Alabama Lead Ban Act; percentages of lead that constitute "lead-free" revised; city and county plumbing codes required to conform; certain applications exempted

This act amends Section 36-22-64, Code of Alabama 1975, to: (1) prohibit individuals from participating in both a supernumerary sheriff program and the Employees' Retirement System (ERS) based on the same service; and (2) authorize individuals who independently qualify for a supernumerary sheriff program and the ERS based on separate service to participate in both programs.

This act amends Sections 12-17-227.4 and 12-17-227.5, Code of Alabama 1975, to: (1) increase the percentage of final average compensation used to calculate service retirement allowances and disability retirement allowances under the District Attorneys' Plan for Retirement under the Judicial Retirement Fund from three percent to four percent; (2) decrease the maximum service and disability retirement allowances under the plan from 80 percent to 75 percent of the recipient's final average compensation; and (3) require the service and disability retirement allowances for members who have attained at least 18 years of membership service to be 75 percent of the member's average final compensation.

This act proposes an amendment to the Constitution of Alabama of 2022, relating to Blount County, to authorize qualified taxpayers 65 years of age or older to claim a senior property tax exemption for single-family owner-occupied residential property beginning October 1, 2027, subject to certain conditions.

This act proposes an amendment to the Constitution of Alabama of 2022, relating to Limestone County, to authorize qualified taxpayers 65 years of age or older to claim a senior property tax exemption for single-family owner-occupied residential property beginning October 1, 2027, subject to certain conditions.

This act is the Alabama Personal Data Protection Act. This act: (1) applies to persons conducting business in the state or targeting state residents that control more than 25,000 consumers' personal data and derive more than 25 percent of gross revenue from selling such data; (2) authorizes consumers to invoke, and requires these controllers of personal data to comply with, certain rights of these consumers, including opting out of data processing or requesting deletion and correction of personal data; (3) authorizes parents, guardians, and conservators to exercise these rights on behalf of their child or consumer; (4) provides procedures and guidelines for making and complying with such requests, including that no fees may be charged and a controller must respond to authenticated requests within 45 days and provide information once a year; (5) requires controllers to provide a conspicuous link on their website for consumers to opt out of personal data processing; (6) requires controllers to limit collecting and to protect personal data, including deidentified data; (7) prohibits controllers from certain actions, including processing personal data for not reasonably necessary, undisclosed purposes, processing data of individuals without consent, processing data in a discriminatory manner, and providing a different quality of service to consumers upon opting out of data processing; (8) requires controllers to provide notice when personal data is sold to third parties or processed for targeted advertising; (9) requires personal data processors to adhere to controllers' instructions pursuant to this act; and (10) exempts certain persons and types of data from these requirements.

This act is the Alabama Living Donor Protection Act. This act: (1) prohibits insurers from declining or limiting coverage of an individual solely because he or she is a living organ donor, requiring an individual to refrain from donating an organ as a condition for policy renewal, or otherwise discriminating against living organ donors; (2) authorizes state employees to receive up to 30 days leave when donating an organ and up to seven days leave when donating bone marrow upon submitting a written request accompanied by a doctor's verification and approval of the State Director of Personnel; (3) authorizes county and municipal employees and other public employees to receive up to 30 days leave when donating an organ and up to seven days leave when donating bone marrow upon submitting a written request accompanied by a doctor's verification and approval of the appointing authority, with protection from job-related retaliation or discrimination; and (4) beginning January 1, 2027 and ending December 31, 2031, authorizes private sector employers to claim a tax credit equal to 25 percent of the gross compensation paid to an employee for the period of leave taken, not exceeding $2,000, for affording employees up to 30 days of paid leave to make an organ donation, subject to the employer adopting a specific formal policy and not reducing pay.

This act substantially amends Chapter 2B of Title 31, Code of Alabama 1975, relating to the Alabama National Guard and State Military Department, to: (1) revise the duties of State Staff Judge Advocates to include serving their respective military service component within the Alabama National Guard and not the Alabama National Guard generally; (2) revise the duties of the General Counsel to include serving the State Military Department; (3) require the Deputy General Counsel's Alabama National Guard Legal Services Manual and the Military Justice Associate General Counsel's Alabama Manual for Courts-Martial both be approved by the General Counsel prior to publication; (4) require the Contract and Fiscal Law Associate, Administrative and Civil Law Associate General Counsel, Operational Law Associate General Counsel, and Legal Assistance Associate General Counsel to supervise their respective legal areas within the Office of the General Counsel and condition each officer's respective statutorily required publication on the Adjutant General's and General Counsel's consent; and (5) provide that paralegal and warrant officers employed by the Office of General Counsel are under the General Counsel's command.

This act amends Sections 40-18-470, 40-18-471, 40-18-472, and 40-18-473, Code of Alabama 1975, relating to the Sweet Home Alabama Tourism Investment Act, to: (1) define the term "completion date," add that resort developments may be qualifying projects if consisting of at least 200 vacation rental units and that tourism attractions are not required to be within an entertainment district to be a qualifying project; (2) authorize companies awarded a supplemental rebate to claim up to $7,500,000 over five years notwithstanding rebate limits; (3) require companies approved to receive a tax rebate from taxes generated by projects to document project costs certified by independent persons; and (4) require approved companies to verify specific information to ensure projects have met capital investment requirements.

Law enforcement; Attorney General and Governor authorized to appoint interim police chief, subject to conditions

This act proposes an amendment to the Constitution of Alabama of 2022, relating to Madison County, to: (1) require private sewer systems that use public rights-of-way to collect or dispose of sewage, discharge to certain wastewater treatment facilities, and bill customers flat fees or fees based on consumption to be certified and regulated by the Public Service Commission, including rates charged; and (2) provide procedures for the county, a municipality, or a governmental utility service corporation to enter into a rate control agreement with such a private sewer system to opt out of Public Service Commission regulation.
