Public safety. Provides that a person who knowingly, intentionally, or recklessly operates a vehicle in a repeated or continuous manner with the intent of causing a rotational skid commits reckless driving, a Class B misdemeanor, and increases the penalty if certain circumstances apply. Specifies that a person may request specialized driving privileges even after the initial hearing. Specifies that a vehicle used to commit reckless driving involving a rotational skid or obstruction of traffic involving a rotational skid is subject to seizure for purposes of civil forfeiture if the person has a prior unrelated conviction for the offense. Increases the penalty for resisting law enforcement to a Level 5 felony if a person operates a vehicle in a manner that creates a substantial risk of bodily injury to another person. Makes conforming amendments.

Excellence in civic engagement designation and school meetings. Requires the department of education (department), in collaboration with the commission for higher education and subject to the approval of the state board, to establish an excellence in civic engagement designation. Requires the department to develop recommendations for an excellence in civics education designation for schools. Provides that the public hearing required before a school employer and school employee may privately negotiate certain matters may take place at a regular or special meeting of the school's governing body.

Water and wastewater utility infrastructure. Amends the statute concerning the acquisition by a utility company of a water or wastewater utility to provide that if: (1) the appraised value of the utility property to be acquired does not exceed $3,000,000; and (2) the purchase price for the utility property is less than the appraised value of the utility property; the acquiring utility company may submit to the Indiana utility regulatory agency (IURC) a filing under a procedure, based on the procedures set forth in the IURC's rules governing 30 day administrative filings, to include in the acquiring utility company's rate base specified costs associated with the acquisition. Sets forth certain information that must be included in an acquiring utility company's filing. Provides that if the IURC approves an acquiring utility company's filing, the IURC: (1) may only authorize that: (A) the full purchase price; and (B) estimated: (i) incidental expenses; and (ii) other costs of acquisition; be recorded as the acquiring utility company's net original cost of acquisition; and (2) shall provide that any estimated: (i) incidental expenses; and (ii) other costs of the acquisition; are subject to a reasonableness review as part of the acquiring utility company's next base rate case. Adds language specifying that the Indiana Code chapter that governs the transfer, acquisition, and improvement of utilities by municipalities applies to a municipally owned natural gas utility (in addition to a municipally owned electric, water, wastewater, or combined water and wastewater utility).

Recognizing May as Mental Health Awareness Month and the work of Mental Health America. A CONCURRENT RESOLUTION recognizing May as Mental Health Awareness Month and the work of Mental Health America.

Marion County small claims courts. Increases the amount to be distributed to a township trustee from certain fees that are collected in a Marion County small claims case. Makes conforming changes.

Directory of approved vaping products. Requires manufacturers of alternative nicotine products and vapor products to annually certify their products with the department of state revenue (department). Requires the department to establish and maintain a directory on the department's website of all manufacturers of alternative nicotine products and vapor products. Provides that, if an alternative nicotine product or vapor product is removed from the directory, each retail dealer, distributor, or wholesaler has 21 days from the day the product is removed from the directory to remove the product from its inventory and return the product to the manufacturer for disposal. Provides that, after the 21 day period, the alternative nicotine products or vapor products of a manufacturer identified in the notice of removal are contraband and are subject to seizure, forfeiture, and destruction and may not be purchased or sold in Indiana. Provides the department with certain enforcement authority. Provides that all fees and penalties collected by the department must be used by the department to administer the directory and enforce the requirements associated with the directory. Provides that any alternative nicotine products or vapor products offered for sale in violation of the directory requirements are declared to be contraband and may be seized without a warrant by the department or by any law enforcement agency in Indiana if directed by the commissioner of the department. Provides that a person may not advertise, distribute, market, offer for sale, or sell a vapor product by using, in a trademark of the product or in the product's advertising branding, design, marketing, or packaging, certain terminology that is attractive to minors. Requires the department to submit an annual report to the general assembly. Provides that a violation of the directory requirements constitutes a deceptive act that may be enforced by the attorney general.

Quality of life initiatives grant fund. Establishes the quality of life initiatives grant fund (fund) July 1, 2025, to provide grants to local units for eligible projects. Defines an "eligible project" as a project that would improve the quality of life or quality of place factors for residents of a local unit, including access to child care, health care, and technology, and creation of recreation or green spaces. Requires a local unit to: (1) have a current comprehensive plan; and (2) before choosing an eligible project, collaborate with the community to determine the local unit's priorities for improving the quality of life or quality of place factors for residents; before applying for a grant from the fund. Establishes the fund board to evaluate applications and award grants from the fund. Provides that money in the fund is continuously appropriated. Makes an appropriation.

Fiduciary duty in health plan administration. Provides that any third party administrator, pharmacy benefit manager, employee benefit consultant, or insurance producer acting on behalf of a plan sponsor owes a fiduciary duty to the plan sponsor.

Assignment of offenders based on biological sex. Provides that the department of correction shall assign an offender, including a delinquent offender, to a facility or program that is based on the offender's biological sex at birth in accordance with the offender's genetics and reproductive biology.

Reimbursement for prosthetic and orthotic devices. Provides that, after June 30, 2025, orthotic devices are provided under Medicaid. Requires the office of the secretary of family and social services to apply for any state plan amendment or waiver necessary to include prosthetic and orthotic devices under Medicaid. Specifies that a minor may receive a prosthetic or orthotic device for the recipient's medical needs. Requires reimbursement for the replacement of an orthotic device or a prosthetic device for a minor for certain reasons.

Emergency powers. Provides that in the event of a disaster emergency, an emergency order issued by a state agency must be narrowly tailored to serve a compelling public health or safety interest. Entitles a person to relief if a court determines that the person seeking judicial relief has been prejudiced by an agency action issued during a disaster emergency that has not been: (1) applied equally to a similarly situated person; and (2) narrowly tailored to serve a compelling public health or safety interest. Provides that the orders, rules, and regulations made, amended, or rescinded by the governor must be narrowly tailored to serve a compelling public health or safety interest. Requires any state or local agency, including the Indiana department of health and local boards of health, to only impose a restriction that is narrowly tailored to serve a compelling public health or safety interest. Provides that any order or proclamation declaring, continuing, or terminating a local disaster emergency must be narrowly tailored to serve a compelling public health or safety interest. Provides that, if the disaster that is the basis of the emergency order impacts an area of the state that does not exceed the lesser of: (1) 31 counties; or (2) an area that is inhabited by less than 33 1/3% of the population of Indiana; the state of emergency expires in 30 days. Provides that the governor may renew the emergency declaration in 30 day increments not to exceed a period of 12 months. Provides that all other emergency declarations expire 30 days after the initial date of the governor's executive order and may not be renewed or extended by the governor without the approval of the general assembly. Removes the governor's ability to suspend certain provisions relating to the general assembly, judicial relief of an agency action during an emergency declaration, or provisions relating to emergency management disasters.

Medicaid work requirements. Sets forth work requirements for certain individuals in order to be eligible for Medicaid. Makes exceptions. Requires the office of the secretary of family and social services to apply for any state plan amendment or Medicaid waiver necessary and to continue to apply for the plan amendment or waiver request if the plan amendment or waiver is denied by the United States Department of Health and Human Services.
