Summary: The Senate Committee on Border Security met with a quorum present and first took up HCR 98, a resolution urging Congress to improve coordination among federal, state, and local authorities on counter-unmanned aircraft systems (C-UAS) technology for border security. The author and sponsor described increasing drone activity along the border, saying unauthorized drones are used to track agents, identify weaknesses, and smuggle contraband, and argued for clearer procedures to detect, identify, and neutralize such aircraft. There was no public testimony, and the committee voted 4-0 to report HCR 98 favorably to the full Senate; the resolution was also ordered for local and uncontested calendar placement without objection. The committee then heard HB 180, sponsored by Chairman Birdwell, which would authorize the governor to coordinate directly with Mexican officials and individual Mexican states on border security agreements and appoint representatives to implement them. Birdwell said the bill would codify prior border-security cooperation efforts, improve responses to cross-border challenges such as drug and human trafficking, and include a finding that entrants from foreign countries must use a legal port of entry. No questions were asked, and there was no invited or public testimony. After the hearing, the committee left HB 180 pending. The meeting concluded with no further business and the committee standing in recess subject to the call of the chair.

Summary: The Committee on Children, Families, and Elder Affairs considered four bills. SB 590, by Sen. Bradley, would toll the statute of limitations for failure to report suspected child abuse by mandatory reporters until the offense is known to law enforcement; an amendment clarified retroactive application for offenses not already time-barred by the bill’s effective date. Sen. Bradley said the bill is intended to ensure accountability in institutional abuse cases and not to change the reasonable-suspicion reporting standard. The committee adopted the amendment and reported the bill favorably. The committee also heard SB 778, by Sen. Simon, which would update the definition of forensic client so certain individuals with intellectual disabilities or autism whose charges were dismissed for incompetency can be housed with other Chapter 916 residents, reducing duplicative staffing and space needs at the Agency for Persons with Disabilities. Barney Bishop appeared in support, and the bill was reported favorably without amendment. SB 560, by Sen. Garcia, would streamline procedures for psychotropic medication prescriptions for children in DCF custody, reduce duplicative background checks and reporting, and simplify consent documentation. Amendments removed language allowing licensed clinical social workers and marriage and family therapists to serve as evaluators and narrowed changes to the Road to Independence Program’s postsecondary education services and supports, extending eligibility ages from 18 to 26 while keeping the five-year cap. Senators discussed the fiscal impact and funding blend for the education stipend. The committee adopted the amendments and reported the bill favorably. The committee then took up SB 1010, by Sen. Yarbrough, which adds criminal and civil enforcement for violations involving sex-reassignment prescriptions or procedures for minors and related parental-rights provisions. An amendment clarified that the civil action authority applies to minors and that damages benefit the affected minor. Public testimony was heavily divided, with supporters saying the bill enforces existing protections and opponents warning it would chill care, counseling, and school-based support for transgender youth. Senators Harrell, Sharief, and Rouson raised concerns about vagueness, standing, and impacts on teachers and health professionals; Sharief voted no, while the bill was still reported favorably.

Senator Schaible walked through the final version, which included changes to foundation aid, transportation grants, free and reduced-price meals funding, paraprofessional and teacher support programs, Native American education items, library and school facility projects, and several one-time grants. Members discussed removing the science center grant funding, and Senator Meyer objected to that removal, arguing that Grand Forks had raised matching private and local funds and that other cities had received similar state support. The committee also agreed to adjust regional education association funding to reflect six centers rather than seven, reducing that line to $600,000. The committee then adopted the amendment to 10-13 unanimously and passed the bill as further amended on a unanimous roll call, with Senator Shively designated as carrier. After a brief recess, the committee turned to bill 1540, but no formal action was taken. Bank of North Dakota and OMB representatives raised concerns that the draft included policy changes and procurement/IT exemptions that needed further discussion. Members agreed the bill would be delayed until Monday so the Bank, OMB, and NDIT could confer and work through the mechanics and policy issues before the committee moved it forward.
