Joint Committee on Dedicated Funds (05/21/2025)
Transcript Highlights:

Summary:
The Joint Committee on Dedicated Funds met to review the House budget provision that would impose a 5% administrative charge on a broad list of dedicated funds, with some exemptions. Members discussed the House approach versus the Senate’s more general approach of leaving the governor discretion over which funds could be charged. The chair explained the committee was hearing from agencies about any legal, contractual, or practical reasons their funds should be exempt, and the agenda was expanded to include several departments and written submissions from others.
The Department of Education testified first, identifying several funds it said should be exempt: a printing revolving fund that is funded by transfers rather than fees; teacher certification, which is self-funded by educator licensing fees and would require an immediate fee increase if charged; a vending stand set-aside tied to the federal Randolph-Sheppard program and subject to federal approval and vendor committee procedures; and a public school infrastructure/safety account, where most revenue is transferred from the education trust fund or general fund rather than generated by fees. Members questioned the department about the effect on school safety projects and whether the fee would simply reduce the number of projects completed each year.
The Veterans Home asked for exemptions for three funds: a donation benefit account used for recreational activities and quality-of-life expenses for residents, a small memorial trust fund whose interest supports veteran activities, and a resident member account that holds veterans’ personal income such as Social Security and pensions. The department argued the charge would reduce donations, cut services, and effectively function like an income tax on vulnerable veterans. The Banking Department also requested exemption for its consumer credit administration license fund, saying it is used to keep exam fees low and is expressly intended by statute to reduce costs on regulated businesses; it said the 5% charge would undermine that framework and could eventually force higher fees.
The Department of Justice began testimony on its dedicated funds, starting with the medical legal investigative fund, which pays for death investigations and related services under statute and without general fund support. No votes or final actions were taken in the portion of the meeting provided; the committee mainly heard testimony and asked questions about the practical and legal effects of applying the administrative charge.

Summary:
The committee heard House Bill 4961, which would bar uninsured motorists from recovering non-economic damages after a collision. The author said the bill is intended to create incentives to maintain insurance and to address what he described as an unfair system for insured drivers. Texans for Lawsuit Reform and Texas Eagle Forum testified in support, while the Texas Trial Lawyers Association opposed it, warning the bill could also affect pedestrians, passengers, children, and others who did not choose whether a vehicle was insured. The bill author clarified that passengers would be included in the bill’s coverage. No vote was taken and the bill was left pending.
House Bill 5570 would extend a legislative attorney CLE exemption to attorneys appointed by the governor and confirmed by the Senate to boards or commissions. The author said the measure is meant to ease time burdens and encourage service, and a witness supported it as a modest incentive for public service. A committee member noted a discrepancy in the number of affected attorneys, and the author agreed to verify the correct figure. The bill was left pending.
The committee also heard House Bill 2969, which would restrict the State Bar from adopting rules or penalties that unreasonably burden attorneys’ religious exercise or free speech based on sincerely held beliefs. The author and several witnesses from Texas Values, Alliance Defending Freedom, and Cecilia Wood argued the bill protects lawyers of faith from an ABA model rule they described as a speech code. No one testified against the bill, and it was left pending. House Bill 4260, which would prohibit county judges and county commissioners from practicing law in courts over which they have jurisdiction, drew opposition from the County Judges and Commissioners Association, which argued existing ethics rules already address conflicts and that the bill would burden rural officials. The author said the bill was prompted by concerns about judges using their office to pressure others. The bill was left pending.
House Bill 5134 would limit Rule 202 pre-suit depositions to people who have suffered or reasonably expect actual damages and would allow attorney’s fees against abusive petitioners. The author said the bill is aimed at preventing harassment and fishing expeditions, especially in family-law disputes. Questions focused on how the standard would work and how it differs from current law; the author said the main change is fee-shifting and a clearer legislative directive. The bill was left pending. House Bill 3095, a committee substitute version of a similar uninsured-motorist bill, would bar uninsured motorists from recovering non-economic damages and limit economic recovery, with several exceptions. Trial lawyers argued it was unconstitutional because it capped economic damages and could unfairly affect innocent drivers, pedestrians, and older people who no longer drive. The author acknowledged constitutional concerns and said the bill would need further work; the committee withdrew the substitute and left the bill pending.
Finally, House Bill 4388 would require all judges, including county judges who perform administrative duties, to remain subject to the Code of Judicial Conduct. Supporters said some elected judges avoid accountability by relinquishing judicial functions, while opponents argued the bill is too rigid and unnecessary because existing remedies already exist. House Bill 3964 would limit public nuisance claims to their historical role and bar such claims against lawful conduct, conduct already covered by other remedies, and products. The author and supporters said the bill is meant to prevent courts from using public nuisance to make policy, while opponents argued it would eliminate useful remedies and could affect local actions against environmental or product-related harms. The author said the bill would not affect statutory nuisance claims, private nuisance claims, or other causes of action, and would be amended to clarify some provisions. The bill was left pending.

Summary:
The joint informational briefing focused on restricted use pesticides in Hawaiʻi, with Senate and House members opening the meeting and explaining that the session was intended to hear expert presentations and community concerns. Fern Holland outlined the background for the briefing, describing how restricted use pesticides differ from general-use products, why state-level regulation matters, and how community advocates have sought disclosure and protections for years. She summarized 2019 reporting data, saying a small number of users accounted for most reported use, with especially heavy application in North Central Oʻahu and on the west side of Kauaʻi. She highlighted concerns about applications near schools, homes, and coastlines, and identified 1,3-dichloropropene and metam sodium as among the heaviest-used fumigants. She also noted concerns about highly hazardous pesticides, some banned in other countries, and the lack of research on long-term combined exposure to multiple pesticides.
Greg Takashima of the Hawaiʻi Department of Agriculture described the department’s pesticide program and regulatory authority under FIFRA and state law. He explained the distinction between general-use and restricted use pesticides, the certification requirements for applicators, and the department’s role in tracking RUPs from sale through use. He reviewed the branch’s functions in enforcement, education and certification, registration and technical review, and laboratory analysis, including inspections, complaint response, market surveillance, product registration, groundwater review, and outreach on drift reduction and integrated pest management. He also noted staffing and funding limitations, saying the branch lacks a toxicologist and long-term monitoring capacity, and compared Hawaiʻi’s resources to California’s much larger pesticide regulatory program. Takashima thanked the legislature for passing Act 231 the prior year and said the department supports the measure as it moves forward this session.
Dr. Lee, speaking for the Hawaiʻi chapter of the American Academy of Pediatrics and as a former member of the Kauaʻi Joint Fact-Finding Task Force, said pediatric guidance has shifted from focusing on acute poisoning to recognizing chronic low-level pesticide exposure as a concern. He cited AAP publications linking pesticide exposure to cancer, brain tumors, leukemia, birth outcomes, neurobehavioral effects, and asthma, and said pediatricians are now encouraged to advise families on reducing exposure and to support right-to-know measures and buffer zones around schools and public gathering places. He also described the Kauaʻi task force’s work, saying it found the west side of the island to be an unhealthy community but could not prove causation because of missing drift, geospatial, and biomarker data. No votes were taken; the meeting was informational, questions were held until after presentations, and the department expressed support for Act 231.

Summary:
The Senate Committee on Education K-16 convened with a quorum, adopted its committee rules, and heard opening remarks from members introducing staff and outlining priorities for the session. Several senators emphasized support for public education, teacher pay and safety, parental choice, and the combined K-16 jurisdiction of the committee. The chair also reviewed hearing procedures, including public testimony registration and time limits.
The main item was Senate Bill 2, the Texas Education Freedom Act, laid out by Chairman Creighton. He described the bill as an education savings account program intended to expand school choice, with a $200 million universal eligibility pool and an additional $800 million targeted to students with disabilities and lower-income families. He said the bill includes anti-fraud safeguards, criminal background checks for vendors, reporting requirements, data protections, and annual testing for participating students, while not imposing STAAR on private schools or homeschoolers. He also said the bill removes a prior hold-harmless provision for public schools and is separate from public school funding and teacher pay legislation.
Members questioned the bill’s income threshold, lottery and priority structure, treatment of homeschoolers, microschools, charter schools, religious freedom protections, citizenship/lawful presence language, cybersecurity, open records, and disability-related issues, including whether 504 students and foster children should be included. Creighton said the bill is designed to prioritize former public school students with disabilities or lower incomes, while also allowing universal eligibility within the program’s first funding tier, and that the Comptroller would oversee vendor screening and cybersecurity rules. He said the bill does not direct curriculum or interfere with religious beliefs and that amendments may be offered later on citizenship and other issues. After member questions, the committee began invited testimony, starting with EdChoice representative Robert Inlow, who testified in support of SB 2 and cited national growth in school choice programs and studies he said show positive effects for students and public schools.

Summary:
The meeting included a Senate recognition ceremony honoring the Winona High School boys basketball team for winning the 2026 Alabama High School Athletic Association 5A state championship. A resolution was read commending the team for its 101-40 victory over Silicag, noting the team’s record-setting performance, Brendan Davis’s MVP honor, the contributions of other players, and Coach Cedric Lane’s leadership. Senators and the lieutenant governor praised the players’ sportsmanship, the school community, and the team’s historic season, and copies of the resolution were presented to the team, coaches, and administrators. Several guests and school representatives also spoke briefly, including the coach and principal, who thanked the Senate and noted the team’s success and the principal’s retirement after 35 years.
After the recognition, the Senate returned to session and adopted the Committee on Rules report setting the special order calendar. The calendar included Senate Bill 99 on the Ten Commandments, Senate Bill 298 on Class 3 municipalities, House Bill 381 on camp safety, Senate Bill 370 on tax increment districts, Senate Bill 363 on the Department of Economic and Community Affairs, House Bill 466 on firefighters, House Bill 95 on elections, House Bill 259 on stablecoin, and Senate Bill 342 on education.
The chamber then took up SB 99, sponsored by Senators Kelly and Sessions. Senator Kelly described the bill as requiring local school boards to display the Ten Commandments, together with founding documents such as the Declaration of Independence, Constitution, Bill of Rights, and Alabama Constitution preamble, in certain history classrooms and common areas for grades five through 12, using donated displays and funds when available. He said the bill was intended as a historical and educational measure, not religious instruction, and emphasized the inclusion of a disclaimer stating Alabama is not establishing a religion. After extended debate and a petition to close debate from the Rules Committee, the Senate voted on the bill by long roll and passed SB 99, with the recorded vote announced as 30 yeas and 4 nays.

Summary:
The subcommittee began its first meeting on retained education funding bills, focusing on HB 366, which concerns school building aid for eligible projects, and HB 295, which would make school building aid program funds non-lapsing. The chair framed the discussion around broader questions about how school building aid should work, noting the state’s limited available funding, the existing debt service obligations, and whether the current formula should continue or be changed. He also raised concerns about the state’s overall revenue constraints and the need to consider renovation, new construction, and possibly leasing within any future program.
Members and the Department of Education representative discussed whether school building aid is a state or local responsibility, the current backlog of projects, and the condition of school facilities statewide. Tim Carney of the Bureau of School Facilities described his background and answered technical questions about current programs. Representative Luno argued that under the ConVal decision the state has responsibility for school buildings, including construction and renovation, and that the program also serves an equity function by helping districts with less property-tax capacity. Representative Papich urged the committee to focus on policy structure and fairness rather than just available dollars, saying the current system creates winners and losers and suggesting a simpler per-capita or similar allocation model, while acknowledging a possible transition for projects already in the pipeline.
The discussion also covered CTE facilities and leasing. Carney explained that charter schools, and possibly CTE centers, can receive limited leasing aid, and that CTE capital requests are funded through a state capital process, while federal Carl Perkins funds cannot be used for construction. He and others described a separate rotational funding approach for CTE centers, but several members said that model can leave programs waiting too long and may not match changing workforce needs. The chair and others noted that a report from a related study group on CTE policy and funding was still pending, and that its absence could affect legislation for FY28. No votes were taken and no bill was acted on in the portion of the meeting provided; the discussion ended with interest in modeling alternatives, reviewing the waiting list, and examining the tradeoffs of reducing upfront state aid versus funding more projects overall.

Summary:
The committee heard testimony on several bills affecting civil practice, judicial conduct, and attorney regulation. HB 4961 and the similar HB 3095 would bar uninsured motorists from recovering non-economic damages after a collision, with HB 3095 also addressing certain exceptions and limiting economic damages in some cases. Supporters said the measures would encourage insurance coverage and fairness for insured drivers, while opponents argued they would unfairly punish injured people who were not responsible for the lack of insurance, including pedestrians, passengers, children, and others. HB 3095 drew constitutional concerns from witnesses, and the committee later withdrew the committee substitute and left the bill pending; HB 4961 was also left pending after questions about its scope, including passengers.
HB 5570 would expand a continuing legal education exemption to attorneys appointed by the governor and confirmed by the Senate who serve on boards or commissions. The author and witness said the bill would free up time for public service while still requiring ethics training. A committee member raised a discrepancy in the number of attorneys covered, and the bill was left pending. HB 2969 would prohibit the State Bar from adopting rules or penalties that unreasonably burden attorneys’ religious exercise or free speech, especially in relation to sincerely held religious beliefs. Supporters framed it as a protection for lawyers of faith against an ABA-style speech code, while no one testified in opposition; the bill was left pending.
HB 4260 would prohibit county judges and county commissioners from practicing law in courts over which they have jurisdiction. The author described it as an ethics measure to avoid conflicts of interest, but county officials and the County Judges and Commissioners Association opposed it, saying existing ethics rules already address conflicts and that the bill would impose hardships, especially in rural counties. The bill was left pending. HB 4388 would require all judges, including those who serve only in administrative roles, to remain subject to the Code of Judicial Conduct; supporters said some judges avoid discipline by relinquishing judicial functions, while opponents said the bill was unnecessary and could burden county judges who serve as administrators. It was also left pending.
The committee also heard HB 5134, which would limit Rule 202 pre-suit depositions to people who have suffered or reasonably expect to suffer actual damages and allow attorney’s fees against abusive petitioners. The author said the bill would curb harassment and fishing expeditions, but members questioned how the standard would work in practice; the bill was left pending. Finally, HB 3964 would narrow common-law public nuisance claims by barring suits over lawful conduct, conduct already addressed by other remedies, and products, while preserving other causes of action. Supporters said the bill would prevent regulation through litigation and protect legislative authority; opponents said it would eliminate important remedies and that no Texas abuse had been shown. The author indicated he would revise the bill, and it was left pending.

Summary:
The Senate Committee on Education K-16 convened with a quorum, adopted its committee rules, and heard opening remarks from members introducing staff and outlining priorities for the session. Members from both parties emphasized education as a major issue, while several Republicans framed the committee’s work around school choice and parent empowerment. Senator West and other Democrats stressed protecting public schools, listening to Texans, and considering the effects of vouchers or education savings accounts on school districts and communities.
Chairman Creighton laid out Senate Bill 2, the Texas Education Freedom Act, describing it as a universal education savings account program modeled on similar programs in other states. He said the bill would provide about $200 million for a universal eligibility pool and additional funding for students with disabilities and lower-income families, with priority weighting for former public school students. He also highlighted anti-fraud measures, vendor pre-approval, criminal background checks, cybersecurity protections, annual testing requirements for participating students, and the use of the Comptroller rather than TEA to administer the program. Creighton repeatedly said the bill is not a voucher and argued it would not take money from public schools, which he said would receive separate historic funding increases.
Members questioned Creighton about the 500% of federal poverty line definition, the adequacy of the $10,000 ESA amount, whether the program would favor students already in private school, how microschools and homeschool pods would fit, and whether the bill protects religious liberty and private-school autonomy. Democrats raised concerns about disability protections, 504 students, foster children, public-school funding, open records, and the historical context of vouchers. Republicans generally supported the bill as a way to expand options for parents and students, while also asking about administration, fraud prevention, and data security. After member questions, the committee began invited testimony, with EdChoice President Robert Inlow presenting in support of SB 2 and citing the growth and reported success of school choice programs nationwide.

Summary:
The committee first approved the January 21st minutes by voice vote. Members then resumed a school finance overview focused on how Minnesota’s “base” budgeting system works and how future committee targets are set above or below that base by the Ways and Means chair, in consultation with fiscal staff. Staff emphasized that school funding decisions are tied to the state budget base and that changes made by the tax committee can affect school levies and school finance more broadly.
The presentation then turned to property tax fundamentals. Staff explained that roughly 65% of school district revenue comes from state aid and about 20% from property taxes, with property tax revenue applying to school districts rather than charter schools. They reviewed the two main school tax bases—referendum market value and adjusted net tax capacity—along with class rates, sales ratios, and equalization. They also described tax credits, especially the school building bond agricultural credit, which helps reduce the property tax burden on agricultural land in Greater Minnesota.
Members discussed student choice programs and how funding follows students. In response to questions from Representative Quam, staff explained postsecondary enrollment options (including direct enrollment and College in the Schools) and online learning, noting that funding generally follows the student to the serving institution or district. Staff also reviewed Minnesota’s pupil-counting system, including average daily membership and pupil weighting, and explained that students attending charter schools, other districts through open enrollment, or online programs are counted where they are served.
The presentation concluded with broader school finance context: funding sources, equity and adequacy goals, constitutional and statutory authority, and the state’s school data systems (EUP/FARS, MARS, and STARS). Staff also began reviewing long-term enrollment trends, noting the impact of the baby boom, later growth from the mid-1980s through about 2000, and projected modest declines in public school enrollment through 2029.
