FLOWS Act of 2026

Summary

The FLOWS Act of 2026 would create a federal grant program at the Environmental Protection Agency to help rural public water systems, treatment works, and rural areas adopt digital infrastructure technology. The bill defines that technology broadly to include remote sensing, real-time flow and pressure monitoring, analytics, industrial control systems, SCADA, artificial or embedded intelligence, and digital design and construction tools used to improve water system operations, detect leaks or damage, and support planning and construction. Under the program, grants could be used to design, construct, operate, and maintain digital tools for drinking water, wastewater, stormwater, source water protection, desalination, water reuse, distribution, conveyance, and groundwater or surface-water development. Grants could also support workforce training and cybersecurity assistance to reduce vulnerabilities to cyberattacks. The bill specifically allows grant funds to cover both the initial purchase and ongoing maintenance of software, notwithstanding other law, and directs EPA to prioritize very small systems serving fewer than 3,300 people and community-controlled or otherwise underserved entities. The bill would authorize $50 million annually from fiscal years 2027 through 2031, available until expended. It also requires the Comptroller General to study the effects of digital infrastructure technology in rural water projects and to report on issues such as water loss, fire-flow capacity, sewer bottlenecks, interoperability, project delays, cost overruns, resiliency, sustainability, and affordability. The bill states that it does not waive or limit any other applicable federal or state law governing funded projects. The likely legal impact is to add a new EPA-administered grant program and create a federal funding stream for rural water infrastructure modernization, while leaving existing federal and state permitting, environmental, and utility laws in place. It would affect rural public water systems, wastewater and stormwater utilities, tribes, states applying on behalf of eligible entities, and community-owned or locally controlled systems that seek funding for digital upgrades and cybersecurity improvements. Because there are no recorded committee transcripts or votes, sentiment cannot be measured from legislative debate or roll call history. Based on the bill text alone, the measure appears generally supportive of rural infrastructure modernization, resilience, and affordability, with an emphasis on helping small and underserved systems adopt advanced technology. The main potential point of contention is the use of federal funds for software acquisition and ongoing maintenance, as well as the scope of EPA authority and the prioritization of certain entities over others, but no specific opposition is documented in the provided materials.

Impact

The bill would amend federal water infrastructure policy by establishing a new EPA grant program for rural digital infrastructure technology and authorizing $250 million over five fiscal years. It would not preempt or displace existing federal or state requirements for water projects, but it would create a new funding mechanism that could influence how rural drinking water, wastewater, and stormwater systems plan, design, operate, and secure their infrastructure. It also directs a GAO study and report that could inform future policy on digital modernization in rural water systems.

Sentiment

No committee transcript or vote data were provided, so there is no recorded legislative sentiment to summarize from debate or floor action. The bill’s text suggests a generally favorable policy posture toward rural water system modernization, cybersecurity, and affordability, with a focus on small and community-controlled systems. Any opposition would likely center on spending levels, federal involvement in local utility operations, or the inclusion of software maintenance costs, but those concerns are not documented in the supplied record.

Contention

The bill’s most likely points of contention are the federal cost of the program, the breadth of eligible uses for grant funds, and the explicit allowance for software acquisition and ongoing maintenance costs. Another possible issue is the prioritization framework, which favors very small systems and community-controlled or underserved entities, potentially leaving larger rural systems lower in the queue. The bill also gives EPA significant discretion in administering the program and determining which entities are most in need, but no specific objections or supporters are identified in the provided materials.
