Under Colorado law, a person is guilty of a crime for placing food or edible waste in the open to lure a wild bear. The act:Lowers the mental state requirement from intention to knowingly placing the food or edible waste in the open in circumstances where there is a reasonable probability of luring a wild bear;Repeals the requirement that a first offense be given a warning; andRaises the fine for a third or subsequent offense from $2,000 to $5,000.(Note: This summary applies to this bill as enacted.)

Beginning on or before July 1, 2028, the act extends certain application, accounting, and notice provisions already in place for federal survivor benefits awarded to a child or youth who is in foster care (child or youth) to federal supplemental security income benefits (SSI), which are monthly payments awarded to a child or youth with a disability and limited resources. The act adds requirements for a county department of human or social services (county department) to follow specified procedures for identifying a child or youth with a disability who may qualify for SSI and for documenting the disability. If the county department determines that a child or youth may be eligible to receive SSI, the county department is required to initiate the application process within 45 days after receiving certain information. If a child or youth is receiving SSI, the county department must document how the money is spent in the state's child welfare case management system. If legal custody of a child or youth receiving SSI or federal survivor benefits is transferring from a county department to another individual, the act requires the county department to reassess the designation of the representative payee or fiduciary receiving and managing federal benefits on behalf of the child or youth. The reassessment must be performed in consultation with interested parties and in compliance with federal requirements.(Note: This summary applies to this bill as enacted.)

The act directs the state treasurer to transfer $130 million from the state affordable housing fund (fund) to the general fund on June 30, 2026, and makes 3 corresponding adjustments to the affordable housing financing fund (financing fund). First, the act reduces the July 1, 2026, transfer from the fund to the financing fund by the amount of the June 30, 2026, transfer from the state affordable housing fund. Second, for the 2026-27 state fiscal year only, the act adjusts the prioritization of programs funded by the financing fund so that the programs are funded in the following order: The concessionary debt program, the affordable housing equity program, and the land banking program. Third, the act ensures that this transfer does not reduce the amount that may be spent on administrative expenses to implement programs funded by the financing fund in the 2026-27 state fiscal year and pools the costs of administering these programs between the administrator and the office of economic development for state fiscal years beginning with the 2026-27 state fiscal year. Under current law, if legislative council staff's March economic and revenue forecast projects that state revenue will not exceed the state fiscal year spending limit, the general assembly may reduce the funding allocated to the financing fund. The act allows for the general assembly to so reduce the funding allocated to the financing fund for the 2025-26 state fiscal year as a result of revenue forecasts projecting that state revenue will not exceed the state fiscal year spending limit.(Note: This summary applies to this bill as enacted.)

Under current law, the general fund reserve requirement is equal to 15% of the amount appropriated for expenditure from the general fund for that fiscal year minus:The difference between $100,000,000 and the proceeds of the sale of insurance premium and corporate tax credits that are credited to the health insurance affordability cash fund; andUnless money held in an escrow account in connection with the university of northern Colorado's college of osteopathic medicine is released, an additional $41,250,000. The act changes the repeal date of the employment support and job retention services program (program) in the division of employment and training (division) in the department of labor and employment (department) from September 1, 2029, to July 1, 2026. The state treasurer is required to transfer all unexpended and unencumbered money in the employment support and job retention services program cash fund (fund) to the general fund on June 30, 2026. Pursuant to section 3 of the act, the appropriations made in the annual general appropriation act for the 2026-27 state fiscal year to the department for use by the division are adjusted as follows:The general fund appropriation for the fund is decreased by $250,000; andThe reappropriated funds appropriation from the fund is decreased by $250,000. A reduction of an appropriation in the annual general appropriation act for the 2026-27 state fiscal year is not required pursuant to section 3 of the act if one of the following conditions is satisfied:The amount of the general fund appropriation to the department for use by the division for the fund is less than $250,000;The amount of the reappropriated funds appropriation from the fund to the department for use by the division for the program is less than $250,000; orThe annual general appropriation act for the 2026-27 state fiscal year does not include an appropriation to the department for use by the division for the fund or the program.(Note: This summary applies to this bill as enacted.)

Current law splits the program allocation to direct 50% of the money to the Colorado district attorneys' council to award grants to district attorneys' offices and 50% to the office of the state public defender.
