Jefferson County; special reserve deputies, appointment and powers authorized

This act: (1) makes an appropriation of $460,000 from the Education Trust Fund to Southern Preparatory Academy for the fiscal year ending September 30, 2027; (2) conditions the appropriation on the submission of an approved operations plan and audited financial statement to the Director of Finance; and (3) requires quarterly expenditure and year-end performance reports to be submitted to the director.

Crimes and offenses; manslaughter, criminally negligent homicide, and other motor vehicle crimes amended, restitution amended

This act makes supplemental appropriations from the Education Trust Fund Advancement and Technology Fund for the fiscal year ending September 30, 2026, to: (1) the public institutions of higher education in the amount of $275,100,000; (2) the Department of Education to be allocated to the local boards of education and other entities in the amount of $570,000,000; (3) the Department of Education to be allocated to local boards of education, including for certain entities and uses, in the amount of $4,900,000; and (4) the Department of Education to be allocated to local boards of education to provide matching grants to local education agencies for regional career technology center development expenses in the amount of $150,000,000.

This act transfers from the Educational Opportunities Reserve Fund, for the fiscal year ending September 30, 2026: (1) $399,150,000 to the Renewing Alabama's Investment in Student Excellence (RAISE) Fund for the continuation and expansion of RAISE Act; and (2) $100,850,000 to the College and Higher Education Excellence and Results (CHEER) Fund to provide initial funding to implement the CHEER Act.

This act: (1) provides a 2 percent pay increase to certain public education employees beginning with fiscal year 2026-2027; and (2) provides a one-time lump-sum longevity bonus to certain retirees and beneficiaries of the Teachers' Retirement System in the amount of $1 per month for each year of service.

Vaccines; religious exemption for K-12 students further provided for, religious exemption for students at public institutions of higher education provided

This act: (1) makes an appropriation of $1,372,572 from the Education Trust Fund to Talladega College for the fiscal year ending September 30, 2027; (2) conditions the appropriation on the submission of an approved operations plan and audited financial statement to the Director of Finance; and (3) requires quarterly expenditure and year-end performance reports to be submitted to the director.

This act: (1) makes an appropriation of $16,300,159 from the Education Trust Fund to Tuskegee University for the fiscal year ending September 30, 2027, $2,000,000 of which is required to be expended for the agricultural research and extension service state match; (2) conditions the appropriation on the submission of an approved operations plan and audited financial statement to the Director of Finance; and (3) requires quarterly expenditure and year-end performance reports to be submitted to the director.

This act substantially amends the Alabama Business and Nonprofit Entity Code, Title 10A of, and adds Sections 10A-2A-8.70, 10A-3A-6.14, 10A-3A-8.61, 10A-3A-8.62, and 10A-3A-8.70 to, the Code of Alabama 1975, to: (1) clarify the internal affairs doctrine thereby codifying the relevant common law; (2) provide for entities' filling instruments to be corrected and nullified; (3) prohibit registered agents from performing duties or functions via a virtual office or the retention of a mail forwarding service; (4) provide procedures for the execution of certificates of withdrawal by foreign entities; (5) authorize certain bylaw provisions regarding proxy matters, including proxy solicitations; (6) further provide for the rights of, and procedures governing, owners' and members' requests to inspect entities' records, including expedited judicial review for noncompliance; (7) provide duties of stockholders to the corporation and fellow stockholders; and (8) provide procedures and duties of officers, directors, stockholders, and corporate members regarding conflicting interest transactions and corporate opportunity transactions. This act also repeals Sections 10A-2A-16.10 and 10A-3A-4.20, Code of Alabama 1975, which provided for financial statements for entities' stockholders and members.

Crimes and procedure; crime of authority figure sexual abuse, established; crimes of indecent exposure and other sex crimes further provided to include additional victims; crime of inpatient custodial sexual misconduct, established; domestic violence offenses, further provided to include additional victims and criminal penalties

Wheelchair repair; establishing time restrictions to ensure prompt repair, to require Medicaid coverage of repair, and to require manufacturers of motorized wheelchairs to provide necessary documentation, parts, and tools to independent repair providers

This act is the Financial Innovation and Market Expansion Act. This act adds Chapter 7B to Title 8, Code of Alabama 1975, to: (1) prohibit issuing payment stablecoins without a permit, subject to exceptions; (2) beginning 2028, prohibit digital asset service providers from offering payment stablecoins not issued by permittees, subject to exceptions; (3) authorize the Alabama Securities Commission to establish a license application process according to specified requirements; (4) require licensees to implement anti-money laundering and economic sanctions programs; (5) authorize and require the commission to adopt rules, including fees, to administer this act; (6) authorize the commission to investigate and examine licensees for violations of this act; (7) require the commission to report annually on this act to the Legislature; (8) authorize the commission to enforce this act, including suspending or revoking licenses, ordering licensees to desist violations; and bringing actions in the Circuit Court of Montgomery County; (9) provide that with regard to offering or purchasing stablecoin, knowingly defrauding persons and making untrue statements is a Class B felony; (10) provide that intentionally falsifying information required by this act is a Class C felony; (11) provide that intentionally engaging in activities requiring a license under this act without a license is a Class C felony if more than $5,000 is received in a 30-day period, and a Class D felony if less than $5,000 is received in a 30 day-period; and (12) authorize the commission to assess civil penalties of not more than $10,000 for violating this act.

Sex offenders; restrictions for certain sex offenders further provided, Board of Pardons and Paroles authorized to adopt rules

This act amends Chapters 2 and 2A of Title 26, Code of Alabama 1975, throughout to: (1) provide procedures and notice requirements for the removal of guardianship and conservatorship proceedings from probate court to circuit court; (2) specify when the circuit court may remand such proceedings; (3) revise notice requirements relating to guardianship and protective proceedings; (4) establish the duties of guardians ad litem, which include protecting the best interests of the respondent and other duties relating to communication, recordkeeping, reporting, investigation, and advocacy; and (5) require guardians ad litem to complete a training program prior to appointment. This act adds Sections 26-2A-54, 26-2A-107.1, and 26-2A-136.1 to the Code of Alabama 1975, to: (1) require the probate court to appoint a court representative to independently evaluate petitions for guardianships and protective proceedings in certain circumstances; (2) specify the duties of court representatives; (3) authorize the probate court to appoint a temporary or emergency guardian or a temporary or emergency conservator under certain circumstances; (4) provide notice requirements, limits on the duration of authority, hearing requirements, and procedures for removal in proceedings relating to temporary and emergency guardians and conservators; and (5) revise when a court may preserve and apply property of a person who is the subject of protective proceedings. This act also repeals Section 26-2A-107, Code of Alabama 1975, relating to the appointment of temporary guardians.
