An Act To Amend Section 25-53-5, Mississippi Code Of 1972, To Authorize Statewide Master Agreements; To Authorize Utilization Of Information Technology Acquisitions Made By Other Entities; And For Related Purposes.

An Act To Authorize A Person Who Is The Holder Of A Wine Manufacturer's Permit In This State, Or Who Is Licensed Or Permitted Outside Of The State To Engage In The Activity Of Manufacturing, Supplying, Importing, Distributing, Wholesaling Or Retailing Wine, To Sell And Ship Wine Directly To Residents In This State, If The Person Obtains A Direct Wine Shipper's Permit From The Department Of Revenue; To Provide For The Issuance Of Direct Wine Shipper's Permits; To Require The Holder Of A Direct Wine Shipper's Permit To Keep Certain Records; To Prohibit The Holder Of A Direct Wine Shipper's Permit From Selling Or Shipping Light Wine Or Beer Or Any Alcoholic Beverage Other Than Wine; To Limit The Amount Of Wine That A Holder Of A Direct Wine Shipper's Permit May Sell Or Ship To An Individual Each Year; To Provide For The Annual Renewal Of Direct Wine Shipper's Permits; To Provide That Persons Purchasing Or Receiving A Direct Shipment Of Wine From A Direct Wine Shipper Must Be At Least 21 Years Of Age; To Provide That Persons Receiving A Direct Shipment Of Wine From A Direct Wine Shipper Shall Use The Wine For Personal Consumption Only And May Not Resell It; To Authorize The Commissioner Of Revenue To Adopt Any Rules Or Regulations As Necessary To Carry Out This Act; To Provide Penalties For Violations Of This Act; To Amend Sections 27-71-5, 27-71-7, 27-71-15 And 27-71-29, Mississippi Code Of 1972, To Provide The Privilege Tax Required For The Issuance Of A Direct Wine Shipper's Permit; To Levy A Tax Upon The Sales And Shipments Of Wine Made By A Direct Wine Shipper; To Require A Certain Amount Of The Taxes Levied To Be Deposited Into The Mental Health Programs Fund; To Amend Sections 67-1-41, 67-1-45, 67-1-51, 67-1-53, 67-1-55, 67-1-57, 67-1-73, 97-31-47 And 97-31-49, Mississippi Code Of 1972, In Conformity To The Foregoing Provisions Of This Act; And For Related Purposes.

An Act To Amend Sections 79-4-14.21 And 79-29-823, Mississippi Code Of 1972, To Authorize The Secretary Of State To Serve Determination Notices And Certificates Of Administrative Dissolution On Corporations And Limited Liability Companies By Email To The Registered Agent Of A Corporation Or Limited Liability Company As Indicated By The Entity; And For Related Purposes.

An Act To Require A Fiduciary Or The Governing Board Of A Public Retirement System, In Making And Supervising Investments For The Public Retirement System, To Discharge Its Duties Solely In The Financial Interest Of The Participants And Beneficiaries For The Exclusive Purposes Of Providing Financial Benefits To Participants And Their Beneficiaries And Defraying Reasonable Expenses Of Administering The System; To Provide That An Investment Manager Retained By The Governing Board Shall Be Subject To The Same Fiduciary Duties As The Board; To Require A Fiduciary To Take Into Account Only Financial Factors When Discharging Its Duties With Respect To A Retirement Plan; To Provide That Financial Factors Do Not Include Any Action Taken, Or Factor Considered, By A Fiduciary With Any Purpose To Further Social, Political Or Ideological Interests; To Provide That All Shares Held Directly Or Indirectly By Or On Behalf Of A Public Retirement System And/or The Participants And Their Beneficiaries Shall Be Voted Solely In The Financial Interest Of Plan Participants And Their Beneficiaries; To Provide That This Act, Or Any Contract Subject To This Act, May Be Enforced By The Attorney General; To Provide That A Person Or Company Who Serves As A Fiduciary And Who Violates The Fiduciary Duty Imposed By This Act Shall Be Obligated To Pay Damages To The Public Retirement System In An Amount Equal To Three Times All Monies Paid To The Person Or Company By The System For The Services Of The Person Or Company; To Amend Sections 25-11-121 And 25-11-407, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.

An Act To Create New Section 27-103-215, Mississippi Code Of 1972, To Provide That In Any Fiscal Year In Which The Amount Of Actual General Fund Revenue Received Exceeds The Official Sine Die General Fund Revenue Estimate For That Fiscal Year, The First Fifty Million Dollars Of The Amount Of The Surplus General Fund Revenue Above The Revenue Estimate, Reduced By The Rate Of Inflation For The Previous Calendar Year, Shall Be Used To Reduce The Debt Of The State Of Mississippi; To Create A Special Fund In The State Treasury To Be Known As The Surplus Revenue Debt Reduction Fund, Which Shall Be Expended, Upon Appropriation Of The Legislature, Only For Paying Maturing Bonds And Interest On The Full Faith And Credit Bonds Of The State Of Mississippi When They Are Due, And For Paying Service Charges To Banks For Acting As Agents Of The State In Paying Maturing Bonds And Interest On The Full Faith And Credit Bonds Of The State; To Provide That Upon The Passage Of This Act, The State Fiscal Officer Shall Transfer The Sum Of One Hundred Million Dollars From The Capital Expense Fund To The Surplus Revenue Debt Reduction Fund Created In This Act, And That Sum Shall Be Appropriated From The Surplus Revenue Debt Reduction Fund By The Legislature For The Payment Of Debt Service For The 2024 Fiscal Year; To Amend Section 27-103-213, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.

An Act To Amend Section 41-42-5, Mississippi Code Of 1972, To Direct The State Department Of Health To Provide For A Nurse Practitioner To Be Present At Each County Health Department For At Least One Day Each Week In Order To Provide Persons With Contraceptive Supplies And Prescriptions For Contraceptive Supplies At No Cost To The Recipient; To Amend Section 41-42-3, Mississippi Code Of 1972, To Conform To The Preceding Provision; To Amend Section 41-42-7, Mississippi Code Of 1972, To Authorize Nurse Practitioners To Provide Contraceptive Supplies And Information To Certain Minors; And For Related Purposes.

An Act To Regulate The Operation Of Utility-type Vehicles (utvs) Or Side-by-sides On The Public County And Municipal Roads And Streets Within The State Of Mississippi; To Define Terms Used In This Act; To Require The Registration Of Utvs With The Department Of Revenue In The Same Manner As Passenger Motor Vehicles; To Authorize The Operation Of On County And Municipal Public Roads And Streets With Posted Speed Limit Of 55 Miles Per Hour Or Less; To Require Owners Of Utvs And Side-by-sides To Obtain A License Plate And Registration From The Department Of Revenue Upon Presenting Proof Of Ownership And Liability Insurance For The Utv And Payment Of An Annual Registration Fee; To Require The Department Of Revenue To Determine The Color And Design Of The License Tags; To Exempt Owners From The Payment Of Ad Valorem Property Taxes To The County Where The Vehicle Is Registered; To Provide For The Deposit And Distribution Of The Registration Fees By The Department Of Revenue And The State Treasurer; To Provide That The Funds Distributed To Counties Shall Be Used For The Maintenance Of Roads And Bridges Therein; To Require Operators Of Utvs And Side-by-sides To Be At Least Sixteen Years Old And Possess A Valid Driver's License; To Require Operators Of Utvs To Have Their Driver's License And Proof Of Financial Responsibility At All Times While Operating Utvs And Side-by-sides On The Public Roads Of The State; To Limit The Operation Of Utvs And Side-by-sides On Public Roads By A Sixteen-year Old With Only A Conditional Driver's License To Operating The Utv During Daylight Hours While Accompanied With A Licensed Adult Driver Over The Age Of Eighteen; To Prohibit The Operation Of Utvs And Side-by-sides On Public Roads By Anyone Holding Only A Learner's Permit; To Provide That No Child Under The Age Of Eight May Be A Passenger In A Utv Or Side-by-side While Operated On A Public Road; To Prescribe The Specific Safety Features A Utv Or Side-by-side Must Be Equipped With To Be Registered With The Department Of Revenue For Purposes Of Operating On Public Roads; To Amend Sections 63-2-1, 63-3-103, 63-15-3, 63-21-5, 63-21-9, 27-19-3, 27-19-31, 27-51-5 And 27-51-41, Mississippi Code Of 1972, In Conformity To The Preceding Provisions; To Bring Forward Section 63-15-4, Mississippi Code Of 1972, For The Purpose Of Possible Amendments; And For Related Purposes.
