Colorado House Bill HB261147
The act requires the department of health care policy and financing (state department) to establish a statewide database to provide accurate information about certain individual residential services and supports settings and their associated service provider agencies. The database will be used by the state department, the department of public health and environment, and service provider agencies. Information from the database may only be shared with the public upon determination by the state department and consistent with state and federal privacy and confidentiality laws. The act requires service provider agencies to submit the required information to the state department beginning July 1, 2026, and quarterly thereafter, and requires the state department to update the database within one month after receiving the required information from the service provider agencies. The act clarifies that individual residential services and supports settings must be treated as residential properties in the application of local regulations, including zoning, land use development, fire and life safety, sanitation, and building codes. The act prohibits local governing authorities from imposing additional regulations on individual residential services and supports settings that do not apply to other residential properties. The act appropriates $20,000 to the state department from the general fund to implement the act. It is anticipated that the state department will receive $60,000 in federal funds for the executive director's office to implement the act.(Note: This summary applies to this bill as enacted.)

When a catalytic converter mechanically fails or is stolen from a motor vehicle, current rules of the air quality control commission require the replacement to comply with the rules of the California air resources board. The bill creates a temporary exception (exception) that allows an individual to use a replacement catalytic converter that complies with the standards established by rules of the United States environmental protection agency if:In the case of the theft of a catalytic converter, the theft has been reported to a law enforcement agency; andThe owner or operator of the motor vehicle has made a reasonable effort to obtain the required replacement catalytic converter and has been unable to obtain the replacement catalytic converter.The exception is repealed, effective July 1, 2028.The bill prohibits a motor vehicle repair facility or any employee or contract laborer of the facility from repairing or replacing a catalytic converter that has failed or been stolen without first informing the customer about available state programs to replace an internal combustion vehicle with a zero-emission alternative.(Note: This summary applies to this bill as introduced.)

The act requires the state board of veterinary medicine (board) to review and update the existing process by which an individual who has a license to practice veterinary medicine in another state may be licensed by endorsement to practice veterinary medicine in Colorado. The board shall adopt rules with the intent to expedite the licensure by endorsement process, including eliminating duplicative requirements and streamlining the pathway to licensure. The act clarifies that a veterinarian who administers, dispenses, distributes, or prescribes medicine to a patient in an emergency situation is not acting as a pharmacist or conducting the practice of pharmacy, and, as such, is not subject to discipline by the state board of pharmacy. The act relocates certain provisions specific to the practice of veterinary medicine from regulation by the state board of pharmacy to regulation under Colorado's veterinary practice act. Under current law, the board must approve a credentialing organization for the purpose of credentialing veterinary technicians, which credentialing organization must require the completion of an American Veterinary Medical Association accredited program for veterinary technicians. The act updates the requirement to require the completion of an accredited program for veterinary technicians offered by other associations. The act also establishes a veterinary prescription drug donation program. An owner of an animal may donate unused veterinary drugs that have been prescribed to the owner to a licensed veterinarian or an animal shelter. A licensed veterinarian may use any drugs accepted through donation if the veterinarian and drugs meet certain conditions.(Note: This summary applies to this bill as enacted.)

The act requires a landlord to:Comply with applicable court rules governing the protection and redaction of personal identifying information in eviction filings; andRedact personal identifying information from supporting documents submitted to a court. The act implements the recommendation of the department of regulatory agencies' sunset review and report in continuing the registration program for vessels until September 1, 2036. The act also makes changes to definitions of 'vessel' and adds a definition of 'vessel livery'. Current law requires that the records of a vessel livery related to hired vessels be preserved for at least 30 days after the vessel is to be returned to the vessel livery. The act extends this period to 3 years after the vessel is to be returned to the vessel livery. Current law provides that an individual who violates provisions related to the minimum age of motorboat operators is subject to a fine of $100. Under current law, a unit owner in a homeowners' association (HOA) may notify the HOA that the unit owner prefers to receive correspondence and notices from the HOA in a language other than English. The HOA is then required to send the unit owner correspondence and notices in both English and the preferred language.The bill:Authorizes the HOA to require that the unit owner first demonstrate the need for correspondence and notices in the preferred language before sending correspondence and notices to the unit owner in the preferred language; and Removes the requirement that the HOA send correspondence and notices to the unit owner in both English and the unit owner's preferred language, instead requiring that the HOA send the correspondence and notices only in the unit owner's preferred language.(Note: This summary applies to this bill as introduced.)

Colorado law exempts the owner of a motor vehicle who is a member of the United States armed forces (member) from motor vehicle registration fees and sets the specific ownership tax at $1 while the member is serving outside the United States. This applies to personal motor vehicles and intrastate trucks, truck tractors, trailers, and semitrailers used to transport property. To qualify, the member must show the military order or evidence acceptable to the department of revenue (department) demonstrating that the member served outside the United States. The act repeals a requirement that the member sign an affidavit to qualify for the $1 specific ownership fee or to be exempt from the motor vehicle fee. Colorado law exempts members from paying late fees for failing to renew a registration for a vehicle if the member was serving outside the state when the registration period expired. The act sets the requirement to qualify for a late fee exception by requiring the member to show the military order or evidence acceptable to the department demonstrating that the member served outside of the state. The act corrects technical defects and incorrect cross-references in certain statutes administered by the department of revenue as follows:Section 1 of the act amends the list of conditions a taxpayer must meet to claim a refundable income tax credit for certain businesses located in the state so that the list of conditions terminates correctly and conforms with standard drafting practices;Sections 2 and 4 correct outdated cross-references in the statute governing the collection of tax on gasoline and special fuels and the statute governing the road usage fee and bridge and tunnel impact fee;Section 3 clarifies the amount that can be claimed for a property tax or rent assistance grant and a heat or fuel expenses assistance grant based on the year the claim was made; andSection 5 removes the definitions for 'battery electric motor vehicle' and 'plug-in hybrid electric motor vehicle' from the statute that creates the high-performance transportation enterprise, as those defined terms do not otherwise appear in the statute.(Note: This summary applies to this bill as enacted.)

The act requires the state treasurer to make the following transfers to the general fund on June 30, 2026:$27,905,384 from the refinance discretionary account in the ARPA refinance state money cash fund;$4,085,246.49 from the revenue loss restoration cash fund;$1,974,702.20 from the economic recovery and relief cash fund;$1,005,850.24 from the behavioral and mental health cash fund; and$750,190.06 from the state highway fund. The act extends the deadline from December 31, 2026, to June 30, 2027, for the department of human services to spend money appropriated in 2022 from the behavioral and mental health cash fund for capital construction related to a youth neuro-psych facility at the Colorado mental health institute at Fort Logan. The act delays a corresponding transfer of money from the behavioral and mental health cash fund. The act reduces appropriations made in 2022 to the department of health care policy and financing by $800,000 and to the department of early childhood by $1,616,989.(Note: This summary applies to this bill as enacted.)

The act requires a state agency, defined as any department, commission, council, board, bureau, committee, institution of higher education, agency, or other governmental unit of the executive, legislative, or judicial branch of state government that receives an appropriation or is otherwise included in the annual general appropriation act, to submit a base budget for the upcoming state fiscal year to the joint budget committee and the office of state planning and budgeting (office) on or before September 1 of each year, beginning in 2026. The act excludes specific independent agencies within the judicial department from this requirement. For these excluded agencies, the office of administrative services for independent agencies must submit a single, consolidated base budget on their behalf. A base budget is defined as the total amount appropriated in the annual general appropriation act and other legislation enacted in the prior state fiscal year plus:Out-year costs or savings from legislation adopted in prior years that were not included in the appropriations for the preceding state fiscal year; and Budget adjustments from prior years that were not included in the appropriations for the preceding state fiscal year.A state agency is required to submit its base budget using a format agreed upon by state agencies and the office, in coordination with joint budget committee staff. The act also requires the director of the office, in collaboration with the executive director of the department of personnel, to provide information related to the office's calculations for common policies, as annually submitted in the governor's November 1 budget request, to the departments, institutions, and agencies of the executive, judicial, and legislative branches of state government as soon as practicable prior to the submission of the November 1 budget request.(Note: This summary applies to this bill as enacted.)
