Specifies that a professional sports team foundation is a qualified organization. Specifies that qualified organizations may conduct unlicensed allowable events at facilities leased or owned by the capital improvement board of managers of Marion County (CIB). (Current law allows qualified organizations to conduct charity gaming events without a license if the value of all prizes awarded is less than $2,500 for a single event and $7,500 for all unlicensed events conducted during a calendar year.) Authorizes payment by credit card for a chance to enter: (1) a raffle or water race at an allowable event conducted by a qualified organization; and (2) an allowable event conducted at a facility leased or owned by the CIB.

Twenty-first century scholars program enrollment. Amends the twenty-first century scholars program (program) eligibility requirements for certain students. Requires the commission for higher education to notify an emancipated student, or the custodial parent or guardian of a student if the student is an unemancipated minor, of the student's eligibility to participate in the program and right to opt out of the program.

Child sexually abusive materials. Authorizes the attorney general to assess a civil penalty of $1 million on a corporation with a market capitalization of at least $100 billion for each instance in which the corporation knowingly makes available child sexually abusive material, and establishes a procedure for the investigation of a complaint relating to child sexually abusive material. Establishes the child sexually abusive material facilitation prevention fund. Specifies that money in the fund shall be used to: (1) fund the Internet crimes against children fund; and (2) offset forgone tax remittances. Makes an appropriation.

Utility service to rental premises. Amends the statute concerning a landlord's obligations under a residential rental agreement to include within those obligations the duty to remain current on all bills for utility service to the rental premises (other than for utility service for which a tenant is responsible for paying under the rental agreement or state law). Provides that a landlord that: (1) offers for rent at least 100 rental units that are part of one or more structures that: (A) are located on the same parcel of property or on contiguous parcels of property; and (B) are master metered for one or more utility services; and (2) fails to meet this new obligation; may not file or prosecute an eviction action for nonpayment of rent against a tenant of the rental premises until the delinquency for utility service provided to the rental premises has been cured. Requires the Indiana housing and community development authority (authority) to do the following not later than August 31, 2023: (1) Designate itself to serve as, or contract to provide, an escrow agent to whom a tenant of a rental premises for which the landlord has failed to meet this new obligation, resulting in a utility bill that is at least 60 days past due, may pay rent until the delinquency has been cured. (2) In collaboration with the Indiana utility regulatory commission (IURC), create a form that: (A) is accessible on the authority's website and the IURC's website; and (B) allows a utility to: (i) report the delinquency; and (ii) request that the designated escrow agent perform certain duties with respect to the delinquency. Provides that a utility that submits a form to report a delinquency and request the services of the escrow agent must provide to the tenants, through conspicuous signage placed within the utility's property rights on the affected parcels, notice of the landlord's delinquency and of a tenant's right to pay rent to the escrow agent, instead of the landlord, until the delinquency for utility service is cured. Specifies the duties of the escrow agent with respect to: (1) collecting rent from tenants; (2) paying collected rent to the utility; (3) paying remaining amounts of collected rent to the landlord upon the delinquency being cured; (4) reporting to the landlord, the utility, the authority, and the IURC certain collection and payment data on a monthly basis; and (5) providing a final accounting and notice once the delinquency has been cured and the escrow has been closed.
