Criminal mischief and criminal trespass. Provides that a person who recklessly, knowingly, or intentionally damages the property of a scientific research facility without the consent of, or with consent which was fraudulently obtained from, the owner, possessor, or occupant of the property that is damaged commits criminal mischief, a Class A misdemeanor. Provides that a person who, not having a contractual interest in the property, knowingly or intentionally enters the real property of a scientific research facility without the permission of, or with permission which was fraudulently obtained from, the owner of the scientific research facility or an authorized person, and knowingly or intentionally engages in conduct that causes property damage to: (1) the owner of or a person having a contractual interest in the scientific research facility; (2) the operator of the scientific research facility; or (3) a person having personal property located on the property of the scientific research facility; commits criminal trespass, a Level 6 felony.

Department of child services matters. Defines "Indian child" for purposes of family and juvenile law. Provides that certain records relating to foster care children may be maintained in an electronic format. Provides that certain individuals may request a child's Social Security number for income tax purposes. Requires the department of child services (department) to: (1) develop a form an individual may submit to request a child's Social Security number; and (2) approve or deny a request for a child's Social Security number not later than 10 business days after receiving the request. Requires the department to approve an individual's request for a child's Social Security number if: (1) the child lived with the individual in the 18 months preceding the request; and (2) the child lived with the individual for: (A) at least six months in any one calendar year; or (B) more than 1/2 of the days the child lived during a calendar year if the child was born or died in the calendar year; unless the child does not have a Social Security number or the department does not have a record of the child's Social Security number. Provides that certain information, documents, reports, pictures, videos, images, or recordings related to department matters are confidential. Requires that information that is otherwise confidential must be made available to: (1) a tribal representative, agency, or organization authorized by an Indian child's tribe to care for, diagnose, treat, review, evaluate, or monitor active efforts regarding the Indian child, and the Indian child's parent, guardian, or custodian; and (2) the United States Department of State and foreign governments to comply with federal law and treaties. Provides that the department: (1) may; and (2) under specified circumstances, shall; notify a child care worker's employer of a substantiated report of child abuse or neglect made against the child care worker. Makes a technical correction.

Rare disease advisory committee. Establishes the rare disease advisory committee.

Minimum wage. Increases, for any work week beginning on or after July 1, 2023, the minimum wage paid to certain employees from $7.25 per hour to $15 per hour. Makes conforming amendments and a technical correction.

Elections matters. Prohibits the Indiana election commission from doing any of the following: (1) Instituting, increasing, or expanding vote by mail or absentee vote by mail. (2) Changing the time, place, or manner of holding an election. Prohibits a person from providing an absentee ballot application to an individual with the individual's driver's license number, identification card number, unique identifying number assigned to the voter's registration record, or last four digits of the individual's Social Security number already printed on the form. Requires an applicant for an absentee ballot application to include: (1) the applicant's driver's license number or identification card number; and (2) a photocopy of the document from which the applicant provides the license number or identification card number. Requires the secretary of state to conduct an audit of all computer equipment used at each general election, beginning with the 2022 general election. Prohibits the governor from changing, during a declared disaster emergency, the time, place, or manner of holding an election. Makes conforming changes.

Various education matters. Requires each school corporation to publish on the school corporation's website the graduation rate for each high school in the school corporation. Amends the definition of "graduation" for purposes of the high school graduation rate determination. Provides that credit for an algebra course earned under certain conditions must count toward the credit requirements for an academic honors diploma. Allows a school corporation to adopt a policy concerning dress code or distractive behavior.

Employment discrimination claims in state court. Expands the definition of "employer", for purposes of civil rights enforcement, to include any person employing one or more persons within the state. (Current law defines "employer" to include any person employing six or more persons within the state.) Permits a civil rights action to be tried by a jury. Removes the requirement that both parties must consent before a civil rights claim is heard as a civil cause of action.

Maximum operating referendum tax. Provides that, notwithstanding any increase in assessed value of property from the previous assessment date, the total amount of operating referendum tax that may be levied by a school corporation for taxes first due and payable in 2024 may not increase by more than 5% over the maximum operating referendum tax that could be levied by the school corporation in the previous year.

Minimum teacher salaries. Provides that, for each school year beginning after June 30, 2024, a school corporation shall, if the school corporation determines that the school corporation cannot establish a minimum salary of $50,000 for each full-time teacher, submit a report to the department of education explaining the school corporation's inability to meet the minimum threshold requirement. (Current law establishes this requirement if a school corporation determines that the school corporation cannot establish a minimum salary of $40,000 for each full-time teacher.)

Indiana farmland trust. Establishes the farmland trust advisory board. Authorizes the Indiana state department of agriculture (department) to accept or acquire certain real or personal property to be held in trust. Allows the department to lease agricultural land that is held in trust. Creates the Indiana farmland trust fund to: (1) purchase permanent agricultural conservation easements; (2) purchase agricultural land; and (3) maintain any agricultural land that is held in trust by the department. Provides that an agricultural conservation easement that meets the agricultural conservation easement requirements shall be assessed and taxed on a basis that reflects the agricultural conservation easement. Provides that the state or a unit of local government may not acquire an interest in any real property through eminent domain if the real property is subject to an agricultural conservation easement, unless permission has been granted by the director of the department. Specifies that an agricultural conservation easement does not affect the ability of a public utility or a municipally owned utility to acquire property or property rights to be used in connection with the provision of utility services to the public. Requires the department to adopt rules concerning requirements to lease agricultural land held in trust by the department.

Commercial property assessed clean energy program. Authorizes counties, cities, and towns (local units) to adopt a commercial property assessed clean energy program (PACE program) as a financing mechanism to allow commercial property owners to obtain financing for energy efficient improvements, with the repayment of the financing obligation for those improvements made from a voluntary tax assessment (special assessment) on the property. Defines an "energy efficient improvement". Requires a property owner to petition a local unit that has adopted a PACE program to impose a special assessment on the property, the proceeds of which would be transferred to the financing provider for the purchase and installation of the energy efficient improvement. Requires all owners of record of a property to sign the petition. Requires the petition to contain the written consent of each mortgage lien holder on the property stating that the lien holder does not object to the imposition of the assessment. Requires certain provisions to be included in an assessment contract. Specifies the procedures for imposing the special assessment and the priority of any tax lien. Prohibits the local unit from issuing bonds secured by tax revenue from any special assessment and further specifies that a local unit shall have no financial obligation or liability for the payment of tax revenue from a special assessment, other than to transfer the proceeds to the financing provider for the improvements.

Threats against election workers. Provides that a person commits intimidation, a Level 5 felony, if the subject of the threat or the person to whom the threat is communicated is an election worker. Defines "election worker" for this purpose.

Property tax assessment appeals. Changes references to the "supreme court" to the "court of appeals" in provisions relating to the payment of taxes pending appeals. Provides that decisions of the tax court may be appealed directly to the court of appeals (rather than the supreme court).

First responders recognition monument. Establishes the American first responders recognition monument committee (committee). Provides that the purpose of the American first responders recognition monument is to reflect on the sacrifice made by first responders catastrophically injured in the line of service. Provides that the purpose of the committee is to administer the disbursement of funds to responsible artisans and organizations to facilitate the design, prototyping, fabrication, and installation of the American first responders recognition monument. Establishes the membership of the committee. Appropriates $350,000 from the state general fund to the department of homeland security (department) to be used by the department to make disbursements to responsible artisans and organizations to facilitate the design, prototyping, fabrication, and installation of the American first responders recognition monument.

Pregnancy accommodation. Requires an employer to grant an employee's request for a reasonable accommodation for a known limitation related to the employee's pregnancy absent undue hardship on the employer's business. Provides that an employer may not require an employee to take leave under a leave law or policy adopted by the employer if another reasonable accommodation can be provided for known limitations arising from pregnancy, childbirth, or related medical conditions. Establishes a civil action for a violation of these provisions.
