One member said the bill should not prevent cities from requiring stormwater facilities because maintenance costs and water-quality responsibilities can be substantial and should not be shifted to all taxpayers. The authors responded that the amendment language was intended to balance concerns about unnecessary HOA mandates with the need to address maintenance, noting that some maintenance responsibilities could remain with cities or be handled through developer agreements.
