Infant Protection and Baby Switching Prevention Act of 2023 This bill establishes additional requirements that certain hospitals must meet in order to participate in Medicare. Specifically, as a condition of Medicare participation, hospitals and critical access hospitals that provide neonatal or infant care must have appropriate security procedures to reduce the likelihood of infant patient abduction and baby switching. Noncompliant hospitals are subject to specified civil penalties. The bill also establishes criminal penalties for knowingly altering or destroying a newborn's hospital patient records for the purpose of causing the newborn to be misidentified.

Regulations from the Executive in Need of Scrutiny Act of 2023 This bill revises provisions relating to congressional review of agency rulemaking. Specifically, the bill establishes a congressional approval process for a major rule. A major rule may only take effect if Congress approves of the rule. A major rule is a rule that has resulted in or is likely to result in (1) an annual effect on the economy of $100 million or more; (2) a major increase in costs or prices for consumers, individual industries, government agencies, or geographic regions; or (3) significant adverse effects on competition, employment, investment, productivity, innovation, or the ability of U.S.-based enterprises to compete with foreign-based enterprises. The bill generally preserves the current congressional review process for a nonmajor rule.

Separation of Powers Restoration Act of 2023 This bill modifies the scope of judicial review of agency actions to authorize courts reviewing agency actions to decide de novo (i.e., without giving deference to the agency's interpretation) all relevant questions of law, including the interpretation of (1) constitutional and statutory provisions, and (2) rules made by agencies. No law may exempt a civil action from the standard of review required by this bill except by specific reference to such provision.

Commercial Cabins for Cabinet Members Act This bill prohibits the Department of Transportation from using charter air transportation until Congress enacts a law that authorizes appropriations to carry out activities of the Federal Aviation Administration for FY2024.

Unmasking the Origins of COVID-19 Act This bill authorizes the Department of State to pay a reward for information leading to the identification of the origins of COVID-19 or other related information, such as the identification of individuals or entities involved in a cover-up of the origins of COVID-19.

Cyber Vulnerability Disclosure Reporting Act This bill requires the Department of Homeland Security to submit a report describing the policies and procedures developed to coordinate the disclosure of cyber vulnerabilities. The report shall describe instances when these policies and procedures were used to disclose cyber vulnerabilities in the previous year. Further, the report shall mention the degree to which the disclosed information was acted upon by stakeholders.

Stopping Abusive Student Loan Collection Practices in Bankruptcy Act of 2023 This bill requires a bankruptcy court to grant a debtor attorney's fees and the costs of the proceeding if (1) the debtor's student loan debt is discharged on the basis of undue hardship, and (2) the court finds that the creditor's position was not substantially justified.

Breath of Fresh Air Act This bill establishes a grant program for local educational agencies to purchase, and train school personnel to use, nebulizers.

Chisholm National Historic Trail and Western National Historic Trail Designation Act This bill designates (1) the Chisholm National Historic Trail, and (2) the Western National Historic Trail. The Department of the Interior shall administer any portion of these trails that is located on nonfederal land only (1) with the voluntary consent of the owner of the nonfederal land, and (2) if the portion qualifies for certification as a component of the applicable trail. The approval by an owner of applicable nonfederal land of a certification agreement shall satisfy the voluntary consent requirement. A certification agreement may be terminated at any time. The establishment of these trails does not authorize any person to enter private property without the consent of the private property's owner. Interior may accept a donation of land or an interest in land for these trails, with specified exceptions. Land or an interest in land may not be acquired for these trails by eminent domain or condemnation.

National Jazz Preservation, Education, and Promulgation Act of 2023 This bill establishes a National Jazz Preservation Program and a National Jazz Appreciation Program, to be carried out by the Smithsonian Institution through the National Museum of American History, to (1) preserve knowledge and promote education about jazz, and (2) further the appreciation of jazz music throughout the nation. The Smithsonian Institution shall (1) record interviews with leading jazz artists; (2) acquire, preserve, and interpret jazz artifacts; (3) continue to recognize Jazz Appreciation Month; (4) establish collaborative agreements for the sharing of such artifacts; and (5) encourage, consult with, and engage in capacity building with community-based and regional organizations with the potential to establish jazz archival collections. The bill amends the Elementary and Secondary Education Act of 1965 to allow the use of certain funds for programs to promote jazz education, which may include (1) a Jazz Artists in the Schools program, (2) a program for the development and distribution of educational materials about jazz and teacher training on jazz education, and (3) an Ambassadors of Jazz program. The Smithsonian Institution shall establish a series of jazz performances at Smithsonian affiliates that provides broad geographic access to jazz and supports public appreciation for the diversity of jazz music.

Bonuses for Cost-Cutters Act of 2023 This bill expands the awards program for cost-saving identifications by federal employees of fraud, waste, or mismanagement to include identifications of certain operational expenses that are wasteful (i.e., that are identified as wasteful by an employee and that an agency determines are not required for the purposes for which the amounts were made available). An agency must propose any identified wasteful expenses for rescission. The bill also doubles the maximum cash award that may be made under the program.

Fourth Amendment Restoration Act This bill limits surveillance conducted for foreign intelligence purposes. Specifically, the bill repeals provisions authorizing without a court order various types of searches and surveillance for foreign intelligence purposes, including electronic surveillance and access to business records. An officer of the U.S. government must obtain a warrant for certain search and surveillance activities against a U.S. citizen, including (1) conducting electronic surveillance, (2) conducting physical searches of property under a U.S. citizen's exclusive control, or (3) targeting a U.S. citizen to acquire foreign intelligence information. The bill provides for criminal penalties for a person who knowingly violates these requirements or otherwise obtains such information under color of law without statutory authorization. Information about a U.S. citizen acquired under Executive Order 12333 (relating to intelligence gathering) or during surveillance of a non-U.S. citizen shall not be used against the U.S. citizen in any civil, criminal, or administrative proceeding or investigation.

Real Justice for Our Veterans Act of 2023 This bill expands data collection on the effectiveness of veteran treatment court programs, incentivizes local governments to improve retention rates in veteran treatment court programs and drug court programs, and expands options for veterans to participate in drug court programs. First, the bill requires the Department of Justice (DOJ) to report on the effectiveness of veteran treatment court programs. The report must assess the population served by the programs, whether the programs use evidence-based treatments, the recidivism rates of participants, and program completion rates. The report must also assess whether women and racial and ethnic minorities have equal access to the programs and an equal opportunity to participate. Second, the bill requires DOJ's Bureau of Justice Assistance to implement a pilot program to make grants for local governments to improve retention in veteran treatment court programs and drug court programs. Finally, this bill allows a veteran (including a veteran who is a violent offender) to participate in a drug court program instead of a veteran treatment court program if a jurisdiction does not operate a veteran treatment court program.
