South Carolina House Bill H3946

Introduced
2/11/25

Caption

A BILL TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 40-11-360, RELATING TO EXEMPTIONS FROM CONTRACTOR LICENSING REQUIREMENTS FOR OWNERS CONSTRUCTING FARM BUILDINGS OR PORTABLE STORAGE BUILDINGS WITH LESS THAN FIVE THOUSAND SQUARE FEET OF FLOOR SPACE USED ONLY FOR LIVESTOCK OR STORAGE, SO AS TO INCREASE THE SQUARE FOOTAGE LIMITATION TO FIFTY THOUSAND SQUARE FEET AND TO INCLUDE POULTRY AMONG THE QUALIFYING USE PURPOSES.

Summary

H3946 amends South Carolina’s contractor licensing law to expand an existing exemption for certain owner-built agricultural and storage structures. Under current law, an owner constructing a farm building or portable storage building used only for livestock or storage is exempt from contractor licensing requirements if the building is under a specified size threshold. This bill raises that floor-space limit from 5,000 square feet to 50,000 square feet and adds poultry as an eligible use, so more farm-related construction projects can be completed without requiring a licensed contractor. The bill is narrowly focused on Section 40-11-360(7) of the South Carolina Code and would change the scope of who must comply with contractor licensure rules for these types of buildings. If enacted, it would reduce regulatory burdens for farmers and other owners building larger agricultural structures for livestock, poultry, or storage, while leaving the rest of the contractor licensing framework intact. The act would take effect upon the Governor’s approval.

Impact

H3946 would directly amend the contractor licensing exemptions in South Carolina law by broadening the owner-builder exception for farm and portable storage buildings. The practical effect is to allow owners to construct much larger agricultural buildings—up to 50,000 square feet—without triggering contractor licensure requirements, so long as the buildings are used only for livestock, poultry, or storage. This would primarily affect farmers, agricultural property owners, and those involved in rural or on-farm construction, while narrowing the circumstances in which the state’s licensing rules apply to these projects.

Sentiment

The available context shows no committee transcripts, recorded votes, or formal opposition, so there is no documented debate to indicate strong controversy. Based on the bill’s text and caption, the measure appears to be a pro-agriculture regulatory relief bill, likely to be viewed favorably by farm and rural interests because it expands flexibility for owner-built structures. With no recorded vote history or discussion snippets, the overall sentiment can only be characterized as neutral to supportive from the face of the legislation.

Contention

The main policy issue is the expansion of the contractor licensing exemption, especially the increase from 5,000 to 50,000 square feet, which could be seen as a significant loosening of oversight. Supporters would likely argue that the change better fits modern agricultural building needs and reduces costs for farmers, particularly for poultry and livestock operations. Potential concerns, if raised, would center on whether larger structures should still require licensed contractors for safety, quality, and consumer protection reasons, but no specific objections are documented in the provided materials.
