BITCOIN Act of 2025

Summary

The BITCOIN Act of 2025 would direct the U.S. Treasury Secretary to create a Strategic Bitcoin Reserve, a decentralized network of secure cold-storage facilities for federal Bitcoin holdings. The bill sets out detailed rules for custody, security, auditing, and reporting, including quarterly public proof-of-reserve attestations, independent third-party audits, and oversight by the Comptroller General. It also requires the government to account for Bitcoin received through forks and airdrops, hold those assets for at least five years before any disposition, and preserve the most valuable forked asset while allowing Congress to authorize exceptions for assets with novel utility or strategic value. The bill would also establish a large-scale Bitcoin Purchase Program under which the federal government would buy 200,000 Bitcoins per year for five years, for a total of 1,000,000 Bitcoins, subject to market-condition adjustments. All purchased Bitcoin would be placed into the Strategic Bitcoin Reserve and generally held for at least 20 years, with any later sales limited and intended primarily to help reduce the national debt. In addition to direct purchases, the bill allows the reserve to grow through federal agency transfers, forfeitures, gifts, bequests, and other lawful acquisitions. It also creates a voluntary program for states to store their Bitcoin in segregated accounts within the reserve while retaining title and assuming custody risk. The bill would amend several federal statutes, including the Federal Reserve Act, title 31 of the U.S. Code, and the Exchange Stabilization Fund provisions, to help finance and support the reserve. It lowers the amount of Federal Reserve surplus funds that may be retained, redirects certain Federal Reserve remittances and gold-certificate-related proceeds toward Bitcoin purchases, and authorizes the Exchange Stabilization Fund to hold Bitcoin and report Bitcoin-related activity. The legislation also includes a rule of construction protecting private property rights, stating that it does not authorize seizure of lawfully acquired Bitcoin or restrict private ownership, transfer, or self-custody of digital assets. The overall sentiment reflected in the bill text is strongly supportive of Bitcoin and digital-asset adoption, framing Bitcoin as a strategic reserve asset comparable to gold and as a tool for financial resilience, innovation, and U.S. competitiveness. Because there were no committee transcripts or recorded votes provided, there is no documented legislative debate or formal vote-based sentiment to assess beyond the bill’s own pro-Bitcoin findings and policy design. The main points of contention likely center on the scale and cost of the proposed purchases, the use of Federal Reserve remittances and gold-certificate proceeds to fund them, and the policy choice to hold a large government Bitcoin position for decades. Potential concerns also include market disruption, custody and cybersecurity risks, the role of the federal government in digital-asset markets, and whether the reserve could create speculative exposure for taxpayers. Supporters would likely emphasize transparency, diversification, and debt-reduction potential, while skeptics may question volatility, fiscal prudence, and the wisdom of treating Bitcoin as a strategic national reserve asset.

Impact

The bill would significantly expand federal law by creating a new Strategic Bitcoin Reserve, authorizing Treasury to acquire and custody large quantities of Bitcoin, and requiring new reporting, auditing, and proof-of-reserve procedures. It would amend the Federal Reserve Act, the Exchange Stabilization Fund statute, and related provisions of title 31 to redirect certain Federal Reserve resources and gold-certificate proceeds toward Bitcoin purchases and to require Bitcoin-related disclosures. It would also affect federal agencies that hold Bitcoin, require transfer of forfeited or otherwise controlled Bitcoin to Treasury, and create a voluntary state participation framework for segregated Bitcoin custody.

Sentiment

The bill’s tone is strongly favorable toward Bitcoin, digital assets, and long-term federal accumulation of Bitcoin as a reserve asset. The findings section presents Bitcoin as a hedge against monetary instability and a means of strengthening U.S. financial leadership, and the operative provisions are designed to institutionalize government ownership and transparent custody. No committee discussion or votes were provided, so there is no recorded bipartisan or partisan debate to summarize beyond the bill’s own affirmative framing.

Contention

Likely areas of contention include the proposal to buy up to 1,000,000 Bitcoins, the use of Federal Reserve remittances and gold-certificate revaluation proceeds to fund the program, and the risk of concentrating public funds in a highly volatile asset. Critics may also object to the federal government’s expanded role in digital-asset markets, the long mandatory holding periods, and the security/custody challenges of managing a national Bitcoin reserve. Supporters are likely to focus on transparency, diversification, debt reduction, and financial innovation, while opponents may question fiscal exposure and market effects.
