Summary: The Senate Transportation Committee reconvened on SB 2722, as substituted by Senator Bettencourt, which would redirect a portion of Harris County Toll Road Authority surplus revenues to the City of Houston and impose audit and tax-rate penalty provisions. Houston Police Chief Noe Diaz and Fire Chief Thomas Munoz testified in support, arguing that Houston bears a large share of toll-road public safety burdens, citing thousands of police and fire responses on toll-road property and the need for compensation for emergency services. Bill King, testifying neutrally, said the toll authority generates large excess revenues and urged stronger oversight and clearer controls on how the money is spent. Opponents, including Harris County officials, business and neighborhood representatives, and toll-road critics, argued the bill would divert transportation dollars, create a precedent for taking toll revenues for general municipal use, and could worsen project delivery and incentives; several also questioned the accuracy and interpretation of the revenue figures and the lack of comparable audit requirements for the city. The committee took extensive testimony but left SB 2722 pending without a vote. The committee then heard SB 2129, which would increase fines for motorists who disregard railroad crossing gates or flaggers, and SB 2323, which would redact railroad crew members’ personal information from public accident reports. Both bills were presented as safety measures, with railroad labor testimony in support, and both were left pending after brief public testimony. The committee also heard SB 2141, a Zaffirini bill concerning specialty license plates for judges, with the substitute aimed at reducing security risks by changing how judges are identified on plates; it too was left pending. Finally, the committee heard SB 2439, another Zaffirini bill, described as a TDLR cleanup measure related to ATV and off-highway vehicle safety certification. The bill would abolish the current training and certification program, which supporters said was burdensome and underused given the small number of approved instructors statewide. With no significant opposition on the record, the committee closed testimony and left SB 2439 pending as well.

State Affairs (Part I) Mar 20th, 2025

State Affairs

Summary: The Senate Committee on State Affairs met and heard several bills related to legislative process and court jurisdiction. Senate Bill 1386, by Senator Huffman, would change compelled legislative testimony from blanket transactional immunity to testimonial immunity, allowing compelled statements or documents to be used against a witness in criminal prosecution only if not derived from the compelled testimony, while preserving protection against perjury and false statements and retaining the right to counsel. No public witnesses testified, and the bill was left pending. The committee then heard Senate Bill 1470, by Chairman Hughes, which would require DPS to share existing data on cross-state driver’s license cancellations with the Secretary of State for voter-roll maintenance. Hughes said the bill does not create new data collection and is intended to improve list maintenance. A DPS resource witness was present, there was no substantive opposition, and the bill was left pending. Senate Bill 1210, also by Hughes, would address conflicts between the Texas Supreme Court and the Court of Criminal Appeals on constitutional questions by making the Supreme Court the final arbiter in limited circumstances. Chris Hilton supported the bill, but Allen Place, Jack Rohde, and Philip Furlow opposed it, arguing it was unconstitutional, unnecessary, and could create practical problems in criminal post-conviction litigation. The bill was left pending after testimony. The committee also heard Senate Bill 311, which would conform the Government Code to the Texas Constitution by clarifying the Supreme Court’s original writ authority against lower courts and officials other than the governor. Justice Evan Young and Chris Hilton supported the bill as a clarification of existing authority, while no one testified against it; the bill was left pending. The committee then recessed to allow the chamber to rearrange for the Senate session.

Summary: The Senate convened with 26 members present, heard a prayer from Dr. Steve Horn, and recited the pledge. The chamber then handled messages from the House, including concurrence in SCR 83 and appointment of conference committee members on several disagreements. A number of Senate resolutions were introduced or adopted, mostly creating study task forces or commending individuals and organizations, including resolutions on energy infrastructure, breast pump access, insurance coverage for auto repairs, biomarker testing, higher education funding, public-private partnership contracting, and various commendations. Several resolutions were adopted without objection, while others were returned to the calendar or concurred in by recorded vote, including SCR 29 and SCR 33 with House amendments. The Senate also considered House and Senate bills and resolutions returned from the House, with many measures adopted or concurred in. Notable actions included concurrence in HCR 117 on homeowner insurance claims processes, adoption of HCR 5 on special red drum harvest permits, and passage of bills on TOPS Tech eligibility (HB 325), vapor product permitting (HB 623), ABLE/Tuition Trust administration (HB 749), design services contracting (HB 755), rare cancer advisory board composition (HB 761), non-emergency medical transportation reimbursement (HB 1028), public meeting notices (HB 1049), healthy food retail financing (HB 1194), genetic testing coverage for SCN2A disorders (HB 1199), grocery initiative grants (HB 1222, which failed), and a constitutional amendment on retirement debt repayment order (HB 27). The chamber also adopted HCR 95, creating a joint rule requiring a fiscal review of certain tax measures for sales and use tax uniformity. Several measures drew extended debate. HB 181, which would allow the legislative auditor access to Medicaid and SNAP-related tax information for eligibility verification and fraud review, prompted concerns about privacy and scope but ultimately passed 26-8. HB 1220 on the State Board of Medical Examiners generated amendment discussion about board composition and transparency, including live video broadcasting of meetings, but was returned to the calendar before final action. HB 1018, creating a temporary local moratorium on certain alcohol permits in one Shreveport district, passed after discussion about broader policy solutions. The Senate then recessed for lunch at 2 p.m. after completing the subject-to-call list for the morning session.
