Cause of action for civil rights violations. Prohibits a governmental entity (entity), including a state educational institution (institution), from discriminating against persons: (1) over the exercise of rights provided or protected by the Constitution of the United States; or (2) by granting preferential treatment to any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting. Specifies certain exemptions. Provides that prohibited discrimination may be asserted as a claim or defense in a judicial or administrative proceeding regardless of whether the relevant entity or institution is a party to the proceeding. Provides that, if the relevant entity or institution is not a party to a proceeding, the relevant entity or institution has an unconditional right to intervene in order to respond to an action or claim alleging discrimination. Specifies certain awards and remedies. Defines certain terms.

Minimum wage. After December 31, 2022, increases the minimum wage paid to certain employees in Indiana from $7.25 an hour to $15 an hour. Provides that after December 31, 2023, and each subsequent December 31, the hourly minimum wage increases at the same percentage as any increase in the Consumer Price Index for the preceding calendar year. Makes technical corrections and conforming amendments.

Prohibits a court or the operator of a case management system from disclosing information relating to an eviction action: (1) if the case is dismissed or if the tenant prevails in the action or upon appeal; or (2) upon order of the court after a petition to prohibit disclosure is made by the tenant: (A) not earlier than seven years after a judgment of eviction against the tenant becomes final; or (B) at least one year after the case was filed if the case remains pending with no judgment.

County treasurer duties. Provides that a charitable nonprofit foundation established to hold the proceeds of the sale of certain county hospitals may provide for compensation of the foundation's chairperson. (Under current law, the county treasurer is the foundation's chairperson and the members of the board of the foundation serve without compensation.) Provides that: (1) the county treasurer's service as the board's chairperson is considered to be part of the county treasurer's duties as county treasurer; (2) the chairperson may not vote on, or otherwise participate in, any board action relating to the compensation of the chairperson; (3) if the board provides for the payment of compensation to the chairperson, the compensation is considered to be part of the county treasurer's compensation as county treasurer; and (4) the amount of compensation paid by the foundation is in addition to the salary paid by the county to the chairperson as county treasurer.

Requires an insurer to provide a self-funded health plan with the opportunity to include its information as part of the insurer's reported aggregate information.

Bereavement and parental leave. Provides three days of paid leave for an employee of a state agency or a political subdivision to attend the funeral of the employee's relative or grieve the death of the employee's relative or a miscarriage experienced by the employee or the employee's spouse. Provides 150 hours of paid leave for a full-time employee of a state agency or a political subdivision and 75 hours of paid leave for a part-time employee of a state agency or a political subdivision upon: (1) the birth of the employee's child; (2) the birth of a child to the employee's spouse; (3) the placement of a child for adoption with the employee; or (4) the stillbirth of the employee's child. Provides unpaid leave of not more than 10 working days for an employee under certain circumstances related to the death of the employee's child, a stillbirth, or a miscarriage. Prohibits an employer from taking an adverse employment action against an employee who exercises the rights provided by the unpaid leave requirements. Allows the department of labor to collect civil penalties if an employer violates the unpaid leave requirements. Provides that an employee may bring a civil action against an employer to enforce the unpaid leave requirements.

Various education matters. Requires the department of education (department) to apply to the United States Department of Education for assessment flexibility. Requires the department to: (1) prepare a report that includes information and recommendations regarding establishing and implementing a parent-teacher compact program; and (2) submit the report to the legislative council not later than November 1, 2022. Provides that the state board of education (state board) shall, in consultation with postsecondary educational institutions and various businesses and industries, identify what skills or traits students need to be successful upon completion of high school. Requires the department to conduct a research study regarding academic standards. Requires the department to establish an online adjunct teacher portal. Provides that the governing body of a school corporation may issue an adjunct teacher permit to an individual who meets certain requirements. Establishes requirements for adjunct teacher employment agreements. Provides that the employment agreements are not subject to certain requirements regarding teacher salaries and school corporation local compensation plans. Provides that: (1) an adjunct teacher is not a school employee for purposes of collective bargaining; and (2) an employment agreement with an adjunct teacher is not subject to a collective bargaining agreement. Provides that the school employer shall discuss the use of adjunct teachers with the exclusive representative of certificated employees. Requires the governing body of a school corporation to announce any vacant adjunct teacher positions at meetings of the governing body. Amends the definition of "primary use of the building" for certain applicable high schools for purposes of occupancy classification requirements. Amends the definition of "appropriate vehicle". Provides that a special purpose bus or an appropriate vehicle may be used to transport students under certain circumstances. Provides that the state board may adopt emergency rules relating to school accreditation. Provides that the driver of a special purpose bus or an appropriate vehicle must pass an expanded criminal history check and an expanded child protection index check. Makes changes to visual acuity requirements for a bus driver. Establishes the Indiana student enrichment grant program (program). Provides that an enrichment student is eligible to establish an Indiana enrichment scholarship account. Provides that an enrichment student may receive $1,000 to be used for certain qualified expenses. Provides that the department shall administer the program. Provides that the program expires July 1, 2025.

School board elections. Requires candidates for school board offices to be nominated in the same manner as candidates for all other elected offices are nominated, beginning after 2022. Provides that for school board offices elected in 2022, the political affiliation of each candidate, or the candidate's statement that the candidate is an independent candidate, must be stated on the ballot. Provides that the current statute relating to nomination of candidates for school board offices expires on January 1, 2023. Repeals other superseded statutes. Makes conforming changes.

Insurance matters. Specifies that the compliance of a practitioner and facility with federal law meets the good faith estimate requirements concerning health service costs. Reduces, from 1% to 0.15%, the lowest interest rate that an insurer may use in determining the minimum nonforfeiture amounts for an annuity contract. Provides that, as a condition of license renewal, a limited lines producer with a title insurance qualification must complete at least seven hours of continuing education in any combination of the following subjects: (1) Ethical practices in the marketing and selling of title insurance, including provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act. (2) Title insurance underwriting. (3) Escrow matters. (4) Matters concerning regulation by the department of insurance. (5) Marketing and selling of title insurance. Allows a property and casualty insurance company to offer property and casualty insurance on a group basis to ten or more commercial, business, or not-for-profit entities that have a preexisting relationship to one another through a common trade, an association, an affiliation, or another organizational relationship that is separate and distinct from any group insurance arrangement of the group. Amends the definition of "health payer" for the all payer claims data base. Provides that an insurer, to operate as a farm mutual insurance company, may not have annual direct written premiums of more than $15,000,000 (instead of $10,000,000). Provides that, except for grandfathered health plans, an accident and sickness insurance policy or health maintenance organization contract must cover or provide: (1) a colorectal cancer screening test assigned either an "A" or "B" grade by the United States Preventive Services Task Force; and (2) a follow-up colonoscopy.

Air pollution. Defines "odor nuisance" as a situation in which the repeated or persistent discharge into the outdoor atmosphere of air contaminants causes an odor that: (1) substantially obstructs the free use of property; or (2) is injurious to human health. Requires the environmental rules board (board) to adopt administrative rules that: (1) establish a means of determining when an odor nuisance exists; and (2) identify practical and economically feasible methods of eliminating odor nuisances at their source. Sets forth certain: (1) means of determining when an odor nuisance exists; and (2) methods of eliminating odor nuisances; that the board may include in the rules. Authorizes the commissioner of the department of environmental management (commissioner) to order a person that creates an odor nuisance in a city to implement one or more of the methods of eliminating the odor nuisance. Provides that a person who violates an order of the commissioner is subject to a civil penalty. Authorizes the department of environmental management to bring a civil action to enjoin a person's violation of an order of the commissioner. Provides that one or more persons adversely affected by a purported odor nuisance in a city may bring an action to abate the purported odor nuisance. Provides that if the commissioner issues an order under the air pollution control laws directing a person to cease and desist, imposing a monetary penalty, mandating corrective action, or revoking or modifying a permit, and if the commissioner's order is stayed during an administrative appeal, the stay of the order expires not more than 180 days after it begins. Provides that if the commissioner's order is later determined to have been an abuse of discretion, arbitrary and capricious, contrary to substantial or reliable evidence, or contrary to law, the effects of the order will be reversed.
