AN ACT TO AMEND SECTION 31-7-14, MISSISSIPPI CODE OF 1972, TO ESTABLISH A PILOT PROGRAM AUTHORIZING THE USE OF PERFORMANCE-BASED CONTRACTS TO IMPROVE, OPERATE AND MAINTAIN PUBLIC FACILITIES ON COMMUNITY AND JUNIOR COLLEGE CAMPUSES; TO PROVIDE THAT THE PROGRAM SHALL OPERATE FOR NO MORE THAN SEVEN YEARS, SUBJECT TO EXTENSION OR EXPANSION BY THE LEGISLATURE; TO DEFINE "FACILITIES PERFORMANCE CONTRACT"; TO EXPAND THE DEFINITION OF "SAVINGS"; TO WAIVE THE PAYBACK PERIOD LIMITATION; TO PROVIDE THAT A FACILITIES PERFORMANCE CONTRACT UNDER THIS ACT MAY INCLUDE LONG-TERM OPERATION, MAINTENANCE, REPAIR, REPLACEMENT AND MANAGEMENT SERVICES; TO REQUIRE CERTAIN PROVISIONS IN EACH CONTRACT UNDER THIS ACT; TO PROVIDE FOR PROCUREMENT; TO CREATE REPORTING REQUIREMENTS; AND FOR RELATED PURPOSES.
