This act continues the existence and functioning of the Alabama Sickle Cell Oversight and Regulatory Commission pursuant to the Alabama Sunset Law until October 1, 2030. This act amends Section 22-10B-1, Code of Alabama 1975, to: (1) establish the commission as a division within the Alabama Department of Public Health; (2) require the department to provide certain administrative services to the commission; (3) authorize the department to hire individuals necessary for the commission; (4) transfer all property of the commission to the department; and (5) change the requirement that commission members serve subject to Senate confirmation to serving when appointed, unless rejected by the Senate. This act also repeals Section 22-10B-7, Code of Alabama 1975, relating to the applicability of Chapter 10B, Title 22, Code of Alabama 1975, to the department.

This act amends Sections 41-9-590, 41-9-594, 41-9-625, and 41-9-650, and adds Sections 41-9-650.1, 41-9-650.2, 41-9-650.3, 41-9-650.4, and 41-9-650.5 to, the Code of Alabama 1975, to: (1) require arresting agencies to collect certain biometric identifiers of arrested individuals, authorize detaining agencies to collect certain biometric identifiers of detained individuals, subject to deletion upon the individual's release, and require agencies recovering unidentified human corpses to collect certain biometric identifiers of corpses; (2) require the Alabama State Law Enforcement Agency (ALEA) to establish, and provide operational procedures for, the Alabama Background Check Service for authorized persons to obtain individuals' background checks for noncriminal purposes; (3) authorize ALEA to perform background checks for noncriminal justice purposes for certain entities, subject to conditions including the subject of the check may not be under 18 years of age and must consent to the sharing of information; (4) authorize the Secretary of ALEA to establish and collect fees for these noncriminal justice purpose background checks; (5) authorize ALEA to establish the Alabama Rap Back Program to notify participating entities, for a fee not exceeding $12, of criminal history updates for enrolled individuals; and (6) provide the misuse of a background check report is a Class B felony. This act also repeals Article 4, Chapter 2 of Title 32, Code of Alabama 1975, regarding the dissemination of criminal history information.

This act amends Sections 40-26B-71, 40-26B-73, 40-26B-77.1, 40-26B-79, 40-26B-80, 40-26B-81, 40-26B-82, and 40-26B-84, Code of Alabama 1975, to remove all statutorily provided sunset dates in order to make the hospital provider privilege tax permanent. This act also repeals Section 40-26B-88, Code of Alabama 1975, which established a termination date of September 30, 2028, for the hospital provider privilege tax.

This act continues the existence and functioning of the Alabama State Board of Pharmacy pursuant to the Alabama Sunset Law until October 1, 2027. This act also amends Section 34-23-90, Code of Alabama 1975, to: (1) revise the nominating authorities for certain board appointments; and (2) require that if a nominating authority does not nominate an individual to fill a vacant position on the board within 45 days of the vacancy, the applicable appointing authority shall appoint a board member within 45 days of the nominating entity failing to nominate an individual.
