Bills: SB2613 , SB2147
Committee: Senate Education
Summary: The committee heard SB 2613, a cleanup bill relating to public school land transfers under Act 307 (2022), which revises tax map key references and the conveyance process for properties transferred to the Department of Education. The Hawaii State Public Library System supported the measure, saying it would complete the long-unfinished separation of the library system from DOE property control and make future building projects more efficient and cost-effective. DOE also supported the bill and requested an amendment to remove TMK 43-62 parcel 10, the Wilcox Elementary School parcel, so that it could instead be transferred to the county for use with the adjacent park and tennis courts. Members focused heavily on why land transfers and construction approvals have been slow, especially the need for right-of-entry documents and an MOA for a library construction project. Library and DOE witnesses said the delays stemmed from site-control issues and confusion over property status, and that the bill would clarify which parcels are transferred by operation of law and remove the need for additional transactional documents in many cases. Several members questioned whether the bill actually changes authority or simply clarifies existing practice, and DOE said it wanted legislative clarity so the transfers are unmistakably effective on a date certain. The committee also discussed a separate section of the bill dealing with public use of school facilities after hours, including parking fees on property under DOE jurisdiction. DOE explained that any parking charges would apply only to property it controls, not county roads, and that fees are set through existing facility-use procedures. Members raised concerns about the pace of land transfers generally and urged DOE to move more expeditiously on pending parcels. The hearing then moved on to SB 2147, which would designate the first Friday in February as Love My Library Day; the library system testified in support as the committee began that measure.

Bills: SB1177
Summary: The Senate Appropriations Committee met to consider Senate Bill 1177, the general appropriation bill. The chair and budget authors explained that the proposal was built to balance the budget using a mix of general revenue, cash sweeps, and other fund transfers, including money from unclaimed property, revenue stabilization, and other statutory funds. Members also discussed a proposed $35 million OWRB revolving loan fund tied to ARPA interest and a $200 million transfer from the Revenue Stabilization Fund to the Taxpayer Endowment Trust Fund as part of a long-term savings strategy. A number of agency-specific items drew questions. Members reviewed the OPEB employer contribution reduction, rent coverage for state agencies, child care and Head Start funding, Department of Corrections revenue from ICE-related agreements, sheriff grant funding, and education funding, including about $99 million in additional formula funding, a $2,000 teacher pay raise, and reading-related appropriations such as Strong Readers and Just Right Reader. The committee also discussed mental health funding, including a $30 million consent decree line, a proposed privatization of CCBHC services with an estimated $10 million savings, and related reduction-in-force costs. Other topics included Attorney General transfers and litigation funding, higher education allocations, Langston University extension funding, historical society requests that were not funded, and a biosolids pilot program. During debate, supporters argued the bill fulfilled the constitutional duty to pass a balanced budget and highlighted increases for education, health care, and water infrastructure. Opponents criticized the use of one-time cash, tax cuts, and what they described as special-project spending, while raising concerns about transparency and underfunded services such as child care and transportation. After debate, the committee voted 18-5 to pass Senate Bill 1177.

Bills: SB1177
Summary: The Joint Appropriations and Budget Committee took up Senate Bill 1177, the main budget bill, and first adopted the committee substitute as the working version. Chairman Caldwell presented the bill as the measure funding state government and answered a series of questions about major budget items, including CareerTech funding, child care, school security, teacher pay raises, the state plane purchase, Medicaid, mental health, veterans’ homes, and higher education projects. He said CareerTech received increased funding, child care funding was increased by roughly $12 million over last year, school security funding was continued at $50 million, and teacher pay raises were included through a mechanism that would raise the state minimum by $2,000. He also explained the $3 million state plane item as a restructuring of state aviation assets, and said the budget did not cut law enforcement funding tied to 287(g) agreements.

  • very open to those discussions, but we do see the benefit of having a consistent standard for the public
Bills: SB2661
Summary: The Legislative Management committee met to hear Senate Bill 2661 SD1, which addresses nepotism. The bill’s sponsor said it would create a uniform state standard covering the judiciary, legislative branch, and related offices such as the Ombudsman, Auditor, and State Ethics Commission, and would include a good-cause exception to allow for unique circumstances, especially in rural areas. The sponsor emphasized the value of a consistent public standard and said the measure was intended to be transparent and broadly applicable. A member asked whether the bill would apply prospectively and how it would affect current employees. The sponsor responded that it would apply prospectively but would still affect existing supervisory relationships involving related or household members, unless a good-cause exception or grandfathering provision were added. The sponsor noted that the current bill does not contain a grandfather clause and described how, in the executive branch, similar situations were handled by changing supervision or temporarily delaying enforcement to work through transitions. The committee then moved to decision-making and recommended passing SB 2661 SD1 with amendments, including changing the effective date to July 1, 3000. The acting chair, vice chair, Representative Morikawa, and Representative Matsumoto voted in favor; Representative Quinlan was excused. The recommendation was adopted and the meeting adjourned.

Bills: SB392 , HJR1086
Summary: The committee, chaired in part by Vice Chair Norwood, considered two measures. H.J.R. 1086 was presented as the first resolution of the year, approving administrative rules for judicial and public safety agencies submitted by the February 1 deadline. After brief discussion, the committee moved to vote and passed the resolution 13-0. The committee then took up Senate Bill 392, which would extend the Oklahoma Strategic Military Planning Commission. Members noted the commission had expired on December 31 and that the issue had only recently come to their attention. The bill was moved for adoption, there was no further question or debate, and it also passed 13-0. After the votes, the chair thanked members for their work, noted that the education bundle had been completed and a draft was being prepared, and said rules for business and commerce had been sent out for review before the upcoming deadline week. The meeting then adjourned.

Summary: The Senate Committee on Retirement and Government Resources considered a series of retirement, pension, and state employee bills. Senate Bill 1870 would let small municipalities in OPERS with populations of 2,000 or less opt out for new employees; members questioned the fiscal impact and the bill passed 8-0 after the chair struck the title to get a clearer actuarial analysis. Senate Bill 1722 passed 9-0 and would require OMES construction contract fees to be based only on construction costs, not interior design and furnishings, with members discussing how to define those terms and whether historical or specialized projects could still be accommodated. Senate Bill 1639 passed 9-0 after an amendment removed provisions affecting the Indian Education Act commission, leaving a bill to repeal several dormant boards and commissions. The committee also passed Senate Bills 715 and 716, which would increase municipal contributions to firefighter and police pensions, respectively; members raised concerns about city budgets, and the sponsor said he was open to phasing in the increases. Senate Bill 182 passed 5-2 to add certain DHS Inspector General officers and OJA residential care specialists to hazardous duty retirement, and Senate Bill 609 passed 7-0 to allow police recruits to buy up to five years of prior out-of-state service credit as a recruitment tool. The committee then passed Senate Bill 169 5-2 to increase state employee longevity pay by 50%, with supporters citing high turnover and opponents warning about budget pressure and the need for broader raises. Senate Bill 134 passed 7-0 to shorten the waiting period for county employees to return to work from one year to six months. Senate Bill 432 passed 6-0 to raise volunteer firefighter pension benefits, and because it was double-assigned it would next go to Appropriations. Senate Bill 1407 passed 7-0 after an amendment requiring OMES to provide the Commission on the Status of Women an itemized accounting of funds; the bill generally clarifies staffing and financial reporting authority for the commission. Finally, Senate Bill 2039 passed 8-0 after an amendment narrowing the bill to military personnel who are also teachers and defining salary for buyback purposes; the sponsor said the measure would help service members return to teaching and buy back up to five years of credit. The committee also passed Senate Bill 1356 7-0, a broader OMES cleanup bill moving certain functions elsewhere, though members flagged concerns about relocating the state use program and the pay-for-success fund and suggested further study on those sections.
