AN ACT to amend Tennessee Code Annotated, Title 8, relative to district attorneys general.

Summary

HB0483 authorizes the Tennessee attorney general and reporter to conduct a study of the thirtieth judicial district, which includes Memphis, focusing on how the district attorney general handles criminal charges and related matters. The study must examine dispositions of cases arising from the Memphis Safe Task Force, including plea deals, convictions, dismissals, declinations to prosecute, and the reasons for reducing or dismissing charges. It also must review recommendations on pretrial release and bail, the use of office funds and grant money, and any other alleged misconduct or unlawful acts connected to the district attorney general’s duties. The bill gives the attorney general broad access to records and information maintained by the district attorney general, even if not publicly available, while requiring confidentiality protections for privileged or sensitive material. The attorney general must report findings to legislative leaders by January 1, 2027. If the study finds clear evidence that the district attorney general has categorically refused to prosecute offenses based on an unjustifiable and unconstitutional standard, or otherwise failed to prosecute according to law, the attorney general may petition the Tennessee Supreme Court to appoint a district attorney general pro tem to handle those prosecutions.

Impact

The bill adds a new section to Tennessee Code Annotated Title 8, Chapter 6 and amends Section 8-7-106 to create an express process for seeking a district attorney general pro tem when a district attorney general is found to have refused to prosecute according to law. It expands the attorney general and reporter’s oversight authority over a local district attorney general’s charging decisions, office practices, and use of funds in the thirtieth judicial district, and it creates a statutory basis for possible judicial replacement of the elected prosecutor in limited circumstances. The measure primarily affects the district attorney general’s office, the attorney general and reporter, the comptroller if auditing is needed, and the Tennessee Supreme Court if a pro tem appointment is sought.

Sentiment

The bill appears to have been generally supported by majorities in committee and on the floor, but with notable opposition, as reflected in several close committee votes and substantial minority no votes on final passage. The recorded votes suggest the measure was viewed by supporters as a public-accountability and public-safety oversight tool, while opponents likely saw it as an aggressive intervention into prosecutorial discretion and local autonomy. The bill ultimately passed both chambers and was enacted.

Contention

The main point of contention is the bill’s focus on the thirtieth judicial district and the Memphis district attorney general, which makes it highly targeted rather than statewide. Supporters appear to favor scrutiny of charging decisions, bail recommendations, and office spending, especially in connection with the Memphis Safe Task Force and alleged nonprosecution. Opponents likely objected to the breadth of the attorney general’s access to confidential records and the standard allowing intervention based on a finding of categorical refusal to prosecute, which raises concerns about separation of powers, prosecutorial independence, and politically motivated oversight.
