Child and dependent care tax credit. Provides a refundable child and dependent care tax credit to taxpayers whose adjusted gross income for the taxable year is not more than 250% of the federal poverty level. Provides that the credit is equal to the lesser of: (1) an amount ranging from $200 to $1,000, depending on the extent to which the taxpayer's adjusted gross income exceeds the federal poverty level; or (2) 20% of the taxpayer's employment related expenses.

Various education matters. Requires the department of education (department) to: (1) evaluate, approve, and publish a list of high quality curricular materials for use in English/language arts; and (2) collaborate with teachers in evaluating and approving the English/language arts curricular materials. Provides that the evaluation process for certain curricular materials must include the age appropriateness of the content. Specifies that the curriculum used by a school in which fewer than 70% of students achieved a valid passing score on the determinant evaluation of reading skills must be age appropriate. Requires, subject to available funding, certain schools to participate in the Indiana literacy cadre. Amends the definition of "eligible school" for purposes of the choice scholarship program. Provides that a parent who: (1) is an education scholarship account (ESA) participating entity; and (2) teaches a course or program only to an eligible student who is the parent's child and does not teach a course or program to any other eligible student; may not submit a claim for reimbursement of an ESA qualified expense of tuition and fees to teach the parent's child. Establishes penalties for certain violations by an ESA participating entity.

Removes certain provisions concerning the audit of practice agreements. Allows an APRN with prescriptive authority to prescribe a schedule II controlled substance for weight reduction or to control obesity. Makes conforming changes.

Tax credit for preceptors in medical education. Provides a credit against the state tax liability of a qualified clinician (preceptor) in medical education who provides to a student in a particular taxable year, in return for no compensation as a preceptor, at least 140 hours of personalized instruction or training related to the student's clinical rotations required to obtain a professional degree. Provides that the amount of the credit allowable is equal to the lesser of: (1) $1,000 for each clinical rotation for which the qualified taxpayer provided the required instruction or training during the taxable year; or (2) $12,000 per taxable year.

Public defender benefits. Allows an attorney who: (1) performs court appointed legal services on a full-time or full-time equivalent basis; (2) regularly performs court appointed legal services in more than one county that receives reimbursement from the Indiana commission on court appointed attorneys; and (3) is not eligible to join an employee health plan in any state or local unit; to participate in the state employee health plan. Establishes eligibility, enrollment, and coverage requirements. Provides that the cost of coverage shall be shared between the Indiana commission on court appointed attorneys and the eligible attorney. Establishes the public defender health benefit fund. Makes conforming changes.

Offenses against children. Replaces the term "child pornography" with the term "child sex abuse material" throughout the Indiana Code. Provides that it is a defense to prosecution of child exploitation and possession of child sex abuse material if a school employee, department of child services employee, or attorney acting in the attorney's capacity as legal counsel: (1) promptly and in good faith notified law enforcement about the image or matter depicting the sexual conduct; and (2) did not duplicate, upload, download, or otherwise transfer the image or matter. Provides that a governmental entity may not organize or host an obscene performance or fund an obscene performance using public funds, and authorizes a person to seek injunctive relief as a remedy for a violation. Specifies the intent of the general assembly concerning P.L.115-2023.

Provides that a trial court may not release on bail a defendant if the state proves by clear and convincing evidence that a defendant poses a substantial risk and the proof is evident or the presumption strong. Establishes a procedure for the state to petition the trial court for a determination that a defendant poses a substantial risk. Provides that for an arrestee whose most serious pending charge is a misdemeanor or a Level 6 felony, the arrestee is presumptively entitled to release without money bail or surety. Provides that an arrestee is not presumptively entitled to release without money bail or surety if certain conditions apply.
