Summary: The conference committees reconvened on April 25, 2025, and worked through a series of measures, mostly public employment cost items, appropriations, workers’ compensation, data sharing, and retirement-related bills. Several bills were briefly held for later action because Finance/FIN-WAM or related release had not yet been received, including SB 382, HB 423, HB 480, HB 214, HB 828, HB 717, HB 1065, and HB 1036, with some of those rolled over to a 2:30 p.m. meeting in Conference Room 16. HB 1424, relating to appropriations, was described as requiring the Director of Finance to report on transfers between position funding and operating expenses; the conferees agreed to a CD1 and voted to pass it. HB 430, relating to internships, was also agreed to in CD1 with technical amendments removing certain appropriation language and was passed after clarification that the funding covered both years and included the Helima program. The committees then moved through a block of public employment cost items. HB 1026, HB 1027, HB 1028, HB 1029, HB 1030, HB 1032, HB 1034, and HB 1035 were each reported as having CD1 agreement and Finance/WAM release, with appropriations tied to various bargaining units and governor’s messages; each was voted out. HB 1036 and HB 1037 were held over due to release issues, while HB 1038 was noted as having CD1 and Finance/WAM release and was passed for bargaining unit 13. HB 1039 was also rolled over for lack of release. Later, SB 336 on defense of state employees was agreed to with technical cleanup and passed as a CD, and SB 1491 on departmental data sharing was amended to add agencies to the state longitudinal data system and require aggregation/anonymization of certain data before being passed as a CD. Additional measures were also resolved. SB 935, relating to government, was amended to reduce the ERS multiplier for judges beginning in 2031, remove sheriff and deputy sheriff language, and require a DHR study on changing vesting from 10 to 5 years; it passed as a CD with no appropriation. SB 1567 required DERT to complete a comprehensive review of classification and compensation systems by October 31, 2026, allowed a third-party contractor, required legislative reports, and included $1.75 million in the budget; it passed as a CD. SB 855, relating to the Hawaii Retirement Savings Act, clarified covered employers, required automatic enrollment unless employees opt out, repealed a fee cap, and added funding for FY26 and FY27; it passed as a CD. SB 743 established a data sharing governance working group within the Office of Enterprise Technology Services and required a legislative report; after a brief recess it was passed as a CD. SB 717 and SB 1065 were both continued to the later 2:30 p.m. meeting because release was still pending.

Summary: The Agriculture and Natural Resources Budget Committee met to organize for the session, confirm a quorum, and hear introductory remarks from members about their districts and interests. Chair Esposito outlined the committee’s jurisdiction and budget overview, noting a total budget of about $7.2 billion, with major funding tied to the Department of Environmental Protection, the Department of Agriculture and Consumer Services, Fish and Wildlife, and the Department of Citrus. She also described major cost drivers such as Everglades restoration, water quality, resiliency, land acquisition, and rural family lands, and asked members to review agency requests in small groups later in the process. Agency leaders then presented budget and program updates. Agriculture Commissioner Wilton Simpson emphasized department efficiency efforts, including IT modernization, staff reorganization, rural and family lands conservation, best management practices, Fresh From Florida marketing, hurricane recovery loans for farmers, and completion of the Connor Complex headquarters. DEP Secretary Alexis Lambert highlighted record investments in Everglades restoration, water quality projects, resilience grants, land acquisition, state parks, and enforcement. FWC Executive Director Roger Young discussed conservation research, fisheries and wildlife management, law enforcement, disaster response, and pressures from growth, boating, invasive species, and derelict vessels. Department of Citrus Executive Director Shannon Shep reviewed the industry’s decline due to hurricanes and citrus greening, current research and marketing efforts, and e-commerce campaigns to support Florida citrus sales. Members asked questions about citrus production declines, future replanting and therapies, rural family lands, PFOS cleanup, mangrove restoration, flooding and pump infrastructure, agricultural theft, and derelict vessel removal. Officials generally responded with updates, emphasized science-based management and enforcement, and in several cases said they would follow up with more detailed information later. No formal votes were taken; the meeting ended with the chair directing members to provide feedback on agencies for further budget review and then adjournment.

Summary: The Ways and Means Committee held a public hearing on Senate Bill 291, which would update religious land-use and property tax exemption rules for church-owned parsonages, parish houses, and similar properties. Senator Tim Lang, speaking for the sponsor, said the bill was intended to address situations where former parsonages are no longer occupied by clergy and are instead used for church-related purposes such as housing staff, religious education, or congregate living tied to ministry, including addiction recovery. He emphasized that the bill was not meant to create commercial rental housing and that it also preserves reasonable zoning and environmental regulations. Committee members pressed the sponsor on how the bill would be applied, especially the meaning of “religious purposes,” the six-unit limit, the “same lot” language, and whether churches could use the exemption to rent units for revenue. The sponsor said the six-unit cap was added to prevent large-scale commercial rental use, that congregate housing would be limited and defined, and that the bill was meant to cover uses like substance abuse recovery, homes for unwed mothers, and religious education, but not apartments converted for ordinary rental. He also said churches would still file annual exemption paperwork and towns could challenge claims they believed were commercial. Questions also raised concerns about whether the bill treated religious and nonreligious housing trusts differently; the sponsor responded that the bill was aimed at church-owned property used in pursuit of a religious mission. Several witnesses testified in support. Representative Mark Pearson, an active clergyman, said the bill would not remove additional property from the tax rolls because clergy housing allowances typically lead clergy to buy taxable homes elsewhere, while the church-owned parsonage remains exempt. Nick Taylor of Housing Action New Hampshire supported the bill as a modest expansion that could help create more attainable housing by allowing better use of existing religious land and structures, though he noted his organization would support even broader use. The hearing ended without a vote or final action, and the chair closed questions after the testimony.

Summary: The joint Ways and Means and Hawaiian Affairs committee heard a budget presentation from the Department of Hawaiian Home Lands on its biennium requests for critical projects, repairs and maintenance, and operations. DHHL described its role in administering the Hawaiian Home Lands Trust, noted the large beneficiary wait list, and said prior funding, including Act 279, has helped the department accelerate land development and reduce vacancies. Officials said they have about 47,219 applications involving 29,548 Native Hawaiians, roughly 28 projects underway, and that about $471 million of a $600 million appropriation has been encumbered, with the remaining lapse-fix funds expected to be resolved before the June 30, 2026 deadline. DHHL emphasized that its current request would support additional lot development and could help produce roughly 6,000 units from the existing project pipeline, with another phase of requests potentially adding about 2,000 more units. The department said it is prioritizing shovel-ready projects, accelerating lease awards and orientations, and using a mix of approaches including paper leases, rental-with-option-to-purchase, owner-builder, and loan programs. Officials also discussed a shift toward denser urban development, citing projects in West Oahu and Honolulu, and said the department is working to reduce its vacancy rate and move beneficiaries onto the land more quickly. Members questioned why Oahu, despite having the largest wait list, was receiving comparatively lower amounts, and DHHL responded that land availability and cost drive those decisions, with Oahu having limited developable land and very high acquisition costs. The department pointed to land acquisition on Kauai and other islands, and to urban high-rise projects that can yield far more units on small parcels. Members also raised long-term maintenance and wildfire risk, asking whether current acquisition and development choices account for future infrastructure costs; DHHL said maintenance is a growing concern, especially on large unused or isolated lands, and that it is pursuing Firewise planning, federal funds, and partnerships to reduce risk. The discussion also touched on mixed-use and community-led development, with DHHL explaining that it leases land to nonprofit homestead associations under general leases with milestones, business-plan requirements, and land-use restrictions to support local services and community goals.

Summary: The committee discussed a draft amendment to consolidate two proposed studies into one Legislative Management study on sentencing, corrections, and parole oversight. Representative O’Brien explained that the revised language would cover the Department of Corrections and Rehabilitation’s inmate classification, housing, placement authority, and transitional services, including work or educational release, while avoiding confusion over separate study proposals. Members also discussed whether issues such as earning good time, meritorious time, parole eligibility, and release decisions would be included; the chair and members concluded those topics would be covered under the parole board and related study language. Several members raised concerns about recidivism data, including the difficulty of counting people who are incarcerated in other states or in the federal system after release from North Dakota custody. Representative Murphy noted that DOCR appears to be using the best available national-study-based method, but that the data limitations remain a problem. The chair and others said the study should focus on what can be measured and that interagency communication is important, while Representative Burke noted that incorporating federal data would be difficult because comparable state-level data would be lacking. The committee then moved and approved the amended study language, with a technical correction changing “early release” to “placement authority.” The motion passed 8-0. The committee later took up further amendments to engrossed Senate Bill 2015, approved those amendments 8-0, and then passed engrossed Senate Bill 2015 as amended on an 8-0 roll call. Members briefly discussed a minimum security facility planning number, confirming the pad/landing number at 20, and the chair said the bill would be sent to Legislative Council for final drafting and could be ready as soon as the next day.

Summary: The Senate convened on the final day of session, heard an invocation, recognized guests and pages, and outlined a tentative plan for multiple sessions and breaks through the day. The chamber then took up several messages between the Senate and House, including a refusal to concur in House amendments to Senate Bill 311 on the Blueprint for Maryland’s Future and the appointment of conferees, as well as a House message on House Bill 9007 establishing a conference committee on third-degree assault. The Senate also considered a series of second-reader bills. House Bill 6, requiring MHEC to collect data on pregnant and parenting students, was amended to exempt Maryland Global Campus and limit certain provisions to public senior higher education institutions and community colleges before being ordered to third reading. House Bill 182, concerning replacement of faithless electors, was amended to conform with Senate Bill 237 and then passed. House Bill 575, creating excused absences for student civic engagement, drew the most discussion; senators asked about the definition of civic engagement, county discretion, and whether students could use the bill for repeated protests. The floor leader explained that county boards would retain discretion and that the bill would not require weekly absences. The bill’s two amendments were adopted and it was sent to third reading. Additional measures passed with little or no opposition. House Bill 640 revised boards, commissions, and reporting requirements; House Bill 1335 required an independent study of IT and cybersecurity staffing and pay; House Bill 587 created a work group to review transportation procurement procedures; House Bill 854 established a nonpublic special education school renovation program; and House Bill 898 adjusted economic development provisions, including VLT proceeds and film tax credit language, after questions about the general fund impact. The Senate also advanced House Bill 1247 on Prince George’s County tax increment financing for an immersive entertainment venue, with amendments making it an emergency bill and addressing zoning and outdoor advertising issues.

Summary: The committee first adopted amendment 2026-2021S to correct a drafting issue in the budget language so that the $2.5 million appropriation for Medicaid per diem rate stabilization at county nursing homes can be spent during the biennium rather than lapsing at the end of the fiscal year. Senator Lang explained that the funds are matched with federal dollars for a total of $5 million and are intended to prevent rate reductions that could shift costs to county property taxpayers. The amendment was adopted unanimously by both chambers, and the committee proceeded on the bill as amended by the Senate. The main discussion then focused on HB 155 and a proposed amendment to the business enterprise tax. The House proposal would lower the BET rate in stages when combined business tax revenues exceed certain thresholds, while the Senate opposed an immediate rate reduction and argued that tax changes should be handled in a budget year. Senators emphasized that raising the filing threshold to $375,000 had already removed about 3,500 small businesses from filing requirements, and they preferred further relief through threshold changes rather than rate cuts. House members argued that the trigger-based reduction was a reasonable, tested mechanism and would provide future tax relief without taking effect unless revenues rose enough. Members debated whether the trigger could be distorted by one-time revenue spikes, such as the recent tax amnesty receipts and prior federal repatriation-related revenue, and Representative Sweeney said he was willing to adjust the effective date or carve out amnesty revenue. The committee did not reach agreement on the BET reduction, and the chair called a break and then continued the meeting later with a new proposal to delay the trigger’s effective date to January 1, 2028. Senator Lang rejected that version but offered a counterproposal to raise the filing threshold to $400,000, and the parties ultimately agreed to continue discussions and reconvene later. The meeting also took up HB 1102, concerning the research and development tax credit and state park fees. The House position was to support the R&D tax credit but remove the park-fee provisions, citing testimony from the Department of Natural and Cultural Resources that it did not need the increase and concerns about discouraging tourism, especially at border parks. Supporters of the park-fee language argued that the department had not raised rates in years, could set its own rates, and should be able to charge nonresidents more while keeping New Hampshire residents’ fees lower. The discussion remained unresolved, with members debating the likely effect on tourism and fairness to residents versus the need for additional revenue.

Local Government (Part II) May 15th, 2025

Local Government

Summary: The Senate Committee on Local Government met with a quorum and took up a series of pending bills, mostly local-government measures. Early action included final committee approval of Senate Bill 1633 and S.J.R. 60, followed by Senate Bill 3038 and Senate Bill 3045, both reported favorably and placed on the local and uncontested calendar. The committee also considered House Bill 24, adopted a committee substitute, and reported the substitute version favorably; House Bill 2025 was likewise reported favorably and sent to the local and uncontested calendar. Members then handled several companion and local bills, including House Bill 2713 as the companion to Senate Bill 1331, which was reported favorably and placed on the local and uncontested calendar. House Bill 3348, House Bill 3370, House Bill 3505, and House Bill 4506 were each reported favorably, with no objections to local-and-uncontested placement. House Bill 5424 passed on a 6-1 vote, and House Bill 5652 passed with one present-not-voting, both also sent to the local and uncontested calendar. The committee also adopted substitutes and reported House Bill 3687 and House Bill 4205, though both were later reconsidered because the wrong script had been read. After reconsideration, House Bill 3687 and House Bill 4205 were each re-voted and reported favorably to the full Senate, with both placed on the local and uncontested calendar. Senate Bill 3071 was also reported out on a 5-2 vote after adoption of a committee substitute. The meeting ended with no further business and the committee standing at recess subject to the call of the chair.

Summary: The meeting began with unanimous committee approval of amendment 2026-2021S to HB 2. Senator Lang explained the amendment corrected a drafting error so that $2.5 million in state funds, matched with federal money for a total of $5 million, could be spent during the biennium rather than lapse at the end of the fiscal year. The money is intended to stabilize Medicaid per diem rates for county nursing homes, and members agreed without objection to adopt the amendment and continue working from the bill as amended by the Senate. The committee then discussed HB 155 and a proposed amendment, 2026-201H, dealing with the business enterprise tax. The House side described the proposal as a compromise that would raise the filing threshold from $250,000 to $375,000 and create a trigger that would reduce the BET rate by 0.05% for each $100 million in combined business tax surplus, down to a floor of 0.25%. Senate members opposed lowering the rate at this time, arguing that tax relief should focus on the filing threshold, which they said would remove filing burdens for about 3,500 small businesses, and that rate cuts should be considered in a budget cycle rather than an off-year. Concerns were raised that one-time revenues, such as tax amnesty receipts or federal repatriation-related surpluses, could unintentionally trigger reductions. Representative Sweeney later offered a revised approach by moving the effective date of the trigger mechanism to January 1, 2028, and said he was also willing to carve out tax amnesty revenues or adjust the effective date to avoid using one-time funds. The Senate remained unwilling to agree to a rate reduction, though it expressed openness to raising the filing threshold further. The committee ultimately did not resolve the business tax issue and recessed to continue discussions at a later time. The final item discussed was HB 1102, concerning an increase in the research and development tax credit paired with changes to state park fees. House members supported the R&D credit increase but opposed tying it to higher park fees, citing concerns about tourism, especially at border parks, and noting that the Department of Natural and Cultural Resources had said it did not need the increase. Senate members defended the park fee changes as a fairness issue, arguing that New Hampshire residents should pay less than out-of-state visitors and that the department had not raised rates in many years. No vote was taken on this item during the discussion captured here.

Summary: Assembly Budget Subcommittee No. 6 heard the Governor’s May Revision proposals for the judicial branch, the Board of State and Community Corrections, the Department of Justice, and the California Department of Corrections and Rehabilitation. The Legislative Analyst’s Office opened with a warning that the state budget remains structurally imbalanced and urged the Legislature to avoid new ongoing spending unless offset by reductions elsewhere. In the judicial branch discussion, the Judicial Council highlighted language access funding, appellate court security, a backfill for the state court facilities construction fund, and an extension of the lactation room mandate; Finance supported most items but suggested reporting language on interpreter costs and reducing the General Fund backfill. Members raised concerns about judicial vacancies, long-term salary freezes, remote hearings, and the lack of progress on court staffing in some counties. For the Board of State and Community Corrections, the administration proposed $10 million one-time each for the Missing and Murdered Indigenous People grant program and a human trafficking vertical prosecution grant program. The LAO said both should be weighed against other priorities and suggested the Legislature consider whether the Tribal Nations Grant Fund could support MMIP work, while Finance said it preferred General Fund support and wanted more review before any fund swap. Members strongly supported MMIP funding and asked whether ongoing support would be considered. On the human trafficking grant, Finance said BSC was a good fit because of its grant administration experience and prior vertical prosecution work, while legislators asked why the program was not placed with the Office of Emergency Services as originally contemplated in prior legislation. The Department of Justice presented antitrust litigation funding, Medi-Cal Fraud and Elder Abuse staffing, completion of organized retail criminal enterprise cases, and trailer bill language for a continuous appropriation from the Victims of Consumer Fraud Restitution Fund. The LAO supported the antitrust account use but questioned the Unfair Competition Law Fund’s ability to cover the full request without General Fund repayment, and recommended against a continuous appropriation for the restitution fund in favor of a more limited mechanism with legislative oversight. Finance said the fund would remain solvent and defended the continuous appropriation as necessary to pay victims promptly. In the CDCR portion, the largest discussion centered on the Boston Consulting Group efficiency review and sharply reduced savings estimates; LAO said the department had not fully explained the proposed position eliminations or future $100 million savings target, while Finance said the work reflected deeper analysis and ongoing efforts to find savings. Members repeatedly pressed CDCR and Finance on the gap between earlier promised savings and the revised figures. CDCR also outlined population projections showing continued declines in prison and parole populations, while LAO again urged the state to close an additional prison to save ongoing costs. The department then walked through several May Revision items, including workers’ compensation funding, a Corcoran honor housing dorm, incarcerated firefighter pay implementation, an incarcerated menopause program, mental health receiver staffing, mental health resource teams and crisis intervention teams, medical classification staffing changes, and AI note-taking for the electronic health record. LAO generally recommended limiting-term funding and more reporting for many of these proposals, while Finance defended them as necessary ongoing investments or court-ordered obligations. Members questioned the cost of workers’ compensation, the need for more prison closures, the lack of funding for women’s facility violence prevention, and the timing and transparency of the BCG savings process. No votes were taken.
