A BILL to amend and reenact ยงยง 9.1-101, as it is currently effective and as it shall become effective, and 9.1-102 of the Code of Virginia and to amend the Code of Virginia by adding in Article 1 of Chapter 17 of Title 15.2 a section numbered 15.2-1723.3 and by adding in Chapter 1 of Title 52 a section numbered 52-11.7, relating to Department of Criminal Justice Services; law-enforcement agencies and sheriff's departments; policy on use of artificial intelligence systems.

Impact

The proposed changes are expected to have a profound impact on how law enforcement agencies utilize technology. By requiring a written policy that meets or exceeds a model policy established by the Department of Criminal Justice Services, the bill emphasizes the necessity for proper guidelines regarding the data collection, use, and retention of information generated through these AI systems. This could lead to increased public trust as the policies must be made publicly available, ensuring community scrutiny and engagement in law enforcement practices.

Summary

House Bill 1170 introduces significant amendments to the Code of Virginia regarding the use of artificial intelligence (AI) systems by law enforcement agencies and sheriff's departments. Specifically, the bill mandates that each local law enforcement agency and sheriff's department establish and adopt a written policy governing the use of 'covered AI systems.' These systems are defined as any AI technology used to assist in law enforcement investigations. The bill aims to standardize practices across the state and enhance the accountability and transparency of AI applications in policing.

Conclusion

Ultimately, HB 1170 represents a proactive step toward integrating advanced technology into law enforcement while recognizing the need for ethical considerations and community involvement. As the bill moves through the legislative process, the balance between technological advancements and civil liberties will be a critical focus for lawmakers and stakeholders alike.

Contention

Notably, there may be some points of contention surrounding this bill, particularly concerning the privacy implications of using AI in policing. Critics may argue that without adequate safeguards, the use of AI could lead to potential biases and the surveillance of marginalized communities. The bill addresses some of these concerns by including provisions that prohibit the use of covered AI systems based on race, ethnicity, religion, gender, or sexual orientation unless such characteristics are part of a specific subject description. Nonetheless, the implementation and enforcement of these policies will be critical to ensuring they do not infringe on individuals' rights.
