Relating to crimes and offenses; to amend Sections 13A-6-92 and 30-3-130, Code of Alabama 1975, to define the term electronic tracking device; to add Sections 13A-6-95 and 13A-6-96 to the Code of Alabama 1975, to prohibit a person from placing certain devices on the property of another person; to prohibit a person from placing certain devices on the property of another in violation of an established court order; to provide for penalties; to make nonsubstantive, technical revisions to update the existing code language to current style; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

RECOGNIZING MARCH 21-27, 2023, AS NATIONAL SURVEYORS WEEK IN THE STATE OF ALABAMA.

Relating to Walker County; to authorize the Walker County Commission to establish voting centers throughout Walker County.

Relating to the Alabama Board of Funeral Service; to amend Section 34-13-1, as amended by Act 2022-339, 2022 Regular Session, Sections 34-13-20, 34-13-21, and 34-13-22, Sections 34-13-23 and 34-13-27, as amended by Act 2022-339, 2022 Regular Session, Code of Alabama 1975, to rename the Alabama Board of Funeral Service as the Alabama Board of Funeral Services and to provide further for definitions and the membership of the board; to add Article 5 to Chapter 13, Title 34, Code of Alabama 1975, by amending and renumbering Sections 27-17A-1, 27-17A-3, 27-17A-4, 27-17A-10 to 27-17A-25, inclusive, 27-17A-30 to 27-17A-34, inclusive, and 27-17A-40 to 27-17A-57, inclusive, as Sections 34-13-170 to 34-13-172, inclusive, 34-13-190 to 34-13-206, inclusive, 34-13-230 to 34-13-234, inclusive, and 34-13-260 to 34-13-277, inclusive, Code of Alabama 1975; to establish the Alabama Preneed Funeral and Cemetery Act of 2023; to transfer the existing Preneed Funeral and Cemetery Act, and the regulation of preneed contracts, from the Commissioner and Department of Insurance to the Alabama Board of Funeral Service; to authorize the Department of Insurance to temporarily transfer certain funds to the board to defray costs associated with the administration and operation of the Alabama Preneed Funeral and Cemetery Act of 2023; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Relating to the Alabama Forestry Commission; to establish the Rural Logging Efficiency Act of 2023; to create the Logging Efficiency Grant Fund to be administered by the Alabama Forestry Commission; and to provide for the distribution of funding to the Alabama Forestry Commission to support rural economic development.

Relating to the Employees' Retirement System of Alabama; to amend Section 36-27-59, Code of Alabama 1975, to designate the Commissioner of Corrections and deputy commissioners of corrections who have earned and maintain APOSTC certification as correctional officers or law enforcement officers for state retirement purposes; and to provide that the designation is retroactive.

Relating to criminal procedure; to amend Section 15-25-3, Code of Alabama 1975, as last amended by Act 2022-201, 2022 Regular Session, to authorize the taking of testimony by closed circuit equipment of victims and witnesses of human trafficking.

Relating to the Alcoholic Beverage Control Board; to add Section 28-3A-6.1 to the Code of Alabama 1975, to authorize a licensed manufacturer or importer of alcoholic beverages to donate a limited amount of alcoholic beverages to a licensed nonprofit special event.

Relating to crimes; to amend Sections 13A-10-30, 13A-10-36, 13A-10-37, and 13A-10-38, Code of Alabama 1975, to allow a detention facility to adopt a policy to further define what items constitute "contraband" for purposes of banning certain items from detention facilities; to further define the crimes of promoting contraband in the first, second, and third degree to apply to juveniles under certain circumstances; to make nonsubstantive, technical revisions to update the existing code language to current style; and in connection therewith would have as its purpose or effect the requirement of a new or increased expenditure of local funds within the meaning of Section 111.05 of the Constitution of Alabama of 2022.

Relating to sales and use taxes; to amend Section 40-23-5, Code of Alabama 1975, to exempt The Mike Slive Foundation from payment of state, county, and municipal sales and use taxes.

Relating to criminal procedure; to amend Section 15-25-2, Code of Alabama 1975, as last amended by Act 2022-201, 2022 Regular Session, to authorize the taking of depositions by video equipment of victims and witnesses of human trafficking under certain conditions.

Relating to voting rights; to amend Sections 15-22-36.1, 17-3-31, and 17-4-3, Code of Alabama 1975; to eliminate the application requirement and the Certificate of Eligibility to Register to Vote; to require the Board of Pardons and Paroles to determine whether an individual may have his or her right to vote restored if the individual has lost his or her right to vote by reason of conviction in a state or federal court and has been pardoned or released from incarceration or period of probation or parole; to allow an indigent individual to have his or her right to vote restored if he or she has paid all fines and restitution and is in compliance with an approved payment plan for the payment of court costs and fees or an approved community service plan to offset the payment of court costs and fees; to remove impeachment from the list of offenses that prohibit an individual from having his or her right to vote restored to make consistent with existing law; and to add Section 17-3-31.1 to the Code of Alabama 1975, to require notification to the individual that his or her right to vote has been restored.

Relating to municipalities and counties; to require the proceeds from motor fuel taxes levied by municipalities and counties to be used for road and bridge construction and maintenance with certain exceptions.

To provide for an additional circuit judgeship, designated as Circuit Judgeship Number 4, in the Nineteenth Judicial Circuit comprised of Autauga, Chilton, and Elmore Counties; to provide for an additional circuit judgeship in the Twenty-third Judicial Circuit comprised of Madison County; to provide for an additional circuit judgeship in the Twenty-eighth Judicial Circuit comprised of Baldwin County; and to provide for the authority of the judges and for the compensation and benefit of the judges.

Relating to law enforcement; to amend Sections 26-19A-2, 26-19A-3, 26-19A-4, and 26-19A-5, Code of Alabama 1975, to expand missing and endangered persons alerts to include individuals who have been abducted; and to make nonsubstantive, technical revisions to update the existing code language to current style.
