Summary: The committee on Consumer Protection and Commerce met on February 26, 2026, and heard several bills, mostly in the areas of workers’ compensation and consumer protection. HB 1946 HD1 on timeshare registration renewal drew support from DCCA’s timeshare program and major industry groups including Hilton Grand Vacations, the American Resort Development Association, and Marriott Vacations Worldwide, with no opposition noted. HB 1515 HD1, which would allow an attending physician to request a functional capacity examination without employer permission, was supported by DLIR and the Department of Human Resources Development and had no other in-person testimony; the bill was then moved on without questions. The committee spent substantial time on HB 1514 HD1, which would streamline workers’ compensation vocational rehabilitation by clarifying provider selection and requiring vocational plans within 90 days. DLIR supported the intent but asked for amendments, saying the 90-day deadline was too rigid given case-by-case complexity, limited staffing, and the need for coordination among injured workers, employers, and counselors; members discussed possible extensions and whether a 120-day timeline or other flexibility would be better. Testimony on the bill included one individual in support and seven in opposition. HB 1648 HD1, concerning workers’ compensation and physician dispensing of non-prescription drugs, drew support from DHRD and comments from DLIR and industry witnesses. After a recess, the committee took up SB 1296 on the Public Employees Relations Commission, as substituted by a committee PCS. The PCS would change union certification and recertification rules, require stronger showing-of-interest and voting thresholds, limit paid union leave in some cases, require equal access to employer communication spaces, and speed up impasse procedures for state-funded salary increases. The bill drew extensive testimony, with supporters arguing it would improve accountability, transparency, and taxpayer fairness, and opponents—many of them teachers, bus drivers, and other public employees—saying it would weaken collective bargaining, burden workers, and function as union busting. Members raised constitutional concerns about the single-subject rule and collective bargaining protections, and debate was ongoing at the end of the transcript.

Summary: The Senate considered and passed several House bills. HB 2624, relating to consumer protections for unsolicited real estate transactions for public purposes, was amended with a striking amendment from the Business, Trade, and Economic Development Committee and then passed 30-18, with Senator Dozier voting no and saying the bill still needed work. HB 2104, which makes permanent aviation assurance funding for wildfire response by removing a sunset clause, passed 47-0 with two excused after Senator Short urged support based on its wildfire-fighting value. The Senate also adopted an amendment to Substitute HB 2334, which addresses cash transactions and rounding to eliminate the need for pennies, adding language that customers with exact change must be able to pay exact change. The bill passed 45-2, with Senator Frame describing it as permissive guidance for businesses and Senator Dozier supporting it humorously; Senator Gainer voted no. HB 2436, concerning requirements for oil tankers operating in restricted waters and clarifying tugboat horsepower standards to match current practice, passed 46-1 after support from Senator Lovelett and Senator King. Finally, Engrossed HB 2575, reducing certain reporting obligations under environmental or energy laws, passed 47-0 with two excused. Senator Schumaker said it would save administrative costs for the Department of Commerce and utilities and free up money for low-income energy assistance. The Senate then adjourned until the next day.
