  • I do want to point out one area where this bill could be improved, and that is in Section 5(c).
  • I'd just say that the first section where it does create the right to counsel is particularly important
Bills: HB115
Summary: The Committee on Criminal Jurisprudence reconvened with a quorum present and announced it would likely not vote that night because of confusion over the bill list; members were told a definitive list would be circulated the next morning and a formal meeting would be scheduled later. The chair then heard a series of bills, generally taking testimony and leaving each pending without action. House Bill 1847 would set maximum caseload standards for private attorneys handling indigent criminal appointments through the Texas Indigent Defense Commission; House Bill 2417 would expand compensation eligibility for some wrongfully imprisoned people; House Bill 2813 would require earlier and more specific victim notice of scheduled court proceedings; and House Bill 2309 would expand state and local authority in certain civil asset forfeiture cases involving human trafficking, health care fraud, and organized crime. Each bill was laid out by its author or a member, with no opposition witnesses registered, and each was left pending. The committee also heard House Bill 4733, which would require sealing records for people acquitted of charges when they were not convicted on the related allegation; House Bill 2328, which would modernize expunction service by encouraging electronic notice, setting a standardized fee when electronic service is unavailable, extending clerk retention of expunction orders, and preserving certain mental health commitment orders; and House Bill 115, which would revise Texas’s “junk science” post-conviction writ law by providing counsel, changing the relief standard, requiring written decisions, and easing procedural barriers. Testimony on HB 2328 was mixed: county clerks supported the bill as a cost-saving modernization, while legal advocates warned that permanent retention of expunction orders could undermine true expunction and create privacy risks. HB 115 drew support from innocence and defense organizations, with some concern about a provision affecting subsequent writs. All were left pending after testimony. Later, the committee heard House Bill 2046, which would allow affirmative family-violence findings for any Penal Code offense rather than only Title V offenses; testimony from a Dallas County prosecutor and a committee member emphasized that family violence can involve arson, burglary, fraud, and other non-Title V conduct, and the bill was left pending. House Bill 1765 would tighten restrictions on no-knock warrants by requiring higher-level approval, judicial review, and identifiable officers; members discussed the dangers highlighted by the Harding Street raid and similar incidents, and the bill was also left pending. The meeting ended with the chair noting that some bills had been removed from the agenda at the author’s request and that members should be prepared to finalize the vote list the next day.

Summary: The Senate Intelligence Committee convened for a significant meeting focused on the Annual Worldwide Threats Hearing. Prominent officials from various intelligence agencies presented their insights on emerging national security threats, including concerns over increasing cyber threats, particularly from China and non-state actors. A major discussion point included the balance between national security and civil liberties, as evidenced by conversations surrounding Section 702 of FISA and its implications for privacy protection. The challenges posed by cartels and transnational criminal organizations, especially related to narcotics trafficking, were emphasized as pressing issues necessitating coordinated responses from federal, state, and local law enforcement agencies. This meeting underscored the necessity of public-private partnerships to tackle these multifaceted threats effectively.

Summary: The committee heard a long series of bills, most of them expanding or adjusting hotel occupancy tax or qualified hotel project authority for specific local governments. Measures discussed included HB 2404 for Childress County; HB 3066 for Allen’s Kalahari resort project; HB 4682 for Plano; HB 4683 for Anna; HB 3076 creating a project finance zone in Frisco; HB 3567 for Wichita County; HB 3715 for McAllen; HB 1039 for Alpine; HB 3182 for Burleson; HB 4926 for Grimes County; HB 4222 for Victoria County; HB 3377 for Katy; HB 4659 for Addison; HB 3241 for Georgetown; HB 4098 for Taylor; HB 3178 for Kerr County; HB 3179 for Mason County; HB 2289 for New Braunfels; HB 4412 for Kermit; HB 5165 for Monahans; HB 3500 for Bastrop; and HB 3169 for Carrollton. In each case, authors and local officials described tourism, convention, hotel, airport, or mixed-use development needs and argued the bills would help attract visitors, investment, and jobs. One non-hotel-tax bill, HB 4226, would exempt Texas food banks from sales tax on vehicle purchases and rentals, with testimony emphasizing the scale of food bank operations and the savings’ impact on meal delivery and disaster response. Testimony was generally supportive from city officials, economic development representatives, and industry groups such as the Texas Hotel and Lodging Association. Several witnesses described major private projects, including Kalahari in Allen, a proposed hotel and conference center in Addison, a mixed-use project in Georgetown, and a large development tied to Samsung growth in Taylor. For HB 4226, food bank representatives said the bill would help them purchase refrigerated trucks and other delivery vehicles, while an opponent questioned the fiscal note and the scope of the exemption. HB 4926 drew opposition from Camp Allen, whose representative argued a new county hotel tax would raise costs for guests and could hurt the retreat center’s operations. HB 3178 also drew an objection from a Kerr County resident who argued the tax would grow county government and pointed to event center losses, though the author said the revenue would support tourism-related county uses. The committee took no final votes on the bills in this transcript. After each bill was laid out and testimony concluded, the chair repeatedly asked whether there was objection to leaving the bill pending; in each instance, no objection was heard, and the bills were left pending. Several committee substitutes were offered and then withdrawn or noted as conforming drafts, but no bill was reported out or otherwise acted on beyond being left pending.

Bills: HB1053
Summary: The committee took up House Bill 1298 and first discussed an amendment from Senator Paulson that would add variable electronic speed limit signs to the bill while leaving the 80-mile-an-hour provision unchanged. Members said the signs would be used on interstates I-29 and I-94 in selected problem areas, based on weather or accident conditions, and that the proposal would not require a fiscal note. The discussion then broadened to Senator Rummel’s concerns about related bills, especially 2243, 1250, and 1229. He argued that the House changes were removing municipal authority to double fines, lowering or eliminating points for serious traffic violations, and undoing prior Senate positions. Several members said they were willing to use HB 1298 as the vehicle to restore the earlier fine and point provisions, including the 29 violations previously assigned three points, and to avoid concurring with the House versions. Members did not take final action on the amendments or the bill. Instead, they agreed more work was needed and asked Legislative Council to prepare a combined amendment and options for the next meeting. The committee recessed and scheduled further discussion for the next morning.

Summary: The Committee on Governmental Oversight and Accountability met and first postponed SB 350 for a future meeting. The committee then considered a series of Open Government Sunset Review bills preserving or extending public records and public meeting exemptions. SB 7000, relating to emergency shelter recipients’ address and phone information, and SB 7002, relating to Department of Military Affairs records in Department of Defense systems, were both amended to set a new sunset date of October 2, 2031 and reported favorably. SB 7012, concerning Department of Highway Safety and Motor Vehicles records, was amended to conform its effective date with the House companion and also reported favorably. The committee next heard SB 7006, which preserves exemptions for certain Florida Public Service Commission hearing portions involving confidential proprietary utility information, and SB 7008, which preserves similar exemptions for the Florida Gaming Control Commission; both were reported favorably without amendment. SB 7004, concerning conviction integrity unit investigation information, was also reported favorably after testimony that state attorney conviction integrity units support keeping the exemption in place beyond its current repeal date. Later, the committee took up SB 7014, presented by Senator Arrington on behalf of Senator Leitz, and adopted a committee substitute extending to October 2, 2031 two exemptions tied to Department of Legal Affairs investigations of social media platforms. The committee also approved SB 7016, which preserves the exemption for certain financial information used by economic development agencies to administer small business loan programs. At the end of the meeting, members recorded affirmative votes on several bills and the committee adjourned.
