Case management after family reunification. Provides that if the dispositional decree entered in the case of a child who is removed from the home of the child's parent, guardian, or custodian provides for reunification of the child with the parent, guardian, or custodian, the department of child services (department) shall conduct random, unannounced, in-home, face-to-face assessments of the child not less than once each week for the first six months following the child's return to the home. Provides that: (1) if the dispositional decree entered in the case of a child who is removed from the home of the child's parent, guardian, or custodian: (A) provides for reunification of the child with the parent, guardian, or custodian; and (B) requires the parent, guardian, or custodian to participate in an addiction treatment program; the dispositional decree must require the parent, guardian, or custodian to submit to weekly, random drug testing for the first six months following the child's return to the home; and (2) if the parent, guardian, or custodian tests positive for a controlled substance or fails to submit to a required drug test after the child's return to the home, the department shall change the placement of the child and file an emergency motion with the court or request the court to issue a temporary order for an emergency change in the child's placement. Provides that if a child who is removed from the home of the child's parent, guardian, or custodian is returned to the home of the parent, guardian, or custodian for purposes of a trial home visit, the department shall conduct random, unannounced, in-home, face-to-face assessments of the child not less than once each week for the duration of the trial home visit. Provides that: (1) if a child is removed from the home of the child's parent, guardian, or custodian and the child's dispositional decree requires the child's parent, guardian, or custodian to participate in an addiction treatment program, the dispositional decree must require that the parent, guardian, or custodian submit to weekly, random drug testing for the duration of a trial home visit; and (2) if the parent, guardian, or custodian tests positive for a controlled substance or fails to submit to a required drug test during a trial home visit, the department shall terminate the trial home visit. Provides that a trial home visit must be at least three months in duration, subject to circumstances necessitating removal of the child from the home. Provides that if a dispositional decree requires a child's parent, guardian, or custodian to participate in a program of care, treatment, or rehabilitation and the court finds that the parent, guardian, or custodian has failed to make consistent and timely progress toward the goals set forth in the dispositional decree: (1) the department: (A) shall not allow the parent, guardian, or custodian supervised visitation with the child until the court finds that the parent, guardian, or custodian is making consistent and timely progress toward the goals set forth in the dispositional decree; and (B) shall not return the child to the home of the parent, guardian, or custodian, including for purposes of a trial home visit, or allow the parent, guardian, or custodian unsupervised visitation with the child, until the parent, guardian, or custodian completes the services required under the program of care, treatment, or rehabilitation; and (2) the court shall not modify the dispositional decree to reduce the number of services in which the parent, guardian, or custodian is required to participate unless the court finds that a compelling reason exists for the modification.

Tax deductions and credits related to military service. Provides a state income tax deduction for a member of an active or reserve component of the armed forces of the United States or the National Guard who has military income that is attributable to military service while deployed or stationed outside of the United States equal to the amount of income attributable to that military service. Establishes a tax credit for a taxpayer that employs a member of a reserve component of the armed forces of the United States or the National Guard. Requires the taxpayer to submit certain information to the department of state revenue to claim the credit.

Resources for committed offenders upon release. Requires the department of correction (department) to provide: (1) a short term supply of medication to certain Medicaid eligible committed offenders and a discharge summary of the medications provided to the committed offender during the committed offender's term of incarceration; (2) assistance to obtain certain documentation; and (3) assistance in obtaining a credential from the bureau of motor vehicles at the time of the committed offender's release on parole, assignment to a community transition program, or discharge from the department. Provides Medicaid coverage for a prescription provided by the department at the time of an offender's release on parole, assignment to a community transition program, or discharge from the department.

Conduct of CDL physical by physical therapists. Defines "certified medical examiner". Provides that, unless there is a conflict with federal law or the orders, standards, or regulations of the Federal Motor Carrier Safety Administration (FMCSA), a licensed physical therapist may perform an examination (exam) for an applicant for an initial or a renewal commercial driver's license or commercial learner's permit that is within the physical therapist's scope of practice. Provides that a physical therapist who performs an exam is subject to the requirements of the FMCSA for a certified medical examiner.

Notice of change to provider agreement. Requires an insurer and a health maintenance organization to provide a contracted provider with a current reimbursement rate schedule: (1) every two years; and (2) when three or more Current Procedural Terminology (CPT) code rates change in a 12 month period. Requires an insurer and a health maintenance organization to provide a contracted provider with notice of a proposed material change to the agreement between the insurer or health maintenance organization and the contracted provider at least 90 days prior to the proposed effective date. Establishes requirements for the contents of a notice of a proposed material change. Requires an insurer or health maintenance organization to provide a contracted provider with notice at least 15 days prior to a change to an existing prior authorization, precertification, notification, referral program, edit program, or specific edits.

Emergency powers. Provides that in the event of a disaster emergency, an emergency order issued by a state agency must be narrowly tailored to serve a compelling public health or safety interest. Entitles a person to relief if a court determines that the person seeking judicial relief has been prejudiced by an agency action issued during a disaster emergency that has not been: (1) applied equally to a similarly situated person; and (2) narrowly tailored to serve a compelling public health or safety interest. Provides that the orders, rules, and regulations made, amended, or rescinded by the governor must be narrowly tailored to serve a compelling public health or safety interest. Requires any state or local agency, including the Indiana department of health and local boards of health, to only impose a restriction that is narrowly tailored to serve a compelling public health or safety interest. Provides that any order or proclamation declaring, continuing, or terminating a local disaster emergency must be narrowly tailored to serve a compelling public health or safety interest. Provides that, if the disaster which is the basis of the emergency order impacts an area of the state which does not exceed the lesser of: (1) 31 counties; or (2) an area which is inhabited by less than 33 1/3% of the population of the state; the state of emergency expires in 30 days. Provides that the governor may renew the emergency declaration in 30 day increments not to exceed a period of 12 months. Provides that all other emergency declarations expire 30 days after the initial date of the governor's executive order and may not be renewed or extended by the governor without the approval of the general assembly. Removes the governor's ability to suspend certain provisions relating to the general assembly, judicial relief of an agency action during an emergency declaration, or provisions relating to emergency management disasters. Repeals provisions authorizing the general assembly to conduct emergency sessions.

FSSA matters. Changes the name of the bureau of developmental disabilities services to the bureau of disabilities services. Removes certain members from the 211 advisory committee. Repeals Medicaid copayment provisions that: (1) require the office of the secretary of family and social services (office) to apply a copayment for certain Medicaid services; (2) require a recipient to make a copayment upon the receipt of services and for a provider not to voluntarily waive a copayment; (3) set forth exemptions from copayment requirements; and (4) require the provider to charge the maximum allowable copayment. Allows for an enrollment fee, a premium, a copayment, or a similar charge to be imposed as a condition of an individual's eligibility for the healthy Indiana plan and the children's health insurance program. Removes a prohibition on the office from: (1) requiring certain providers to submit non-Medicaid revenue information in the provider's annual historical financial report; and (2) only requesting balance sheets from certain providers that apply directly to the provider's facility. Allows the office to implement an end of therapy reclassification methodology in a successor of the RUG-IV, 48-Group model for payment of nursing facility services.

PFAS biomonitoring pilot program. Establishes the PFAS biomonitoring pilot program (pilot program) under the department of homeland security (department) to collect and analyze blood samples of individuals who were previously, or are currently, firefighters: (1) for serum PFAS levels; and (2) to determine whether there may be corresponding health implications associated with elevated serum PFAS levels. Requires the department to consult the department of environmental management and the Indiana department of health regarding the pilot program. Provides that the department shall, to the extent possible, test 1,000 firefighters. Allows the department to work with a third party to administer the pilot program and to store data collected under the pilot program. Requires the department to submit, not later than July 1, 2027, a report summarizing: (1) the results of the pilot program; and (2) recommendations of the department, the department of environmental management, and the Indiana department of health for decreasing serum PFAS levels and exposure to PFAS chemicals; to the governor and the legislative council. Establishes the PFAS biomonitoring pilot fund. Makes an appropriation.
