Preventing Child Sex Abuse Act of 2023 This bill makes changes to the federal law prohibiting child sexual tourism. First, the bill revises the specific intent required for certain offenses involving interstate or foreign travel to engage in or facilitate illicit sexual conduct. Specifically, this bill requires the government to prove that an individual traveled (or facilitated travel) with the intent to engage in illicit sexual conduct (currently, with a motivating purpose of engaging in illicit sexual conduct). Further, it specifies that the term intent is to be construed as any intention to engage in illicit sexual conduct at the time of the travel. Second, the bill establishes new criminal offenses for acts in furtherance of illicit sexual conduct by an officer, director, employee, or agent of an organization through his or her connection to or affiliation with the organization. A violation is subject to a fine, a prison term of up to 30 years, or both. Finally, the bill specifies that the term sexual activity for which any person can be charged with a criminal offense does not require interpersonal physical contact.

Relates to creating the crime of attempt to engage in sexual conduct with a person incapable of consent when an individual communicates such individual's intent to engage in sexual conduct with the victim, and engages in certain acts which would tend to further effect the commission of such sexual conduct; designates such attempt as a class C felony, class E felony, or class A misdemeanor; designates individuals convicted of such crime as sex offenders.
Requires lifetime post-release supervision for offenders convicted of rape in the first degree, criminal sexual act in the first degree, aggravated sexual abuse in the first degree, course of sexual conduct against a child in the first and second degrees or sexual abuse in the first degree when the other person is less than eleven years old; prohibits good behavior allowances against a determinate sentence for a person convicted of any such crimes.
Authorizes a court to conduct a contradictory bail hearing prior to setting bail for a person in custody who is charged with certain sexually based offenses against a child under the age of eighteen
To Amend The Law Concerning The Offense Of Sexually Grooming A Child; And To Include Bribing Or Attempting To Bribe A Child In The Offense Of Sexually Grooming A Child.
Prohibits the distribution, transfer, or possession of any material that depicts a minor engaging in sexually explicit conduct and is obscene and lacks serious literary, artistic, political, or scientific value.
