Reinserts the provisions of the bill with these changes. Requires the Department of Human Rights to notify the parties that the complainant may request a Departmental notice of right to sue when submitting the Equal Employment Opportunity Commission determination after the Department receives notice that a charge was filed with the EEOC. Requires that if the EEOC does not issue a determination or determines that it is unable to establish illegal discrimination, the Department must proceed as follows: if the complainant timely notifies the Department of the EEOC's determination and also requests in writing that the Department issue a Departmental notice of right to sue, then the Department shall issue such notice within 10 business days after the receipt of the EEOC's determination and request from the complainant; but if the complainant does not submit the written request as required when notifying the Department of the EEOC's determination, then the Department must inform the parties, within 10 business days after receipt of the EEOC's determination, that the Department will issue a Departmental notice of right to sue unless the complainant requests in writing within 35 days after receipt that the Department review the EEOC's determination. Provides that if the complainant does file a written request with the Department to review the EEOC's determination, the Department shall review the EEOC's determination and may review any information submitted by the complainant with the written request and any evidence obtained by the EEOC during its investigation. Provides that if the Department receives a written request from the complainant to opt out of the investigation after the 60-day opt-out time period has elapsed, the Department shall process the request as a request for a Departmental notice of right to sue. Provides that if more than 365 days have elapsed after the charge is filed, or any such longer period agreed to in writing by all the parties, the complainant may exercise the complainant's rights to either file a complaint with the Human Rights Commission or commence a civil action in the appropriate circuit court without requesting or obtaining a Departmental notice of right to sue. Makes structural changes. Provides that the changes made to the Section governing procedures by Public Act 104-425 apply to charges pending or filed on or after January 1, 2026.

Amends the Toll Highway Act. Provides that the Illinois State Toll Highway Authority has the power to establish a special pay supplement for those positions of employment that require that a person employed in that position speak or write a language other than English. Provides that such paid positions may be eligible for a bilingual pay supplement to attract bilingual individuals, to encourage present employees to become proficient in languages other than English, or to retain qualified bilingual employees. Provides that a bilingual pay supplement shall be processed within 30 calendar days after the employee presents to the Authority a certification from either the designated testing program process selected by the Authority or a State community college confirming that language skill proficiency in reading, writing, and speaking has been satisfied by the employee.

Amends the Environmental Protection Act. In provisions concerning the regulation of air pollution, water pollution, drinking water, hazardous waste, and landfills, provides that the Illinois Pollution Control Board shall not adopt any standards that are less stringent than those existing in Board regulations. Provides that various provisions of the Act shall not be construed to limit the right of a person to submit to the Board, or for the Board to adopt, regulations more stringent than the regulations promulgated by the Administrator of the United States Environmental Protection Agency.

Amends the Illinois Sustainable Investing Act. Provides that the laws of this State shall govern in any case or controversy heard in this State related to lawful sustainable investment activity. Provides that the State shall not provide any information to or expend or use any time, money, facilities, property, equipment, personnel, or other resources to assist any individual, or out-of-state officer, official, agency, entity, or department seeking to impose civil or criminal liability upon a person or entity for lawful sustainable investment activity. Creates a right of action if a person residing or domiciled in Illinois has had judgment entered against them in another state for lawful sustainable investment activity that is permitted under the laws of this State.

Amends the Public Utilities Act. Provides that 20% of the lesser of (rather than the lesser of): (i) the purchase price or (ii) the fair market value shall constitute the rate base associated with the water or sewer utility as acquired by and incorporated into the rate base of the district designated by the acquiring large public utility, subject to any adjustments that the Illinois Commerce Commission deems necessary to ensure such rate base reflects prudent and useful investments in the provision of public utility service. Provides that the difference between the rate base and the purchase price or fair market value shall be borne by the shareholders of the acquiring large public utility. In provisions concerning the acquisition of a water or sewer utility, provides that, at the next election following the public meeting and notice requirements, a referendum shall be placed on the ballot for all electors within the area the water or sewer utility operates. Provides that, if a majority of the electors voting on the referendum within the service area of the water or sewer utility vote in favor of the referendum, then the acquisition may continue. Provides that, if less than a majority of the electors voting on the referendum within the service area of the water or sewer utility vote in favor of the referendum, the Commission shall not approve the large public utility's acquisition of the water or sewer utility. Removes a provision that provides that the Commission may authorize a water or sewer utility to file a surcharge which adjusts rates and charges to provide for recovery of costs associated with an investment in qualifying infrastructure plant, independent of any other matters related to the utility's revenue requirement. Makes other changes.

Amends the Illinois Controlled Substances Act. Provides that, if a pharmacy is unable to fill an initial prescription received electronically because the prescribed drug is not in stock, the dispenser must immediately contact the patient to notify the patient of the situation and ask if the patient would like the prescription transferred electronically to a pharmacy of the patient's choosing, consistent with federal regulations concerning the prescribing of controlled substances. Provides that the prescriber shall not be required to issue prescriptions electronically if the prescriptions need to be filled outside of typical retail pharmacy operating hours or may be difficult to obtain because of drug shortages or pharmacy inventory limitations. Amends the Pharmacy Practice Act to make conforming changes. Effective immediately.

Amends the Assisted Living and Shared Housing Act, the MC/DD Act, and the ID/DD Community Care Act. Provides that notice of closure of an establishment or facility licensed under those Acts shall be given to the Office of the State Long Term Care Ombudsman.

Amends the Video Gaming Act. Provides that an applicant or licensee is not in violation of the Act or any rule of the Board and the applicant or licensee is not subject to disciplinary action, delay of Board consideration, or denial of any license based solely upon the ownership, operation, or possession of a game device if the game device is in compliance with specified Sections of the Criminal Code of 2012. Amends the Criminal Code of 2012. Provides that, notwithstanding any other gambling offense provisions, a gambling offense involving a specified vending or other electronic machine or device connected to the Internet is a Class 4 felony. Prohibits any municipality from imposing any restriction or prohibition on permitted gambling activities. Makes changes to the definition of "gambling device". Amends the Prizes and Gifts Act. Makes changes to defined terms. Sets forth provisions concerning the operation of a prize and gift kiosk. Requires each business operating a prize and gift kiosk to be registered with the Department of Revenue and to register each prize and gift kiosk as a Coin-Operated Amusement Device. Provides that filing for a device other than a prize and gift kiosk shall be considered filing a false report or form with the State, and violators shall be subject to any and all penalties for that violation. Provides that the Department of Revenue and the Illinois Liquor Control Commission or its designee shall have jurisdiction. Effective immediately.

Amends the Counties Code and the Illinois Municipal Code. Provides that a county or a municipality may not adopt or enforce an ordinance, rule, or other measure that would regulate the installation or inspection of a residential energy backup system, including on a building with a shared roof. Defines "residential energy backup system". Effective June 1, 2026.

Amends the Educator Licensure Article of the School Code. Provides the additional requirement of successfully completing at least one foundational course on English learners for a person to be issued a Professional Educator License. Effective January 1, 2028.

Amends the Student Transfer Achievement Reform Act. Provides that the Board of Higher Education and the Illinois Community College Board shall develop a policy to foster the reverse transfer of credit for any student who has accumulated at least 30 (rather than 15) hours of academic credit at a community college and a sufficient number of hours of academic credit at a State university in the prescribed courses necessary to meet a community college's requirements to be awarded an associate degree. Provides that each State university shall automatically notify any transfer student accepted to the State university with at least 30 hours of academic credit at a community college of the option for the reverse transfer of credit within the student's first term of enrollment. Provides that a community college shall provide notification to a student wishing to reverse transfer earned academic credit with instructions on application for conferral of an associate degree. Provides that a community college or State university may not charge an application, transfer evaluation, or graduation fee or any other fee associated with conferral of an associate degree through reverse transfer. Provides that a community college shall include each student awarded an associate degree through reverse transfer within its student information system. Effective immediately.

Amends the Sexual Assault Survivors Emergency Treatment Act. Provides that beginning January 1, 2028, a treatment hospital, treatment hospital with approved pediatric transfer, or approved pediatric health care facility may submit a sexual assault treatment plan which includes the use of a TeleSANE interactive telecommunications system which allows a qualified medical provider to precept a medical forensic examination while located at a distant site. Amends the Juvenile Court Act of 1987. Provides that in inspection and copying of law enforcement records maintained by law enforcement agencies that relate to a minor who has been investigated, arrested, or taken into custody before the minor's 18th birthday by victims and their attorneys, the information identifying the nonrequesting victims shall be redacted in cases of multiple minor victims or multiple victims of sex offenses. Amends the Rights of Crime Victims and Witnesses Act. Provides that a victim shall not be excluded from any part of the trial unless a written motion to exclude a victim from trial was filed at least 60 days prior to the date set for trial. Makes other structural and technical changes in the Act. Makes other changes. Amends the Address Confidentiality for Victims of Domestic Violence, Sexual Assault, Human Trafficking, or Stalking Act. Defines "eligible person" as a person 18 years of age or older who is the victim of domestic violence, sexual assault, human trafficking, or stalking; the parent or guardian of a minor or disabled adult who is a victim of domestic violence, sexual assault, human trafficking, or stalking; and a household member of a victim of domestic violence, sexual assault, human trafficking, or stalking. Allows household members who are not victims to participate in the program. Provides that a participant whose certification has not been withdrawn or cancelled may reapply to the Address Confidentiality Program to renew certification for an additional 4 years. Changes notice process for certification cancellation. Allows the Attorney General discretion to continue the participation of participants who have a change of legal name and specifies notice in that process. Makes other changes.

Creates the Social Media Age Restriction Act. Provides that an operator of a social media platform shall take reasonable steps, including the implementation of an age assurance system, to prevent a child from creating or maintaining an account on the social media platform. Provides that an operator may enter into an agreement with application distribution services or device manufacturers to allow for user information to be shared for age assurance purposes. Provides that the provision does not apply to a parent or guardian who allows a child to use an account held by the parent or guardian. Sets forth provisions concerning a 30-day cure period and civil penalties. Provides that an operator shall have 180 days after the effective date of the Act to comply with the requirements of the Act. Effective immediately.

Amends the Civil Administrative Code of Illinois. Provides that the Board of Review within the Department of Employment Security shall consist of 3 members (rather than 5 members). Sets forth provisions concerning the compensation and support of members of the Board of Review. Amends the Unemployment Insurance Act. Provides that each member of the Board of Review shall review the record and certify that fact in each final determination made by the Board of Review.

Amends the Common Interest Community Association Act and the Condominium Property Act. Prohibits an association in both Acts from requiring permission before a unit owner removes Illinois designated noxious weeds and Illinois designated exotic weeds as designated by the Department of Natural Resources. Provides that any provision in the association's community instruments requiring permission is null and void.
