Committee:
House Human Services & Homelessness
Summary:
The committee heard testimony on HB 963, which would make crimes against elders age 60 and over strict liability offenses by removing the requirement that the perpetrator knew or should have known the victim’s age. The Office of the Public Defender opposed the bill, arguing that removing the state-of-mind element would create unfair and subjective results and suggesting sentencing enhancements or broader vulnerability-based language instead. Supporters, including Sandy Wong and another testifier with elder-abuse experience, said the current knowledge requirement creates a loophole that lets offenders avoid the elder enhancement even when they target vulnerable older adults. No vote was taken on the measure in the portion provided.
The committee also heard HB 384, which increases penalties for promoting minor-produced sexual images, extends probation terms for felony obscenity offenses, tolls the statute of limitations during a victim’s minority, and requires sex offender registration for certain felony obscenity offenses involving minors. The Public Defender opposed the bill as overly broad and warned of absurd results, while the Department of the Prosecuting Attorney supported it, saying the bill addresses sextortion and other exploitation cases where adults solicit images from minors and that the 3-year age-gap threshold preserves ordinary teen relationships. Committee members questioned whether the bill was aimed at adults only and whether the age-gap carveout was narrow enough; the prosecutor said it was intended to cover adult predators and not consensual peer conduct. No final action was reported.
HB 1100, which renames the Neighbor Islands Blind and Visually Impaired Service Pilot Program to use “low vision” instead of “visually impaired,” was supported by the Department of Human Services and disability advocates, who said the current term is derogatory and that the change responds to the blind community. The department said it was beginning work on administrative rules and expected to seek an appropriation, with implementation hoped for in 2026. The committee then heard HB 1283, exempting paternity proceedings from mediation when domestic abuse is alleged; the Hawaii State Coalition Against Domestic Violence and others supported it as consistent with divorce law and important for survivor safety. HB 689, creating safe harbor protections for survivors of sexual exploitation who seek medical or law enforcement help, drew support from HPD, Emua Alliance, the Judiciary, and others, who said it would prevent traffickers from using prostitution charges to silence victims. Finally, HB 383, reinstating mandatory minimum jail terms for successive violations of protective orders and removing the court’s ability to suspend those minimums, drew opposition from the Public Defender, who said some repeat violations stem from mental health or substance use issues, and support from the Prosecuting Attorney, who argued the bill treats protective orders like temporary restraining orders and preserves judicial discretion within a misdemeanor framework.

Summary:
The committee began by announcing that afternoon hearings, including House Bill 283, would be moved to Representatives Hall because of expected public interest. It then took up House Bill 671, which would establish a kindergarten literacy readiness program. The bill’s sponsor, Rep. Mark Pearson, described the measure as a way to close gaps in early reading readiness and said it was intended as a first step, with only a placeholder appropriation while details are developed. He framed it as a targeted effort to help children who are not entering first grade ready to read.
Testimony on HB 671 was largely supportive. Representatives asked about the bill’s structure, whether a specific program had been identified, how it would interact with play-based learning, and why the provider was limited to a registered nonprofit. Waterford.org representatives Teresa Rosenberger and Rob Riley testified in support, describing Waterford Upstart as a home-based, evidence-based early learning program already used in New Hampshire. They said the program provides adaptive instruction, family coaching, and technology support, including computers, tablets, internet access, and translation services in more than 100 languages. They also said the model has been successful in New Hampshire, including a Nashua pilot and later statewide efforts, and that similar legislation has existed in other states. Rep. Jonah Wheeler also spoke in support of the bill. The chair then closed the hearing on HB 671.
After a fiscal note for HB 671 was distributed, the committee moved to House Bill 781, which would require school districts to adopt policies for a cell phone-free education and includes an appropriation. The transcript cuts off as Rep. Litchfield was introduced to testify on that bill, so no testimony, debate, or vote on HB 781 is included in the excerpt.

Summary:
The subcommittee first took up House Bill 525, which would have transferred administration of the program for the deaf and hard of hearing and the related board to OPLC. The chair said the sponsor was no longer interested in moving forward, and Representative Schmidt moved ITL. The motion passed 14-0 with two members absent, and the bill was placed on the consent calendar.
The committee then considered Senate Bill 182 on the maternal mortality review committee. The chair described a narrower amendment that would keep the name change, clarify operations so recommendations are returned to the appropriate entities, and expand contact with family members and close contacts, while dropping a proposed addition of a Department of Corrections member. The amendment was adopted unanimously, and the bill was then moved ITL and placed on the consent calendar.
Senate Bill 185, dealing with OPLC investigations and backlog reduction, received an update from OPLC General Counsel Nicholas Fry. He described efforts to improve public communication, clear the complaint backlog, standardize intake and expert review, add automated responses and website updates, use weekly legal-viability reviews, create preliminary investigation protocols, and establish a process for law-enforcement referrals. Members asked about board involvement and criminal-conviction cases; Fry said boards are kept informed and that such matters can proceed either through complaints or application/background-check processes. Representative Groa requested a follow-up update in January, and the committee agreed to an oral report then if needed. The bill was then voted ITL unanimously and placed on the consent calendar.
Finally, the committee heard House Bill 349 on optometrists performing ophthalmologic laser procedures. Dr. Angelique Sawyer testified in support, saying the amendment adds more specific proctoring and qualification requirements, based on language requested after earlier hearings, and that similar systems exist in other states. Representative Sers confirmed that the new sections were the key additions, while Representative Schmidt said he remained open to the concept but wanted a thorough review and asked about a subcommittee. The discussion was still ongoing when the transcript ended, with no vote recorded on HB 349.

Summary:
The Municipal and County Government Committee held public hearings on House Bill 471 and House Bill 373. HB 471 would create a temporary commission to study growth, traffic, planning, and land use issues in a group of southern New Hampshire towns, with possible recommendations on regional planning commission boundaries or coordination. Representative Perez said the bill was requested by Londonderry residents and local officials, and Eric Power of Brookline testified in support, saying the towns share corridor and development issues that cross regional planning commission lines. Several members questioned whether existing law already allows towns to form regional planning commissions under RSA 364:6, whether the bill should be broader, and whether the town list should include additional communities. The hearing closed with testimony counts reported as two in support and three opposed on remote sign-in, plus one opposed and one in support on the blue sheet.
HB 373, sponsored by Representative Diane Powers, would revise RSA 41:11-a on town property leases. Powers said current law is too restrictive because leases over five years require repeated town votes, which she argued is impractical for long-term arrangements. She cited examples from Hampton and Brookline, including long-term road and property leases, and said she had found multiple similar cases. The bill would keep select board authority for leases under one year, allow a legislative body to authorize a specific longer lease by a three-fifths ballot vote, and preserve the existing five-year blanket leasing authority with a three-fifths vote, while keeping existing leases valid if authority is later rescinded. Eric Power testified in support, describing recurring lease renewals in Brookline and saying longer terms are needed for projects such as housing, cell towers, and solar arrays. Members asked about the change from a simple town vote to a three-fifths threshold and whether the bill duplicates existing mechanisms; Powers said the higher threshold was intended because the leases involve long-term commitments. No votes were taken during the hearing portion described.
