This act amends Section 41-9-548, Code of Alabama 1975, to provide that employees of the Governor's Mansion Authority are: (1) members of the unclassified service for purposes of state employment; and (2) entitled to payment of accumulated leave upon separation of service, depending on dates of service.

City of Alabaster; weed nuisance, abatement authorized, procedures established

This act is the Decentralized Unincorporated Nonprofit Association Law. This act adds Article 2 to Chapter 17, Title 10A, Code of Alabama 1975, to: (1) establish decentralized unincorporated nonprofit associations as a business organization form; (2) provide for the formation and management of associations; (3) authorize associations to engage in certain actions, including profit-making activities if those profits are used in furtherance or set aside for the association's common purpose; (4) establish rights and powers of associations regarding their separate legal status, acquiring and conveying property, entering into contracts, legal proceedings, and service of process; (5) establish rights and duties of associations regarding internal governance, including using distributed ledger technology and algorithmic means to validate records and establishing processes or procedures for making organizational decisions; (6) establish the rights of association members and limitations that may be placed on their liability; and (7) provide for association administrators, indemnification of members, insurance for members and administrators, recordkeeping, and dissolution, winding up, and mergers of associations. This act also designates Sections 10A-17-1.01 through 10-17-1.18, Code of Alabama 1975, as Article 1 of Chapter 17, Title 10A.

This act is the Alabama Property Protection Act of 2026. This act adds Chapter 19J to Title 8 and Chapter 21 to Title 35, Code of Alabama 1975, adds Sections 8-6-61, 12-13-55, and 13A-9-23 to the Code of Alabama 1975, and amends Sections 6-6-540, 6-6-545, 6-6-571, 13A-9-12, 13A-9-22, 36-20-73, and 36-20-73.1, Code of Alabama 1975, to: (1) authorize the Alabama Securities Commission to investigate, adjudicate, and take specified enforcement actions, including levying civil penalties, against residential title fraud violators; (2) authorize the commission, in conjunction with judges of probate, to fund and administer a statewide real property notification alert system; (3) authorize the commission to order proceeds derived from fraudulent real estate conveyances as determined by the commission to be forfeited and deposited into the Alabama Title Fraud Recovery Fund and levy a $10,000 civil penalty for violating such an order; (4) prohibit real estate agents from agreeing to sell or lease, and settlements agents from closing on, certain residential property unless the seller's identity and ownership rights are verified; (5) provide for an expedited quiet title complaint process based on fraudulent title conveyance; (6) provide for appeals of the commission's administrative orders to the circuit court; (7) establish the Alabama Title Fraud Recovery Fund to be administered by the commission to compensate parties injured by fraudulent conveyances, subject to certain criteria; (8) authorize the commission to levy civil penalties of up to $100,000 per fraudulent title conveyance transaction; (9) establish the crime of aggravated fraudulent sale or lease of residential property when a person knowingly lists a property for sale or lease without the authority to do so and either receives money from the sale or the victim is 70 years of age or older, the penalty for which is a Class C felony; (10) require online real estate platforms to verify ownership before listing properties for sale or lease which are not listed with a licensed real estate broker; (11) require online real estate platforms to remove public photos of properties not for sale upon the request of a verified owner; (12) provide that a plaintiff in a quiet title action based upon a fraudulent conveyance is entitled to recover all costs of bringing the action, including attorney fees; (13) require a judge of probate’s order granting a petition for expungement of a false or fraudulent lien, deed, or other instrument to contain certain relevant information; (14) increase the penalty for the crime of fraudulent sale or lease of residential real property from a Class A misdemeanor to a Class D felony; (15) provide that a notary public is not obligated to perform a notarial act if he or she believes it is illegal, false, deceptive, or coercive or the individual's demeanor casts doubts as to their knowledge of the consequences; (16) require a notary public remotely notarizing documents to verify the identity of a signatory and his or her understanding and competence to sign, notify the signatory that the proceedings are being recorded, and verify that the signatory is located within the United States; and (17) require a remote notary to refuse to perform a remote notarial act if the signatory appears to lack knowledge of the consequences of their actions or the image of the signatory appears to be artificially generated or the communication method is unsecure.

"This act amends Sections 28-3-1, 28-3A-7, and 28-12-45, Code of Alabama 1975, to: (1) clarify that persons licensed by the Alcoholic Beverage Control Board as an importer may import into this state alcoholic beverages manufactured in another state or country; (2) change the start of the license year for importer licensees from January 1 to October 1; and (3) add to those persons that may be issued a consumable hemp products retailer license by the board, those persons that possess a board permit to operate as a specialty retailer of electronic nicotine delivery systems.

This act amends Sections 11-20-71, 11-20-73, and 11-20-81, Code of Alabama 1975, to: (1) require boards of directors of agriculture authorities incorporated before January 1, 2022, to appoint a successor when a director vacates his or her office before his or her term expires; (2) remove the authority of director appointing authorities to clarify director term length; (3) authorize agriculture authorities to purchase or otherwise obtain goods through purchasing cooperatives sponsored by the National Association of Counties or other national or regional cooperative purchasing program using competitive procurement processes; and (4) add county and municipal tax proceeds from alcohol sales and local lodging taxes collected by entities operating lodging accommodations made available by an authority to those rebated to authorities.

This act amends Sections 40-18-417.1, 40-18-417.2, and 40-18-417.3, Code of Alabama 1975, to: (1) allow sites owned by one or more local economic development entities to qualify for Growing Alabama tax credits if all parties listed on the deed are eligible applicants; (2) require all eligible co-applicants owning a site to submit a joint application and conflict of interest policy; and (3) require all approved co-applicants to be jointly and severally liable for the disposition of funds and required reporting.
