STABLE GENIUS Act

Summary

HB3849, titled the “STABLE GENIUS Act,” would bar certain federal officeholders and candidates from engaging in financial transactions involving “digital assets” during specified periods. The covered individuals include the President, Vice President, Members of Congress, delegates, the Resident Commissioner of Puerto Rico, and candidates for those offices. The bill defines covered investments broadly to include any digital asset and prohibits not only direct buying, selling, holding, issuing, sponsoring, or endorsing of such assets, but also synthetic or pooled exposure through derivatives, mutual funds, ETFs, or similar vehicles. The prohibition would apply from the date a candidate files for a covered federal election through the election, throughout the individual’s term of service, and for one year after leaving office. To comply, covered individuals would generally have to place any covered investments into a qualified blind trust approved by the relevant ethics office. The bill also requires public posting of blind trust agreements and amends federal ethics law to include the Federal Election Commission as the supervising ethics office for candidates in covered elections.

Impact

The bill would add a new federal restriction on personal financial activity by top elected officials and candidates, effectively creating a crypto and digital-asset conflict-of-interest rule for federal political office. It would amend Title 5 ethics provisions, expand reporting and oversight responsibilities to the Federal Election Commission for candidates, and authorize public disclosure of qualified blind trust agreements. It also creates civil enforcement by the Attorney General, a civil penalty of up to $250,000, disgorgement of profits, and criminal penalties for certain knowing violations involving large losses or financial gain.

Sentiment

Based on the bill text and available context, the measure appears to be framed as an ethics and anti-corruption reform aimed at limiting lawmakers’ and candidates’ exposure to digital assets. There is no recorded committee debate or vote history in the provided materials, so no formal bipartisan or partisan sentiment can be measured from proceedings. The bill’s title and structure suggest a strongly reform-oriented posture, with an emphasis on public confidence, transparency, and preventing self-dealing.

Contention

The main points of contention are likely to be the breadth of the ban and the definition of covered investments. The bill reaches not only direct ownership of digital assets but also indirect exposure through funds, derivatives, and other synthetic structures, which could affect common investment vehicles and retirement or diversified holdings. Another likely issue is enforcement and scope: the bill applies to candidates before election, officeholders during service, and for a year after leaving office, and it imposes both civil and criminal penalties. Supporters would likely emphasize ethics and anti-corruption concerns, while critics may argue the restrictions are overbroad, difficult to administer, or unfairly limit personal investment choices.
