The Energy and Natural Resources Committee continued work on House Bill 1459, which concerns rare earth and critical mineral recovery from North Dakota lignite coal. Jody Smith of the Retirement and Investment Office presented updated language adding guardrails for in-state infrastructure investing, including requiring approved projects to be underwritten and managed by a qualified investment manager or financial institution and to follow the Legacy Fund investment policy. Members discussed whether the amendment had been shared with the House sponsor and noted that the related bill 1330 was still pending, so HB 1579 was being held for the time being.
Finally, the committee took up House Bill 1566, which had an amendment from the Agriculture Commissioner’s office. The committee adopted the amendment 7-0, then passed a due-pass motion on the amended bill and referred it to Appropriations, also by a 7-0 vote. Members discussed the bill’s fiscal impact, including an estimated $580,000 for two FTEs over two years, and clarified that the study component remains in the bill. Senator Gerhardt was assigned to carry the measure.

The Dr. Martin Luther King Jr. Memorial Commission Tribute to Senator Yvonne Miller Work Group met to discuss plans for Senator Miller’s portrait. Members introduced themselves, then took a walking tour of the Capitol to review possible placement locations. After returning, the group agreed the first-floor rotunda area appeared to be the best recommendation because of its visibility, traffic, and central location between the House and Senate, which was seen as especially fitting given Senator Miller’s service in both chambers.
The work group also discussed how to select the portrait artist. Members described prior practices of reviewing artists’ websites or portfolios, narrowing the field to a few candidates, and then comparing style and pricing before making a choice. House staff noted that a portrait vendor or agent could help identify artists, and the group discussed whether a formal RFP was required. Counsel explained that the commission could seek an exemption under the VPPA, allowing a more flexible selection process without following the full statutory procurement procedure.
Members said the exemption request would be handled quickly and included in the report for the full commission meeting the next day. They also agreed to provide a photo of the recommended portrait location for members who had not taken the tour, and to revisit the family’s preferred image so it could be matched to the portrait requirements. The meeting ended with plans to report the location recommendation and continue the portrait selection process at the full commission meeting.

The committee then heard House File 3707, brought by Representative Berg, which would extend confidentiality protections to unemployment insurance and paid leave judges and related staff by adding them to the definition of judges for purposes of protecting personal information. Berg and testifiers from the Department of Economic Development and MAPE said the bill responds to harassment and safety concerns, including threats, doxxing, and an attack near an office, and is intended to protect people making sensitive determinations. MAPE supported the bill as an update to existing protections for similar workers.
Members raised concerns that the bill’s language was too broad, especially the reference to the paid leave division, and questioned whether it should cover only judges or also call-center and other staff. Department and committee members agreed the language likely needed narrowing and discussed possible amendments and whether to move the bill to Judiciary and then revisit it. No final vote was taken on HF 3707 during the discussion, and the bill remained under consideration for further language work.
