An Act To Establish The "families' Rights And Responsibilities Act Of 2023"; To Define Terminology Used Herein; To Establish That A Parent's Liberty To Direct The Upbringing, Education, Health Care And Mental Health Of His Or Her Child Is A Fundamental Right; To Prohibit The State Or Any Political Subdivision Thereof From Substantially Burdening A Parent's Fundamental Right Without Demonstrating That The Burden Is Required By A Compelling Governmental Interest; To Provide That All Parental Rights Are Exclusively Reserved To A Parent Of A Child Without Obstruction By Or Interference From The State Or Any Political Subdivision Thereof; To Provide That Abuse Or Neglect Of A Child By A Parent Or The Action Or Decision Of A Parent That Would End Life Are Not Authorized By This Act; To Prohibit Employees Of This State And Any Political Subdivision Thereof, Except For Law Enforcement Personnel, From Encouraging Or Coercing A Child To Withhold Information From The Child's Parent; To Further Prohibit Such Employees From Withholding Information That Is Relevant To A Child's Physical, Emotional Or Mental Health From A Child's Parent; To Require The Board Of Education Of A School District To Develop And Adopt A Policy To Promote The Involvement Of Parents Of Children Enrolled In The District's Schools; To Prescribe The Minimum Requirement Procedures To Be Addressed By The Policy; To Provide The Board Of Education Of A School District With The Discretion To Adopt A Policy To Provide To Parents The Information In An Electronic Form; To Require Parents To Submit A Written Or Electronic Request For The Child's Information To The School Principal Or The Superintendent Of The School District; To Require The School Principal Or Superintendent To Provide The Requested Information To The Parents Within Ten Days Of Receiving The Request, Or Submit To The Parent A Written Explanation Of The Reasons For The Denial Of The Requested Information; To Prescribe The Process By Which A Parent May Submit A Formal Consideration Of The Request Of Information With The School Board If The Requested Information Is Not Received 15 Days After Submitting The Initial Request; To Stipulate The Limitations Placed Upon Persons, Corporations, Associations, Organizations, State Supported Institutions Or Individuals Employed By Any Of These Entities To Provide Any Medical Or Mental Health Service Or Procedure On A Child Without First Obtaining The Consent Of The Child's Parent, Except As Otherwise Provided By Law Or Court Order; To Prescribe Exceptions To The Limitation When Parental Consent Is Not Capable Of Being Given Or In Emergency Situations When Imminent Bodily Harm Or Death Could Result; To Specify The Manner By Which Parental Consent Must Be Verified If Telemedicine Is Provided; To Establish A Cause Of Action For Violation Of This Act; To Provide That This Act Shall Serve As A Defense To Any Cause Of Action That Is Raised As A Result Of A Violation Thereof; To Provide That The Rules Of Construction Shall Provide Broad Protection Of A Parent's Fundamental Rights As Inalienable Unless Those Rights Have Been Legally Waived Or Legally Terminated; To Provide For Severability If Any Part Of This Act Is Held Invalid; To Amend Section 37-3-49, Mississippi Code Of 1972, To Provide The Parent Of Each Public School Student With The Right To Receive Effective Communication From The School Principal As To The Manner In Which Instructional Materials Are Used To Implement The School's Curricular Objectives; To Amend Section 37-13-173, Mississippi Code Of 1972, To Provide Parents The Authority To Opt Their Children Out Of Any Instruction Of The School District's Comprehensive Health Education Relating To Sex Education Upon Submitting A Written Request To The School Principal; To Amend Section 37-15-3, Mississippi Code Of 1972, To Provide That Student And Parental Rights To Education Records Created, Maintained, Or Used By Public Educational Institutions And Agencies Shall Be Protected; To Stipulate That Students And Their Parents Maintain The Right To Access The Student's Educational Records, Waive Access To Such Records, Challenge The Content Of Such Records, Privacy Of Such Records And To Receive Annual Notice Of The Rights To Such Records; To Bring Forward Section 43-21-105, Mississippi Code Of 1972, For The Purpose Of Possible Amendment; And For Related Purposes.

An Act To Require Children Who Are Younger Than 18 Years Old To Take The Act Assessment Prior To Dropping Out Of School; To Provide That If The Child Cannot Attain A Certain Act Score They Shall Be Included In The Compulsory School Attendance Law Until They Reach 18 Years Of Age; To Provide Penalties For The Parents Of Children Who Are Required To Attend School Until Reaching 18 Years Of Age And Miss A Certain Number Of Consecutive Days; To Amend Section 37-13-91, Mississippi Code Of 1972, In Conformity Thereto; And For Related Purposes.

An Act To Create New Section 73-11-75, Mississippi Code Of 1972, To Provide That When A Funeral Establishment Has Picked Up A Body And Has Performed Embalming Services Or Other Services In Preparing The Body For Burial Or Cremation, And The Person Who Is The Next Of Kin Or Authorizing Agent Or Representative Of The Deceased Requests That The Body Be Transferred To Another Funeral Establishment For Burial Or Cremation, The Transferee Funeral Establishment Must First Pay The Transferring Funeral Establishment For The Cost Of The Services That Were Performed By The Transferring Funeral Establishment Before The Body May Be Transferred; And For Related Purposes.

An Act To Authorize Certain Municipalities To Impose An Excise Tax Of One Cent Per Gallon Upon The Retail Sale Of Gasoline And Diesel Fuel For Motor Vehicles In The Municipality; To Provide That Before The Tax May Be Imposed, The Municipality Shall Adopt A Resolution Declaring Its Intention To Levy The Tax And Calling For An Election To Be Held On The Question; To Require The Municipality To Publish Notice Of The Election; To Provide That The Tax Must Be Approved By A Majority Of The Qualified Electors Who Vote In The Election Before The Municipality May Levy And Collect The Tax; To Provide That The Tax Shall Be Collected By The Department Of Revenue And Paid To The Municipality; To Provide That The Proceeds Of The Tax Shall Be Placed Into A Special Municipal Fund Apart From The Municipal General Fund And Any Other Funds Of The Municipality, And Shall Be Expended By The Municipality Solely For The Repair, Maintenance And/or Reconstruction Of Roads, Streets And Bridges In The Municipality; And For Related Purposes.

An Act To Create The "released-time Moral Instruction Act Of 2023"; To Authorize Local School Boards To Permit The Released-time Moral Instruction Of Pupils; To Permit School Boards To Complete A Survey To Determine Pupils Within The School District Who Desire Released-time Moral Instruction And Who Have Received Consent From Their Parent Or Legal Guardian For Such Instruction; To Require School Boards To Allow Those Students Desiring Released-time Moral Instruction To Participate In Off-site For At Least One Hour, One Day Each Week; To Prohibit The School District From Providing Or Facilitating Released-time Moral Instruction On School Premises; To Permit Local School Boards To Make Arrangements With The Persons In Charge Of The Released-time Moral Instruction As The Board Deems Necessary And Advisable; To Provide That Students Shall Not Be Penalized Or Considered Absent From The School For Purposes Of Attending Released-time Moral Instruction; To Provide That Students Who Do Not Participate In Released-time Moral Instruction Shall Continue In The Regular Course Of Daily Instruction; To Provide That Released-time Moral Instruction Shall Be Given Without Expense To Any Local School Board Beyond The Cost Of The Original Survey; To Amend Section 37-13-91, Mississippi Code Of 1972, In Conformity To The Preceding Provisions; And For Related Purposes.

An Act To Require The Attorney General To Commence An Investigation Into The Activities Of Pharmaceutical Companies In Mississippi Relating To The Development, Promotion And Distribution Of Vaccines Purported To Prevent Covid-19 Infection, Symptoms And Transmission; To Declare Certain Findings; To Specify Certain Criminal Offenses That Must Be Included In The Scope Of The Investigation; To Require The Attorney General To Submit A Status Report To The Legislature Before January 1 Of Each Year That The Investigation Is Ongoing, Which Report May Not Include Information That Is Confidential Or Potentially Threatening To The Integrity Of The Investigation; And For Related Purposes.

An Act To Create New Section 43-13-115.1, Mississippi Code Of 1972, To Provide That Pregnant Women Shall Be Deemed To Be Presumptively Eligible For Ambulatory Prenatal Care Under Medicaid For Up To 60 Days If A Qualified Provider Determines, On The Basis Of Preliminary Information, That The Total Countable Net Family Income Of The Woman Does Not Exceed 185% Of The Federal Poverty Level; To Require Pregnant Women To Provide Proof Of Pregnancy And Documentation Of Monthly Family Income When Seeking A Determination Of Presumptive Eligibility; To Provide That Qualified Providers Are Those That Meet The Federal Definition Of Qualified Provider, Which Shall Include County Health Departments, Federally Qualified Health Centers (fqhcs), And Other Entities Approved And Designated By The Division Of Medicaid To Conduct Presumptive Eligibility Determinations For Pregnant Women; To Require Pregnant Women Who Are Determined To Be Presumptively Eligible For Medicaid To Make Application For Medicaid By Not Later Than The Last Day Of The Month Following The Month During Which The Determination Is Made; And For Related Purposes.
