Summary: The Judiciary Committee first took up decision-making on two judicial nominations heard the previous day. Governor’s Message 796, naming Annalisa En Bernard Lee as Circuit Court Judge for the Second Circuit (Maui County), and Governor’s Message 797, naming Michael K. Soong as Circuit Court Judge for the Fifth Circuit (Kauai), were both recommended for consent and adopted by unanimous roll-call votes. The committee then heard testimony on Governor’s Message 801, the nomination of Vladimir P. Devens as Chief Justice of the Hawaii State Supreme Court. Support came from the Governor’s office, Honolulu Prosecutor Steve Alm, Honolulu Managing Director Michael Formby, the Hawaii Association for Justice, United Public Workers, HGEA/AFL-CIO, the Hawaii Filipino Lawyers Association, labor and trade unions, retired Chief Justice Mark Recktenwald, retired judges, bar and court officials, and many other individuals and organizations. Supporters emphasized Devens’ legal experience, work ethic, labor-law background, community ties, mentorship, and ability to manage the judiciary and address the appellate backlog. A few speakers opposed the nomination, including Chuck Freedman, who raised concerns about union influence and potential conflicts, and others who submitted opposition testimony. Devens also testified, describing his Honolulu upbringing, education at UC Berkeley, six years with the police department, and more than 30 years in private practice before joining the Supreme Court. He said the chief justice role is primarily an administrative one, highlighted his experience with bar and judicial administration committees, and identified reducing the appellate backlog as a major priority. No vote was taken on GM 801 during this portion of the hearing.

Summary: The commission to study the cost of special education met, confirmed a quorum, introduced members and guests, and approved the minutes from the October 29 meeting. Members noted the commission’s mandate under Senate Bill 57 and emphasized the need to focus on recommendations and findings by July 1, 2026. The chair also distributed additional handouts, including materials related to the Education Freedom Account (EFA) program and administrative rules tied to differentiated aid and disability determinations. The main discussion centered on how students qualify for differentiated aid under the EFA program. Matt Sutherton of the Children’s Scholarship Fund explained that the organization, which contracts with the state to administer EFAs, accepts either school-district/IEP documentation or a medical certification of disability (MCD) from a licensed medical professional. Members questioned how this process relates to the state’s special education rules and whether the school-district examiner standards in ED 107/1107.04 apply to EFAs. Sutherton said the MCD form, created with the department, requires the medical professional to sign that they are qualified to make the determination and to identify the disability. Several members expressed concern that the EFA process is less rigorous than the school-district IEP process and may be inflating disability counts. One member argued that the administrative rules cited are primarily for school districts, not EFAs, and said the Department of Education may not know how many of the roughly 890 EFA students receiving differentiated aid came through school-district documentation versus the MCD pathway. Another member said the EFA system appears more generous than the school system and raised concerns about oversight, auditing, and whether the program’s data are accurate. Sutherton said the organization reviews signed documentation, credentials, and diagnosis information, and may request additional records to help adjudicate expenses. No votes or formal actions were taken beyond approving the prior minutes.

Summary: The committee began a work session on House Bill 1600, concerning access to the centralized voter registration database on election days. Secretary of State David Scanlan testified that the state already has a new statewide voter registration system connected to town clerks and supervisors of the checklist, and that the bill was probably unnecessary but acceptable if the legislature wanted it. He raised concern about language that could require direct electronic access in every polling place, noting that some polling locations lack reliable internet or cell service and that municipalities can change polling locations, which could make a rigid requirement expensive and impractical. Members discussed whether the bill should be clarified to allow direct or indirect access, including use of a phone-based workaround, and the secretary said that would address his concern. The committee then voted on HB 1600. Representative Maguire moved ought to pass with an amendment adding “direct or indirect access” on page one, line seven, and the motion was seconded. The amendment was adopted 9-0 by voice vote, and the committee then voted 9-0 to OTP the bill. The chair stated that HB 1600 would be placed on consent. The committee next took up House Bill 1197F FN, a technical correction to insurance laws. Members noted it had already passed the House with amendment and that the fiscal note was effectively indeterminate but would not affect the general fund because the insurance agency is self-funded. The committee voted 9-0 to OTP the bill; the chair said consent calendar placement would be decided by the full committee. Finally, the committee opened a work session on House Bill 11:30 FN regarding judicial performance evaluations. Representative Lynn, the bill’s sponsor, argued that the fiscal note overstated the immediate cost and said the judicial branch could likely manage through the current biennium while implementing the new system. He also supported making judges’ names public and said the bill’s anonymity provisions were aimed at protecting the identities of questionnaire respondents, not the judges being evaluated. Members asked about public disclosure, internal access to evaluation materials, and the removal of language allowing the governor and executive council to receive evaluations on request; discussion continued on those points, but no final vote on HB 11:30 FN was taken in the portion provided.

Summary: The committee first took up a liquor-related amendment correcting an earlier drafting error that had accidentally removed enhanced penalties for death-related over-service from the statute. Members explained that the language had already been enacted briefly before being deleted by mistake, and the amendment simply restored the prior penalty provisions. The committee voted unanimously in favor. A second liquor amendment followed, concerning VFW and similar veterans’ clubs. The revised language would allow a veteran or member to sign in a limited number of under-21 guests, with testimony emphasizing that this was meant for small events and would mirror existing restaurant rules requiring a parent, legal guardian, or adult spouse. There was extended debate about whether private clubs were sufficiently public, whether towns could tighten liquor rules locally, and whether enforcement would be effective. Liquor enforcement testified that municipalities must approve licenses, only four minors could be signed in at once under a member’s signature, age-restriction signage remains required, and clubs often report violations themselves to protect their licenses. The amendment was ultimately approved unanimously, and the subcommittee then moved into executive session. In executive session, HB 186, relating to cannabis legalization, regulation, and appropriations, was recommended ought to pass on a 10-7 vote, with a minority report noted. HB 241, relating to treatment alternatives to opioids, was then supported with amendment 2990 and recommended ought to pass as amended; the bill was described as expanding access to non-opioid, non-surgical, and non-medication pain treatments, while the amendment clarified Insurance Department procedures and educational materials. That bill was placed on the consent calendar unanimously. HB 297, concerning access by self-funded employer health plans to claims data, was also recommended ought to pass with amendment 2987 and then ought to pass as amended unanimously; supporters said it would let employers opt in to deidentified claims data, improve transparency, and preserve privacy. It too was placed on the consent calendar unanimously. The committee then considered HB 312, dealing with student-athlete name, image, and likeness compensation, and voted to send it to interim study. Members said the issue remained too uncertain because of ongoing federal and NCAA developments, and that interim study would keep the committee’s options open without killing the bill. The motion was supported as a way to continue monitoring the issue for future action.

Summary: The committee first took up HB 129, which would redefine “evidence-based” in public education. The Department of Education testified that the bill’s definition would conflict with federal definitions and be very restrictive, potentially affecting a wide range of instructional methods, curriculum materials, teacher training, civics requirements, suicide prevention training, and other programs. The department said the bill could force a broad overhaul of school practices, create local implementation burdens, and require at least one new state position, with a fiscal note estimating roughly $118,000 in FY 2026 rising in later years. Members also raised concerns about possible impacts on federal pass-through funding and whether the bill was workable. Representative Papovich moved to retain HB 129, and the motion passed 7-0. The committee then heard HB 133, a Department of Safety/DMV bill involving follow-up when a person votes using an out-of-state license or non-driver ID and then does not obtain a New Hampshire credential within the statutory timeframe. DMV officials said the bill would require a $40,000 technology upgrade plus a new full-time position, and that the fiscal note did not include postage or fully account for the manual work needed to match records, send notices, and review responses. They said the proposal also raised broader tracking issues because it would apply not only to voters but to anyone who had not obtained a New Hampshire license within 60 days, and they questioned whether DMV was the proper agency to make those inquiries. Committee members pressed the department on how the 60-day clock would be determined, whether the bill could amount to a kind of poll tax or raise privacy concerns, and whether voter ID cards or other exceptions would avoid that problem. The department explained that New Hampshire offers a free voter identification card through town clerks for people without a license or state ID, but said the bill did not exempt those cards and that the DMV would still be asked to investigate status after voting. Officials also said the bill would be difficult to enforce, that some cases would be ambiguous, and that any response from the DMV would likely amount to a request for information rather than an enforceable consequence. No vote on HB 133 was taken in the portion provided.
