The Act lets people do pre-plea conditional discharge in more types of cases. (Flesch Readability Score: 63.4). Expands eligibility for pre-plea conditional discharge to all offenses except Ballot Measure 11 (1994) crimes and driving under the influence of intoxicants. Removes the requirements of specialty court acceptance and district attorney consent. Allows a defendant to have more than one discharge and dismissal after fulfilling the probation agreement.

The Act makes a new exemption against Oregon estate tax. (Flesch Readability Score: 61.3). Provides for an additional exemption against Oregon estate tax in order to account for inflation in the calculation of a taxable estate. Adjusts the amount of an exemption based on inflation. Allows an estate to file an amended return seeking a refund based on the operation of the exemption. Applies to the estates of all decedents who die on or after January 1, 2020. Takes effect on the 91st day following adjournment sine die.

Tells state agencies to buy common software through an online portal. Allows the agencies to buy the software through normal buying processes. Tells a state agency to start a program to give grants and loans to other state agencies so that they can replace their old computers and software, and for other purposes. Says that the agencies must pay back the moneys from cost savings. (Flesch Readability Score: 64.2). Requires contracting agencies to purchase common off-the-shelf software or other information technology products or services that do not require customization through an information technology marketplace portal. Authorizes the State Chief Information Officer to select and preapprove an information technology marketplace portal for use. Specifies features that the information technology marketplace portal must have. Exempts purchases through the information technology marketplace portal from the application of certain provisions of the Public Contracting Code. Requires the Oregon Department of Administrative Services to create a program to award grants and provide loans to state agencies for replacing outdated information technology and for certain other purposes. Creates an advisory board that the department must consult in awarding grants and providing loans. Establishes the Technology Modernization Fund and appropriates moneys in the fund to the department for the purpose of the department's program. Declares an emergency, effective on passage.

The Act would allow the DOC to hire some retired staff under specific conditions. (Flesch Readability Score: 65.7). Authorizes the Department of Corrections to hire retired corrections officers subject to specific conditions. Sunsets on January 1, 2032.

The Act requires a GPS tracker that notifies the victim for a person charged with or convicted of a DV crime. (Flesch Readability Score: 68.6). Requires that a person on pretrial release for a crime constituting domestic violence wear a location tracking device that provides real-time location alerts to the victim and law enforcement agencies. Specifies an exception. Requires as a supervision condition of probation or post-prison supervision that the defendant wear a location tracking device that provides real-time location alerts to the victim and law enforcement agencies for the first 90 days of supervision. Specifies an exception.

The measure makes changes to LBPR 27 to limit the role of secrecy in investigations made under the rule. The measure says that a person being investigated has a right to a lawyer, with the costs paid for by the LEO, a right to discover evidence and question witnesses and a right to appeal to a court. The measure makes changes to the standard of proof for facts. (Flesch Readability Score 60.6). Modifies Legislative Branch Personnel Rule 27 to eliminate confidential reports or information being used for investigations performed under the rule by requiring disclosure at conclusion of investigation. Authorizes an investigation respondent to obtain independent counsel to be paid for by the Legislative Equity Officer. Provides that an investigation respondent has the right to discover evidence and depose witnesses. Requires that findings of fact must be established beyond a reasonable doubt. Provides that a respondent who is subject to remedial measures has the right to appeal the determination to a court for de novo judicial review. Provides that a person subject to the rule may not be accused of violating the rule for the same conduct that was previously not found to violate the rule.

The Act would let a surviving spouse claim the unused amount of the first spouse's estate tax exclusion. (Flesch Readability Score: 66.3). Allows an exclusion from the Oregon taxable estate of a surviving spouse for the unused portion of exclusion that applied to the prior deceased spouse of the decedent. Applies to estates of decedents who die on or after January 1, 2026. Takes effect on the 91st day following adjournment sine die.

This Act relaxes the rules that relate to home prices for lands that are being added to a smaller city's UGB through a temporary program. (Flesch Readability Score: 63.0). Allows a city with a population of 20,000 or fewer to bring lands into its urban growth boundary, under a temporary program, under lower requirements for the percentage of affordable housing.

The Act tells DAS to look at more cost effective ways for agencies to get translation services and make a report. (Flesch Readability Score: 68.0). Requires the Oregon Department of Administrative Services to study more cost effective ways for state agencies to procure translation services. Directs the department to submit findings to the interim committees of the Legislative Assembly related to general government no later than September 15, 2026. Sunsets on January 2, 2027.

The Act tells school districts and certain private schools to designate sports by gender. The Act forbids males from playing in female sports. (Flesch Readability Score: 77.4). Requires school districts and certain private schools to designate athletic competitions and extracurricular sports according to biological sex. Prohibits biological males from participating in athletic competitions or extracurricular sports designated for biological females. Provides causes of action for students, school districts and private schools.

The Act creates new requirements for people applying to ODHS to provide services. (Flesch Readability Score: 63.4). Creates new requirements for the application process for a license, certificate, endorsement or authorization from the Department of Human Services for various providers of services to children, older adults and individuals with disabilities, and individuals with intellectual or developmental disabilities. Prohibits new applications within one year after a revocation or denial of a license, certificate, endorsement or authorization. Requires the department to report to the Legislative Assembly about the number of hours and cost to the department required to process initial and renewal applications. Takes effect on the 91st day following adjournment sine die.

The Act tells DHS to do certain things when preparing caseload forecasts. (Flesch Readability Score: 60.7). Directs the Department of Human Services to prepare accurate caseload forecasts of the older adults and individuals with disabilities who will be served by the department during the biennium and projections for the workload needed to serve those individuals that take into account specified factors. Requires the department to report any changes during the biennium to the Legislative Assembly.
