This act amends Sections 19-3B-505 and 19-3B-816, Code of Alabama 1975, to: (1) remove the treatment of holders of the power of withdrawal from an irrevocable trust as settlors when the power lapses, is released, or waived for purposes of creditors reaching a settlor's interests in the trust; (2) provide a beneficiary of an irrevocable trust holding a power of withdrawal is not a settlor upon the power lapsing; (3) authorize trustees to pay or reimburse a settlor's personal income tax liabilities for a trust's principal and income and provide such payment or reimbursement is not considered amounts distributed to or for the settlor's benefit; and (4) provide that beneficiaries, including previous settlors, who acquire an interest in a trust through the exercise of a power of appointment by another are not deemed settlors.

This act: (1) beginning January 1, 2027, exempts mobile food units from county and municipal health and fire inspections if a unit holds a valid health inspection certificate from the health department of the county of the permitted food establishment to which the unit returns after daily operation and a valid fire inspection certificate from a local fire department authorized to inspect mobile food units by the State Fire Marshal; (2) requires the State Fire Marshal to establish a statewide uniform fire inspection process for mobile food units, to include specified criteria, and maintain a list of certifying local fire inspectors; (3) provides that health and fire officials are not precluded from inspecting mobile food units and taking certain actions, including ordering to cease operation, if significant health issues are present; and (4) provides that operating a mobile food unit without valid health and fire inspection certificates is a Class C misdemeanor and that a subsequent violation prohibits operating for 30 days.

This act: (1) amends Section 12-19-290, Code of Alabama 1975, to add providing for the general operation of state courts as determined by the Administrative Director of Courts to the permissible uses of the Administrative Office of Courts Advanced Technology and Data Exchange Fund; and (2) establishes the Supreme Court Advanced Technology and Data Exchange Fund, Court of Civil Appeals Advanced Technology and Data Exchange Fund, and the Court of Criminal Appeals Advanced Technology and Data Exchange Fund in the State Treasury to consist of fees associated with the appellate court case management system, legislative appropriation, and transfers from the Administrative Office of Courts Advanced Technology and Data Exchange Fund to be expended by each respective court for administration of justice activities.

This act amends Sections 34-7B-1 and 34-7B-13, Code of Alabama 1975, relating to licensure by the Alabama Board of Cosmetology and Barbering, to: (1) remove braiding and weaving hair from the definition of "cosmetology"; (2) remove satisfaction of licensure requirements from the definition of "natural hairstylist"; (3) provide that persons practicing natural hair styling and facilities where only natural hair styling is practiced are not required to be licensed by the board; and (4) to provide that qualified persons and public high school students enrolled in a career and technical education cosmetology program may obtain a voluntary natural hairstylist license.

This act amends Sections 34-24-140 and 34-24-160, Code of Alabama 1975, to: (1) remove graduation from a chiropractic school that required in-person attendance to graduate from the prerequisites to serve on the State Board of Chiropractic Examiners; and (2) remove the requirement that applicants for licensure by the board must have graduated from a school that teaches only attendance courses and requires a four-year standard college course.

This act amends Sections 8-32-1, 8-32-3, 8-32-5, Code of Alabama 1975, to: (1) authorize annual fees paid to the Commissioner of Insurance by providers of service contracts sold in this state to be adjusted according to the Consumer Price Index; and (2) require all such collected fees be deposited into the Special Examination Revolving Fund in the State Treasury instead of the Service Contract Revolving Fund. This act also requires all unencumbered and unexpended funds remaining in the Service Contract Revolving Fund on October 1, 2026, to be transferred to the Special Examination Revolving Fund.

This act amends Section 16-40A-2, Code of Alabama 1975, to: (1) require the teaching of sexual risk avoidance and the advantages of avoiding nonmarital sexual activity in public school programs including sex education or human reproduction; (2) prohibit course materials introducing concepts related to sexual behavior to students in kindergarten through fourth grade; (3) require sex education or human reproduction course materials to include certain information, including on abortion, infant adoption, surrendering newborns, unhealthy relationships, exploitation and peer pressure, and impacts of youth pregnancies and disease infections; (4) authorize parents to opt children out of sex or human reproduction education; (5) prohibit this curricula from demonstrating contraceptive use or providing explicit materials and information on obtaining abortions; (6) prohibit local school boards from contracting with persons to provide sex education who support abortions or do not endorse sexual risk avoidance; and (7) authorize enforcement by the Attorney General.

This act amends Section 34-14A-19, Code of Alabama 1975, to: (1) provide that the written disclosure as to whether a residential home builder has liability insurance before building a home may be an incorporated provision within an original contract or a separate addendum; (2) if the disclosure is that the home builder has liability insurance, require the disclosure to be signed or initialed, including electronically, by the home builder and homeowner without a witness; and (3) if the disclosure is that the home builder does not have liability insurance, require the disclosure be signed by the home builder and homeowner and attested by a witness.
