Employment and vaccinations. Provides that an employer may require an immunization only if the employer respects the employee's right to refuse an immunization. Provides that an employee shall be free from coercion or an adverse action based on the employee's refusal of an immunization. Requires an employer that offers an immunization at no cost to an employee to provide certain notice to the employee. Provides that a violation may be reported to the department of labor (department). Requires the department to impose a civil penalty of $5,000 per incident. Allows an employee to bring a civil action against an employer to enforce the provisions. Repeals provisions concerning exemptions from COVID-19 immunization requirements. Makes a corresponding change.

Department of correction immunity. Provides immunity under the tort claims act for a governmental entity or employee for civil liability based on injury to or the death of an inmate, if the injury or death was the result of the voluntary possession or use of fentanyl illegally brought into a correctional facility.

Maintenance of U.S. 41 right-of-way. Appropriates $500,000 from the state general fund to the Indiana department of transportation (department) to be used by the department for the purpose of providing roadside mowing on U.S. 41 from the Vanderburgh County - Gibson County line to the Knox County - Sullivan County line.

Health care matters. Requires a hospital to inform a woman in premature labor of the hospital's capabilities of treating the born alive infant and managing a high risk pregnancy and, if the hospital's capabilities interfere with the woman's care, the hospital must provide this information before the woman is admitted to the hospital. Provides that if a born alive infant is transported to a hospital with an appropriate perinatal level of care, the woman must be offered an opportunity to be transported to the same hospital. Provides that if the local prosecuting attorney has probable cause to believe that a health care provider may have knowingly or intentionally: (1) violated the requirements concerning the treatment and care of a born alive infant or mother or the professional standards of practice through the health care provider's actions or inactions; and (2) caused harm or death to the born alive infant or mother; the prosecuting attorney shall investigate the health care provider for appropriate criminal prosecution. Establishes a presumption that the continuation of life is in a minor's best interests. Requires a health care provider to obtain the consent of each parent or each legal guardian before issuing a do not resuscitate order or otherwise withholding or withdrawing treatment to allow the natural death of a minor. Prohibits a health care provider from interfering with the transfer of a minor patient at the request of a parent or guardian or otherwise preventing life saving measures before or during the transfer. States that a court does not have jurisdiction to withdraw life sustaining treatment for a minor.

Birth certificate information. Provides that the gender listed on an individual's birth certificate and permanent record made from the birth certificate may not be changed. Specifies certain exceptions.

Use of public restrooms. Makes it a Class B misdemeanor if: (1) a male knowingly or intentionally enters a restroom that is designated to be used only by females; or (2) a female knowingly or intentionally enters a restroom that is designated to be used only by males. Provides certain defenses.

IHCDA report requirement. Requires the housing and community development authority (IHCDA) to include in its annual report certain information concerning the authority's programs to promote housing stability.

Real estate matters. Requires a broker company to deposit funds belonging to others into a trust account that the broker company maintains. Requires that residential real estate sales disclosure forms include disclosures by an owner that a property is located within a locally designated historic district. Requires that residential real estate sales disclosure forms include disclosures by an owner of any conservation easement. Requires the Indiana professional licensing agency in consultation with the Indiana real estate commission to perform annual and random audits for compliance of more than one percent (1%) but less than ten percent (10%) of the practitioners who hold a broker's license required to take continuing education courses. Provides that to become a managing broker, an individual, among other things, must: (1) hold an active broker's license for at least three years; and (2) pass a written examination. Amends provisions relating to real estate agreements. Makes a technical correction.

Conservancy district road funding. Provides that, beginning July 1, 2025, a conservancy district that: (1) has an elected board of directors; and (2) has assumed responsibility in its district plan for the construction, reconstruction, and maintenance of the public highways within the conservancy district; is considered a city or town for purposes of distributions from the motor vehicle highway account and the local road and street account.

Unborn children. Modifies the definition of "human being" in the criminal code to include an unborn child. Removes applicability language concerning certain abortions in the wrongful death or injury of a child statutes. Clarifies the duress defense relating to culpability. Repeals the section that provides that the homicide chapter does not apply to certain abortions. Removes language from the murder, manslaughter, and involuntary manslaughter statutes regarding intentionally killing a fetus. Repeals the crime of feticide. Repeals the section that concerns the applicability of certain crimes related to abortion, the termination of a pregnancy, or the killing of a fetus. Provides that the homicide and battery chapters apply to a victim who is an unborn child.

Hospital charity care. Specifies charity care that certain nonprofit hospitals and county hospitals must provide concerning patients.

Property tax relief for seniors and veterans. Makes certain changes to the qualification requirements and credit amount for the over 65 circuit breaker credit. Makes certain changes to the qualification requirements and deduction amount for the property tax deduction for disabled veterans who are either totally disabled or at least 62 years of age with a partial disability.

Cultural commissions. Changes the membership of the Dr. Martin Luther King Jr. Indiana holiday commission. Reduces the number of members serving on the following cultural commissions: (1) The Indiana commission on Hispanic/Latino affairs. (2) The Indiana commission on the social status of black males. Makes changes concerning the meeting, voting, reporting, staffing, and funding requirements of the cultural commissions. Provides that money appropriated to the civil rights commission for the cultural commissions does not revert to the state general fund. Establishes the Dr. Martin Luther King Jr. Indiana holiday commission special fund. Makes appropriations.

Homestead exemption for persons at least age 65. Eliminates property taxes on primary residences for those who are at least 65 years of age (qualified homesteads) beginning with the assessment date on January 1 of the year that immediately succeeds the year in which the balance in the pension stabilization fund is sufficient to pay the liabilities of the pre-1996 account without the need for further appropriation by the general assembly. Requires the Indiana public retirement system to determine whether the balance of the pension stabilization fund is sufficient to pay the liabilities of the pre-1996 account without the need for an appropriation by the general assembly and certify the determination to the budget committee on or before March 1, 2026, and on or before March 1 of each odd-numbered year thereafter. Provides an annual state distribution to offset the property tax elimination for qualified homesteads based on the amount of property taxes that otherwise would be due on the qualified homesteads. Makes an ongoing appropriation.
